I have spoken with staff in our Central Office in Raleigh and they have informed me that we have the authority under North Carolina General Statute 143-214.7 (c2) to transfer a permit to an owners association upon request of a permittee if certain conditions are met. These conditions include, "...(i) common areas related to the operation and maintenance of the stormwater management system have been conveyed to the unit owners association or owners association in accordance with the declaration; (ii) the declarant has conveyed at least fifty percent (50%) of the units or lots to owners other than a declarant; and (iii) the stormwater management system is in substantial compliance with the stormwater permit issued to the permittee by the Department." Please note that we prefer to have the ownership change form completed, signed and notarized by the HOA and returned back to us for processing. However, if this cannot be completed by October 23, 2015 we will transfer the permit to the HOA based on the request submitted by the current permittee. This maintenance record will be kept in a log in a known set location. Any deficient 13MP elements noted in the inspection will be corrected, repaired or replaced immediately. These deficiencies can affect the integrity of structures, safety of the public, and the removal efficiency of the BMP. Important maintenance procedures: — The drainage area will be carefully managed to reduce the sediment load to the sand filter. — The sedimentation chamber or forebay will be cleaned out whenever sediment depth exceeds six inches. — Once a year, sand media will be skimmed. — The sand filter media will be replaced whenever it fails to function properly after maintenance. The sand filter will be inspected quarterly and within 24 hours after every storm event greater than 1.0 inches (or 1.5 inches if in a Coastal County). Records of operation and maintenance will be kept in a known set location and will be available upon request. Inspection activities shall be performed as follows.
