On behalf of our client, Bermuda Greens Associates, Inc., please accept this email as an initial response to the attached
NOV-2019-RV-0002, dated 2-19-19, regarding a failure to Renew and Transfer Stormwater Permit No. SW7020602
issued for the existing commercial development located at 5312 N. Virginia Dare Trail in Kitty Hawk, NC. The following is
a brief explanation of the ownership and occupancy of the development and actions being taken toward resolving the
Violation. Bermuda Greens Associates, Inc. owns the property that was originally leased to and developed by JDH
Capital, LLC as an Eckerd Drugs store. In association with construction of the commercial project, the referenced high
density stormwater permit was secured in the name of JDH Capital, LLC. Some years later the store's occupancy changed
from Eckerd Drugs to a Rite Aid Pharmacy and, within the past month, has changed again to a Walgreens. According to
the recent NOV, both the landowner and Rite Aid of North Carolina, Inc. were notified that the stormwater permit had
expired on August 2, 2016. It is the landowner's desire to have the permit remain in the name of the lease holder and to
this end, has been reaching out to Walgreens in an attempt to have the permit renewed and transferred in their
name. On 3-14-19, a representative of Walgreens responded by copying their engineer, Andrew Wojcik, for
advisement. As of earlier this afternoon the landowner had received no further response from Walgreens regarding a
plan of action and has followed up. In consideration of the forthcoming NOV response deadline, the landowner
respectfully requests that additional time be granted on the basis that communication regarding a resolution is ongoing
with the new lease holder, Walgreens. We thank you for your time and consideration in this matter and if you have any
questions or need any additional information, please do not hesitate to ask. If possible, a quick response regarding
acceptance would be greatly appreciated.

Carolina Law. As a result of a file review on August 11, 2016, a letter (copy attached)
dated August 11, 2016 was sent to Bermuda Greens Associates, Inc. notifying them that
the stormwater permit had expired on August 2, 2016 and that a renewal application and
processing fee of $505.00 was required. Also, Bermuda Greens Associates, Inc. was
advised in this letter that since ownership of the property has changed, an application for
ownership change -was also required. As of this date we have not received a response,
and a renewal application and an ownership change application has not been received.
The permit is now expired. As a result, the following violations are noted:
I. Failure to Renew State Stormwater Permit
Title 15A NCAC 02H .1045 (3) requires that applications for permit renewals to be
submitted a minimum of 180 days prior to the expiration of the permit. On February 11,
2016, an application for a permit renewal was required to be submitted to the Division of
Energy, Mineral, and Land Resources (DEMLR). As of the date of this letter, the Division
has not received an application to renew Stormwater Permit SW7020602.
II. Failure to ADnly For and Secure a Stormwater Manaaement Permit
Title 15A NCAC 02H .1019, in accordance with G.S. 143-214.7, requires a State
Stormwater Management Permit for development activities within the 20 coastal counties
that require a Coastal Area Management Act (CAMA) Major Permit or an Erosion and
Sedimentation Control Plan. The DEMLR file review confirms that a valid, active State
Stormwater Management Permit was not obtained prior to the expiration of Stormwater
Permit SW7020602 and an ownership change of the permit has not been applied for.
Required Response
This Office requires that you respond to this letter in writing within 30 calendar days of
receipt of this Notice. Your response should be sent to this office at the letterhead
address. Your response should address the following items:
1. Complete and submit the enclosed renewal application along with the
processing fee, currently set at $505.00.
2. Complete and submit the enclosed ownership change application along with
the processing fee, currently set at $505.00.

SW7020602 for infiltration basins serving a Rite Aid Pharmacy located at 5312 North Virginia Dare Trail in
Kitty Hawk, NC in Dare County expires on August 2, 2016. Renewal applications are due 180 days prior to
expiration. A search of the Dare County tax records shows that the property covered under this permit is
now owned by Bermuda Greens Associates, Inc. North Carolina General Statutes and the Coastal
Stormwater rules require that this property be covered under a stormwater permit.

This letter is to notify you are in violation of Title 15A North Carolina Administrative Code (NCAC) 21-1
.1.003 for failing to comply with terms, conditions and limitations ol;' a Stormwater Management Permit
No. SW7020602.
On December 22, 2009, Amy Adams of the Washington Regional Office performed an inspection to.
determine the status of compliance with Stormwater Permit SW7020602. Permit Number SW7020602
was issued on August 2, 2002 for the Eckerd Drug/Pier l Imports project, located at 5312 North Virginia
Dare Trail, Kitty Hawk, Dare County, North Carolina. On January 25, 2010 you received notice of this
violation which required a response within 30 days. To date no response or request to transfer the permit
has been received.
As a result of the site inspection and DWQ file review, the following observations and violations are
noted:
I. Permit Condition III.General Conditions #1-Failure to nrODeriv transfer permit
DWQ observed there is a discrepancy between the permit holder (JDI-f Capital) the owner of record
according to the Dare County tax information (Bermuda Greens Assoc. Inc) and the site lease (Rite Aid
Corporation). This is a violation of Permit Number SW7020602 Condition #1 which states "This permit
is not transferrable. In the event there is a desire for the facilities to change ownership, or there is a name
change of' the permittee, a formal permit request must be submitted to the Division of Water Quality
accompanied by an application fee, documentation from the parties involved, and other supporting
materials as may be appropriate. The approval of this request will be considered on its merits and may or
may not be approved."

