Noted deviations from approved plans and specification: Sand filter for drainage area, D.A. #1, discharges to diversion ditch and sediment trap that was constructed as part of the original temporary sediment erosion controls. Revised grading did not permit the construction of a level, spreader per original plans. Diversion ditch and sediment trap is stabilized and discharges, upstream of the buffers Discharge is diffused through rock check as part of the sediment trap. We have indicated the proper off -site drainage areas. 3. We have revised plan Sheet C-4.0 to include all areas draining to each BMP including off -site areas and the area of the BMP themselves. Attached please find the SHWT determinations for sand filter #1, #2, and #5. 7. The gravel hatching represented a temporary access route around the building for building construction. We have eliminated the bio-retention cells from being our BMP's. In place of bio-retention cells, these areas will now just be depressions to collect the storm water for conveyance in the closed conduits to the sand filters. 8. We have eliminated the well site from the plan. Please refer to plan Sheet C-2.0. We are just stubbing the gravel drive across the creek for future access and maintenance to septic field. No water will be channeled, it will sheet flow off the proposed gravel. 9. We have shown the drainage area for the water flowing to pipe ZZ on plan Sheet C- 4.0. We have provided calculations for the 100yr-24hr storm event in our Storm Water Management and Soil Erosion and Sedimentation Control Plan, Revised April 2, 2013. The flow of water can be dissipated with a rip -rap outlet protection. The associated velocity is below the threshold for bluegrasslBermudagrass on highly erodible soils 10. BMP Cross Section Detail on plan Sheet C-2.2. a. We have indicated a clay core seal to be constructed under the rock weir. b. This cross section is only for the sand filter. 11. We have eliminated all bio-retention cells. We have modeled the site for a 100yr- 24hr storm event. The hydraulic grade line in the sand filters and the top of pond elevations are indicated in the Storm Water Management and Soil Erosion and Sedimentation Control Plan, Revised April 2, 2013. There is nearly a foot of freeboard in the ponds during this storm event. 12. The sand filter basins may/can be used during construction to ensure compliance with the NPDES permit. Please reference the note under the Sand Filter Section Detail on plan Sheet C-2.2. The BMP Manual recommends using chocking stone if there is a potential for high sediment loads that would clog the washed stone. We are eliminating this factor by telling the contractor not to install the underdrains, stone, and filter media until the site has been stabilized to the greatest extent possible. 13. We have eliminated sand filter, BMP #4, and propose to construct a drainage swale to keep off -site surface water from entering the site. Page 3 Mr. Robert D. Patterson April 2, 2013 14. Page 11 of 12 PURCHASE AND SALE AGREEMENT THIS PURCHASE AND SALE AGREEMENT (this "Agreement") is made and entered into this Z`� day of CT[,tC3»u . 2012 (the "Effective Date"), by and between David Rankin Shepherd and Dana Hudspeth Shepherd, husband and wife, and Michael Paul Schwab and Janie Shepherd Schwab, husband and wife (collectively, "Seller") having a mailing address at 126 Beech Street, Elkin, North Carolina 28621; and Charter Development Company, L.L.C., a Michigan limited liability company, and/or its assigns ("Buyer"). For and in consideration of the mutual agreements and undertakings herein set forth, and other good and valuable considerations, the receipt and sufficiency of which are hereby acknowledged, it is hereby agreed between Seller and Buyer as follows: 1. . Sale of Property. Seller agrees to sell, convey, assign, transfer and deliver to Buyer,.and Buyer agrees to purchase, acquire and take from Seller the following described property (collectively, the "Property"): (i) all of that certain approximately 15.3 acre parcel of land, with an address of 5303 US 220 North Summerfield, NC 27358, bearing Guilford County Parcel # 0146905, and the boundaries and location of which are depicted on Exhibit A attached hereto and incorporated herein by reference (the "Land"); (ii) all of the buildings, structures, parking lots, driveways, curb, gutter, sidewalks, pavement and all other improvements located on the Land (collectively, the "improvements", and together with the Land, the "Real Property"); and (iii) all appurtenances to the Real Property and any property affixed thereto. 2. . Purchase Price. The purchase price (the "Purchase Price") for the Property shall be�=11 Thousand and No/Dollars per acre (based upon 15.3 acres the total Purchase Price would be 10 and No/100 Dollars At Closing, the balance of the Purchase Price, subject to adjustments as hereinafter provided, shall be paid in. immediately available funds. 