Virginia Dare Trail in Kitty Hawk, NC. The following is a brief explanation of the ownership and occupancy of the development and actions being taken toward resolving the Violation. Bermuda Greens Associates, Inc. owns the property that was originally leased to and developed by JDH Capital, LLC as an Eckerd Drugs store. In association with construction of the commercial project, the referenced high density stormwater permit was secured in the name of JDH Capital, LLC. Some years later the store's occupancy changed from Eckerd Drugs to a Rite Aid Pharmacy and, within the past month, has changed again to a Walgreens. According to the recent NOV, both the landowner and Rite Aid of North Carolina, Inc. were notified that the stormwater permit had expired on August 2, 2016. It is the landowner's desire to have the permit remain in the name of the lease holder and to this end, has been reaching out to Walgreens in an attempt to have the permit renewed and transferred in their name. On 3-14-19, a representative of Walgreens responded by copying their engineer, Andrew Wojcik, for advisement. As of earlier this afternoon the landowner had received no further response from Walgreens regarding a plan of action and has followed up. In consideration of the forthcoming NOV response deadline, the landowner respectfully requests that additional time be granted on the basis that communication regarding a resolution is ongoing with the new lease holder, Walgreens. We thank you for your time and consideration in this matter and if you have any questions or need any additional information, please do not hesitate to ask. As a result of a file review on August 11, 2016, a letter (copy attached) dated August 11, 2016 was sent to Bermuda Greens Associates, Inc. notifying them that the stormwater permit had expired on August 2, 2016 and that a renewal application and processing fee of $505.00 was required. Also, Bermuda Greens Associates, Inc. was advised in this letter that since ownership of the property has changed, an application for ownership change -was also required. As of this date we have not received a response, and a renewal application and an ownership change application has not been received. The permit is now expired. As a result, the following violations are noted: I. Failure to Renew State Stormwater Permit Title 15A NCAC 02H .1045 (3) requires that applications for permit renewals to be submitted a minimum of 180 days prior to the expiration of the permit. On February 11, 2016, an application for a permit renewal was required to be submitted to the Division of Energy, Mineral, and Land Resources (DEMLR). As of the date of this letter, the Division has not received an application to renew Stormwater Permit SW7020602. II. Failure to ADnly For and Secure a Stormwater Manaaement Permit Title 15A NCAC 02H .1019, in accordance with G.S. 143-214.7, requires a State Stormwater Management Permit for development activities within the 20 coastal counties that require a Coastal Area Management Act (CAMA) Major Permit or an Erosion and Sedimentation Control Plan. The DEMLR file review confirms that a valid, active State Stormwater Management Permit was not obtained prior to the expiration of Stormwater Permit SW7020602 and an ownership change of the permit has not been applied for. Required Response This Office requires that you respond to this letter in writing within 30 calendar days of receipt of this Notice. Your response should be sent to this office at the letterhead address. Your response should address the following items: 1. Complete and submit the enclosed renewal application along with the processing fee, currently set at $505.00. 2.