11. Failure to Provide Operation and Maintenance
Condition 3 of Stormwater Permit SW7020602 requires that the permittee shall provide the operation and
maintenance necessary to operate the storm water controls at optimum efficiency. **Specific operation
and maintenance failures are noted in the Comments section of your inspection report. Also, same of the
photographs taken during the site inspection are included. Please refer to the new Operation and
Maintenance Agreement for .solutions to noted problems.
Required Response
I. This Office requires that you respond to this letter in writing to the address listed at the
bottom of the letterhead within 10 calendar days of receipt of this Notice. Please provide a
written "Plan of Action" which outlines the actions you will take to correct the following
violation(s) and a time frame for completion of those actions.
Please submit the required Name/Ownership Change Request Form for this property
along with a new O&M form for the new responsible party.
Please provide a plan for addressing the maintenance needs of the permitted stormwater
system. Please see the new O&M form for solutions to noted problems.
Thank you for your immediate attention to this matter. This Office is considering an enforcement action
including the assessment of civil penalties regarding these violations and any continuing violations that
may be encountered. Your above -me tit iotied response to this correspondence will be considered in this
process. Please be advised, these violations and any continuing or future violations are subject to a
civil penalty assessment of up to $25,000.00 per day for each violation pursuant to North Carolina
General Statute 143-2.15.6A.This office requires that the violations, as detailed above, be abated and

1. A change in ownership has occurred on the property without proper transfer of the State Stormwater Permit. The permittee is
JDH Capital LLC, the owner of record is Berrrfuda Greens Assoc. Inc, and the store on site is Rite -Aid #11429. This should be
resolved through name/ownership change form submittal to DWQ.
2. Overall on -site maintenance appears to be consistent with the O&M agreement.

This letter is to notify you are in violation of Title 15A North Carolina Administrative Code (NCAC) 21-1
.1003 for failing to comply with terms, conditions and limitations of a Stormwater Management Permit
No. SW7020602.
On December 22, 2009, Amy Adams of the Washington Regional Office performed an inspection to
determine the status of compliance with Stormwater Permit SW7020602. Permit Number SW7020602
was issued to you on August 2, 2002 for the Eckerd Drug/Pier I Imports project, located at 5312 North
Virginia Dare "frail, Kitty Hawk, Dare County, North Carolina.
As a result of the site inspection and DWQ file review, the following observations and violations are
noted:
1. Permit Condition III.General Conditions 41
DWQ observed there is a discrepancy between the permit holder (JDH Capital) the owner of record
according to the Dare County tax information (Bermuda Greens Assoc. Inc) and the site lease (Rite Aid
Corporation) This is a violation of Permit Number SW7020602 Condition 41 which states "This permit
is not transferrable. In the event there is a desire for the facilities to change ownership, or there is a name
change of the permittee, a formal permit request must be submitted to the Division of Water Quality
accompanied by an application fee, documentation from the parties involved, and other supporting
materials as may be appropriate. The approval of this request will be considered on its merits and may or
may not be approved."

11. Failure to Provide Operation and Maintenance
Condition 3 of Stormwater Permit SW7020602 requires that the permittee shall provide the operation and
maintenance necessary to operate the storm water controls at optimum efficiency. "Specific operation
and maintenance failures are noted in the Comments section of your inspection report. Also, some of the
photographs taken during the site inspection are included Please refer to the new Operation and
Maintenance Agreement for solutions to noted problems.
Required Response
This Office requires that you respond to this letter in writing to the address listed at the
bottom of the letterhead within 30 calendar days of receipt of this Notice. Please provide a
written "Plan of Action" which outlines the actions you will take to correct the following
violation(s) and a time frame for completion of those actions.
1. Please submit the required Name/Ownership Change Request Form for this property along
with a new O&M form for the new responsible party.
2. Please provide a plan for addressing the maintenance needs of the permitted stornnvater
system. Please see the new O&M form for solutions to noted problems.
Thank you for your immediate attention to this matter. Please be advised, these violations and any
continuing or future violations are subject to a civil penalty assessment of up to $25,000.00 per day
for each violation pursuant to North Carolina General Statute 143-215.6A.
This office requires that the violations, as detailed above, be abated and properly resolved. Should

A Division of Energy, Mineral, and Land Resources file review has determined that Stormwater
Permit SW7020602 for infiltration basins serving a Rite Aid Pharmacy located at 5312 North
Virginia Dare Trail in Kitty Hawk, NC in Dare County expired on August 2, 2016. Renewal
applications were due 180 days prior to expiration. A search of the Dare County tax records
shows that the property covered under this permit is now owned by Bermuda Greens
Associates, Inc. North Carolina General Statutes and the Coastal Stormwater rules require that
this property be covered under a stormwater permit.
The permit has now expired and you are now operating without a valid permit. Operation of a
stormwater treatment facility without a valid permit is a violation of NC General Statute 143-
215.1 and may result in an appropriate enforcement action including assessment of civil
penalties.
Please submit a completed permit renewal application along with a $505.00 fee for permit
renewal and an ownership change application within 30 days. Permit application forms for