3. Earnest Money Deposit. Within three (3) business days after the Effective Date, Buyer shall pay and deliver to First American Title, Greensboro, North Carolina, or another title company acceptable to Buyer ("Escrow Agent") the sum of Two Thousand Five Hundred and No/100 Dollars ($2,500.00) as earnest money (the "Earnest Money Deposit") to be held in trust for the mutual benefit of the parties, subject to the following terms and conditions: (a) The Earnest Money Deposit shall not be invested but shall be maintained in a non -interest bearing account in a bank in North Carolina, so as to provide availability of funds on no more than two (2) days notice. (b) In the event of a default by Buyer under this Agreement and termination of this Agreement because of the same, Escrow Agent is instructed to deliver the Earnest Money Deposit to Seller. (c) in the event of a default by Seller under this Agreement and termination of this Agreement because of the same, Escrow Agent is instructed to deliver the Earnest Money Deposit to Buycr. (d) In the event of a termination of this Agreement by Buyer pursuant, to Section - 10 of this Agreement, Escrow Agent is instructed to deliver the Earnest Money Deposit to Seller. (f) Buyer and Seller agree that Escrow Agent shall not be liable for any reason except gross negligence or willful misconduct. (g) Escrow Agent shall comply with any specific terms contained in this Agreement with respect to disbursement of the Earnest Money Deposit. Notwithstanding anything herein to the contrary, Escrow Agent shall have the right at any time to, or immediately upon instructions from Buyer, pay the Earnest Money Deposit into a state court in North Carolina, having jurisdiction relative to such matter and to interplead Seller and Buyer in respect thereof; and, thereafter, Escrow Agent shall be discharged of any further or continuing obligations in connection with the Earnest.Money Deposit. The parties shall enter into a separate escrow agreement with the Escrow Agent as to such terms and conditions. 4. Closing. The closing (the "Closing") of the sale of the Property shall be held in the offices of Escrow Agent or such other place as Buyer and Seller agree to, on or before that date which is thirty (30) days after the expiration of the Inspection Period (the "Outside Closing Date"); provided that Buyer may elect to close on an earlier date upon no less than five (5) days advance notice to Seller. The date on which the Closing actually occurs is referred to herein as the "Closing Date". Buyer and Seller may elect to close via an "escrow closing" (AKA a "mail -in closing"). Prior to Closing Seller shall vacate the Property, including the house thereon, and shall cause all of Seller's relatives, agents, invitees, contractors, subcontractors and licensees to do the same. 5. Closing Documentation. At Closing, Seller shall execute and deliver to Buyer the following (the "Seller's Closing Deliverables"): (a) A special warranty deed (the "SWD") on the North Carolina Bar Association form or other form reasonably acceptable to Buyer, conveying to Buyer fee simple, marketable, indefeasible and insurable (at regular title insurance rates) title to the Real Property free and clear of all liens, charges and encumbrances, except any matters waived by Buyer pursuant to the terms hereof (the "Permitted Exceptions"). (b) A quitclaim deed (the "QCD", and together with the SWD, the "Deeds"), in form and substance reasonably satisfactory to Buyer and seller. The legal description of the Real Property contained in the QCD shall be the legal description taken from Buyer's survey or such other legal description as Buyer may reasonably request. (c) An affidavit, in form and substance reasonably satisfactory to Buyer, Seller and Buyer's title company, indicating that, as of the Closing Date, there are no outstanding unsatisfied judgments, tax liens or bankruptcies against or involving Seller; that there has been no skill, labor or material furnished to the Property by or at the insistence of Seller for which mechanics' or materialmen's liens could be filed; and that there arc no unrecorded interests in the Property of any kind; and that there are no parties with rights to possess the Property. (f) A closing statement, in form and substance reasonably satisfactory to Buyer and Seiler. (g) All other documents affecting title to and possession, of the Property and necessary or reasonably desirable to transfer or assign the same to Buyer, marketable, indefeasible and insurable (at regular title insurance rates), and free and clear of all liens,' charges and encumbrances except the Permitted Exceptions. 6. Termination of Contracts. At or prior to Closing, Seller shall terminate all leases (if any), vendor and service contracts related to the Property except as may otherwise be expressly provided for herein. 7. Closing Costs. Seller shall furnish and pay the expense of preparation the Seller's Closing Deliverables (except the aforementioned closing statement), the revenue stamps (AKA excise tax, AKA dced stamps, AKA transfer taxes), Seller's- attorneys' fees, any deferred taxes, any rollback taxes, and the costs of release of any liens on the Property. Buyer shall pay for the expense of filing the Deeds, the cost of Buyer's investigations (including title examination costs), the title insurance premium for coverage provided by the title company insuring Buyer's title, and the fees and costs of Buyer's attorneys. Except as otherwise provided herein, each party shall bear its own expenses, including its own attorneys' fees. 8. Closing Adjustments and Apportionments. All items of income and expense that are customarily apportioned in real property transactions of the character contemplated by this Agreement shall be apportioned or adjusted between Seller and Buyer. Real estate taxes shall be prorated upon.a calendar year basis. All apportionments and adjustments shall be made as of 12:00:01 a.m. on the Closing Date. 9. Delivery of Seller's Items. No later than two (2) days after the Effective Date, Seller shall deliver to Buyer the following items: any title report the Seller has in its possession, any survey the Seller has in its possession, and such other information and/or documentation as Buyer shall reasonably request. 10. , Inspections. During the period from the Effective Date through. 5pm on that date which- is one. hundred fifty (150) days after the Effective Date (the, "Inspection Period"), Buyer and its agents shall have unlimited access to the Property (including but not limited to the personal residence) to inspect the Property and perform such appraisals, building inspections, engineering tests, soil and groundwater tests, surveys, environmental assessments, feasibility studies and other inspections, tests, studies and inquiries as Buyer shall deem advisable in its sole discretion, all without any payment to Seller. In addition, Buyer and its agents may cut, drill, dig, plow and use other such methods to (i) cut a path to the septic field and related areas and improvements on the Property, and (ii) clear the septic field area as required by regulatory agencies and/or as depicted on Exhibit B attached hereto and incorporated herein by reference (collectively, the "Septic Clearing"). At the conclusion of the Inspection Period, Buyer shall not leave the Property in a condition that violates local soil erosion regulations if such violation is due to the Septic Clearing. Buyer and its agents shall have no other duties to restore or repair the Property. Buyer shall have the right to terminate this Agreement during the Inspection Period in the event that Buyer determines in its sole opinion that the Property is not suitable to Buyer. In the event that Buyer determines in its sole opinion that the Property is not suitable to Buyer, then Buyer shall send written 3 WCSR 7504035v3 notice to Seller of its intention to terminate tiffs Agreement (the "Tern ination Notice") no later than the expiration of the Inspection Period, the Earnest Money Deposit shall be delivered to Seller, and the parties hereto shall have no further obligations to one another hereunder. 11. 'Title Examination. During the Inspection Period, Buyer shall examine the title to the Property as Buyer deems appropriate in its sole discretion. Should Buyer not approve of any aspect or item of the title to the Property to be received by Buyer, Buyer shall advise Seller in writing, during the Inspection Period, of its objections to title, and Seller shall have a period often (10) days from the date of receipt of the notice within which to remedy the objections to the satisfaction of Buyer. In the event the objections are not cured or remedied within said ten (10) day period, Buyer, at its election and as its sole remedy, shall have the right to either (i) accept title to the Property subject to the objections (which shall thereby be deemed "Permitted Exceptions"), or (ii) terminate this Agreement and the parties shall have no further obligations to each other hereunder. Any title exception not disapproved in writing within said time period shall be deemed approved by Buyer and shall constitute a "Permitted Exception". Notwithstanding anything herein to the contrary Seller shall be obligated to remove, at or before Closing, and at Seller's cost, all monetary liens and encumbrances affecting the Property. 12. Zonine. Buyer shall determine prior to the expiration of the Inspection Period whether the current zoning of the Real Property includes Buyer's use. If such zoning does not, Buyer may terminate this Agreement. The obligations of Buyer under this Agreement are in all respects conditioned upon and subject to the Real Property being zoned at Closing the same as zoned as of the expiration of the Inspection Period (or other zoning agreed to by Buyer in writing) and upon there then being no pending or proposed application for any rezoning or change in zoning not consented to by Buyer in writing that would apply to the Real Property or any portion thereof. In the event Seller obtains knowledge of any application or proposal for rezoning or change in zoning of the Real Property or any portion thereof, Seller shall immediately notify Buyer and then Buyer, in Buyer's sole discretion, shall have the option to terminate this Agreement, in which event the Earnest Money Deposit shall be immediately refunded to Buyer. Seller represents and warrants to Buyer that it will not apply for, encourage or consent to any zoning or rezoning of the Real Property without Buyer's prior written consent. Seller agrees to work in good faith with Buyer in applying for and -pursuing such governmental and quasi -governmental approvals, variances, rezoning and the like, including but not limited to site plan approval, that Buyer so requests of Seller. Seller shall not be liable for any zoning -related application costs that are made at the request of Buyer. 13. Representation and Warranties by Seller. Seller represents and warrants to Buyer that: (a) Seller has good and marketable fee simple title to the Property, and that there are no mechanics' liens, contractors' claims, unpaid bills for material or labor pertaining to the Property, and that there are not any other similar liens which might adversely affect Seller's title to the Property. (b) There are no persons or entities that will have a right of possession beyond the date of Closing. (c) There are no liabilities which encumber the Property that will survive the Closing and be binding upon Buyer and/or the Property. WCSR 7504O35v3 (d) Seller has received no notice of any action, litigation, pending or threatened condemnation or other proceeding of any kind pending against the Seller which relates to or affects the Property. (e) To the best of Seller's knowledge, as of the date of this Agreement: (1) except for f?:` ;':" ir=7 (collectively, the "Asbestos Items"), the Property does not contain any hazardous wastes, hazardous substances, hazardous materials, toxic substances, hazardous air pollutants or toxic pollutants, as those terms are used in the Resource Conservation and Recovery Act (42 U.S.C.A. §§ 6901 et seq.), the Comprehensive Environmental Response, Compensation and Liability Act of 1980 (42 U.S.C.A. §§ 9601 et seq.), the Hazardous Materials Transportation Act (49 U.S.C.A. §§ 1801 et seq.), the Toxic Substances Control Act (15 U.S.C.A. §§ 2601 et seq.), the Clean Air Act (42 U.S.C.A. §§ 7401 et seq.), and the Clean Water Act (33 U.S.C.A. §§ 1251 et seq.), or in any amendments thereto, or any regulations promulgated pursuant thereto, or in any applicable state or local law, regulation or ordinance; (2) the Property is not subject to federal, state or local regulations or liability because of the presence of stored, leaked, spilled or disposed petroleum products, waste materials or debris, "PCB's" or PCB items (as defined in 40 C.F.R. § 761.3), underground storage tanks, "asbestos" (as defined in 40 C.F.R. § 763.63) (except the Asbestos Items) or the past or present accumulation, treatment, storage, disposal, spillage or leakage of any dangerous, hazardous or toxic substance as defined in or regulated by any federal, state or local laws, regulations or orders; (3) no portion of the Property is filled land; and (4) no condition exists which is or may be characterized by any federal, state or local government or agency as an actual or potential threat or danger to public health or the environment. Seller further represents and warrants to Buyer that the Property shall be maintained through the Closing Date in the condition represented and warranted above. Seller is not required to remove the Asbestos Items. (0 At Closing, the Property will be in the same condition as exists on the' Effective Date, reasonable wear and tear only excepted. (g) Seller has not made a general assignment for the benefit of creditors, filed any voluntary petition in bankruptcy, admitted in writing its inability to pay its debts as they come due or made an offer of settlement, extension or composition to its creditors generally. Seller has received no written notice of (a) the filing of an involuntary petition by Seller's creditors, (b) the appointment of a receiver to take possession of all, or substantially all, of Seller's assets, or (c) the attachment or other judicial seizure of all, or substantially all, of Seller's assets. (h) Seller is not a foreign person within the meaning of Section 1445(f) of the Internal Revenue Code. (i) There are no legal proceedings pending or, to Seller's knowledge, threatened against Seller which could affect Seller's title to the Property or the right, power, or ability of Seller to convey the Property to Buyer in accordance with this Agreement. 0) Seller has not received written notice and has no knowledge: WCSR 7504035v3 (i) concerning the possible or anticipated condemnation of any part of the Real Property, or the widening, change of grade or limitation on use of streets abutting the same or concerning any special taxes or assessments levied or to be levied against the Real Property or any part thereof; (ii) from any insurance company or bonding company of any defects or inadequacies in the Property or any part thereof, which would adversely affect the insurability of the same or cause the imposition of extraordinary premiums or charges therefor or of any termination or threatened termination of any policy of insurance or bond; or (iii) concerning any change in the zoning classification of the Real Property or any portion thereof. (k) From the Effective Date until the Closing, Seller shall: (i) Maintain the Property in the same condition as presently exists, reasonable wear and tear only excepted. (ii) Perform all of its obligations under any contracts affecting the Property and promptly notify Buyer of any default thereunder. (iii) Provide Buyer and its agents reasonable access to the Property and reasonable access to all engineering information, reports, soil tests, surveys, plans and records available to Seller relating to the Property. (iv) Refrain from entering into, or negotiating with regard to, any contract or commitment or Gam incurring any expenditure or obligation affecting the Property or the title thereto which would extend beyond the Closing or would involve payments that would not be paid in full prior to the Closing. (v) Make no lease or rental of the Property or any portion thereof, or negotiate, market or enter into any discussions or other contract or option for the sale of the Property or any portion thereof, or further encumber the Property with any lien, restriction or easement.. Seller hereby agrees that the truthfulness of each of the foregoing representations and warranties is a condition precedent to the performance by Buyer of its obligations under this Agreement, and all of the foregoing representations and warranties shall be deemed to be repeated at Closing. Seller shall execute and deliver certificate of representations and warranties satisfactory in form and substance to Buyer at Closing reaffirming all said representations and warranties as of the Closing Date. Upon the breach by Seller of any representation or warranty made in this Section, Buyer may terminate this Agreement and receive the return of the Earnest Money Deposit. The foregoing remedy is not intended to be an exclusive remedy of Buyer. 14. Defaults, Remedies. Upon the breach of any of the representations and warranties contained in Section 13, or upon the breach by Seller of any other representation, warranty or agreement set forth in this Agreement, Buyer may, prior to the Closing Date, by delivery of written notice to Seller, terminate this Agreement and upon such termination the Earnest Money Deposit shall be returned to Buyer. The 6 WCSR 75o4035v3 foregoing remedy is not intended to be an exclusive remedy of Buyer. Without limiting any provision herein or any remedy at equity at law, Closing shall not serve as a waiver of any fraudulent act or misrepresentation by Seller which is first discovered after the Closing Date. Seller agrees that its refusal to close the sale of the Property contemplated by this Agreement will cause Buyer irreparable damages which cannot be measured in money damages, and that Buyer will be entitled to institute proceedings in any court of competent jurisdiction to enforce the specific performance by Seller of the terms of this Agreement. If Buyer shall fail to close the transactions contemplated under this Agreement as required by this Agreement, Seller shall be entitled to receive and retain the Earnest Money Deposit as Seller's liquidated damages and sole remedy for Buyer's breach, and neither party shall have any other claim against the other. The remedy provided to Seller in the preceding sentence is provided in recognition by both parties that damages to Seller in the event of Buyer's breach would be difficult or impossible to measure and is not intended as a penalty or forfeiture. 15. Risk of Loss. in the event the condition of the Property is materially changed prior to Closing, Buyer may (i) terminate this Agreement and receive a full refund of the Earnest Money Deposit, whereupon the parties hereto shall have no further rights, obligations or liabilities with respect to each other hereunder, or (ii) complete the purchase of the Property with an equitable reduction of the Purchase Price. Provided however that to the extent that the building is damaged by fire or any other casualty which is covered by insurance, then Buyer shall have the option of accepting the proceeds of such insurance and proceeding with Closing or cancelling this Agreement and receiving a refund of the Earnest Money Deposit. 16. Assignment. Buyer may assign its rights, duties and obligations under this Agreement without the consent of Seller. So long as the assignee accepts all of Buyer's of its duties, obligations and liabilities under this Agreement, then upon such assignment Buyer shall be completely discharged from all of its duties, obligations and liabilities under this Agreement. Seller may not assign this Agreement. 17. Survival -All of the terms, covenants, conditions, representations, warranties and agreements of this Agreement shall survive and continue in full force and effect for a period of six (6) months after the Closing. Buyer shall be responsible for the Buyer's Broker's- fee pursuant to a separate agreement. It is expressly agreed that there are no verbal understandings or agreements which in any way change the terms, covenants and conditions herein set forth, and that no modification of this Agreement and no waiver of any of its terms or conditions shall be effective unless made in writing and duly executed by both parties. 23. B_ inding Effect. Severability. If any provision this Agreement should be held invalid, illegal or unenforceable in any respect in any jurisdiction, then, to the fullest extent permitted by law, all other provisions hereof shall remain in full force and effect in such jurisdiction and shall be liberally construed in order to carry out the intentions -of the party as nearly as maybe possible. 25. . Essentially, BMPs are sized for an instantaneous volume for the V runoff for the receiving DA. This applies to BMPs in series as well. The other option would be to design them in parallel instead by not discharging the bioretention cells into the sand filters. Regarding #6: I can try to work with you more on this item. However, this requirement is clearly stated in the BMP manual that at least one boring is required w/in the footprint of each BMP. The SHWT separation is an extremely important design factor for the success of these types of BMPs. The soil scientist or geotech engineer must be willing to seal something stating that based on the soils information from the on -site evaluations that the SHWT is at least 2' below the bottom of the media in each BMP. If they were not specifically looking for the SHWT elevation when the other borings were done, that may be difficult. The SHWT elevation can be much different than just the elevation that water was observed at some given point in time. It can also vary greatly across a site due to topography, clay lenses, etc. If the separation was more than the minimum 2 feet in the one BMP that it was determined for, I might be more comfortable with it. Also, the underdrains are only for discharging the filtered water, not for getting rid of incoming groundwater. Soil boring logs and a soil boring exhibit were submitted indicating water table depths and bottom of media (BOM) for each BMP. The exhibit indicates that ground water is deeper than the media in each BMP. I specifically want to point out the borings within the building envelope. These borings are deeper than the others and, in particular, boring 413 is 33 feet below existing grade with no ground water encountered. The exceptions to the above statement are sand filters #4 and #5. We have limited boring information in the area of these two BMP's. I understand the SHWT requirement. However, given the topology of the site, the larger regional topography indicated on the quadrangle map, existing boring data, and the fact that ground water was only encountered near the creek (west side, lower portion of the site), we feel that specific SWHT determinations for each BMP would provide the same findings already presented. This concern is further mitigated with under drains installed for each BMP. Expending additional time and money to verify the same conclusions is hard to justify given the data provided. We do acknowledge the lack of boring data for sand filter #4 and #5 and proposed to conduct SHWT determinations for these BMA's. We request a second review of the information provided and consideration that SHWT is not a concern except as acknowledged. Reference Comment #14 —A number of the BMA's are in series. Given the time of concentration, required 1-inch treatment volume, and storage in each BMP, each BMP will receive the required treatment volume from its respective treatment area prior to receiving storm water from the upstream drainage area/BMP, then the by-pass structures for each downstream BMP will divert the upstream storm water and prevent upstream water from entering downstream BMP's. Basically, all downstream BMA's will collect 1-inch of water from its respective drainage area prior to receiving/by-passing upstream BMP by-pass water. At the tail end of a storm, when high flows subside, storm water from the upstream BMP will be diverted to the downstream BMP. However, at this point, the upstream water has already been treated or is not part of the 1-inch required to be treated. The downstream BMP would have already captured the required 1-inch from its respective drainage area. Assuming a bioretention cell is an acceptable treatment method and the storm system functions hydraulically as described above (I will provide verification), do you have any other specific concerns regarding the BMP's in series? The proposed Summerfield Academy is located approximately l mile northwest of the intersection of United States (US) Highway 220 and North Carolina (NC) Highway 150 in Summerfield, North Carolina. Mr. Chuck Christy with WadeTrim provided Mr. Stephen Lacz with S&ME a revised site plan on December 11, 2012 indicating the location of the proposed Stormwater BMP. S&ME's scope of services consisted of evaluating the SHWT at the proposed location to a minimum depth of eight (8) feet bgs, or until seasonal high soil wetness conditions were encountered (whichever is first encountered), or until auger refusal, as determined by a Licensed Soil Scientist. The area evaluated consisted of wooded cutover with dense vegetation (Figure 2). An S&ME soil scientist conducted an evaluation of the soils within the proposed BMP system, identified on the provided site map. The soil scientist evaluation was conducted to evaluate the suitability of the soil properties relative to Stormwater Management permitted by the NCDENR-DWQ and/or local stormwater regulatory agencies. FINDINGS Seasonal High Water Table (SHWT) Determination The SHWT evaluation was performed by advancing two (2) hand auger borings to depths ranging from 90 to 108 inches bgs within the proposed stormwater management system area. The locations of the SHWT evaluations were approximated in the field (Figure 2). Hand auger borings were evaluated by a Licensed Soil Scientist for evidence of SHWT influence. This evaluation involved looking at the actual moisture content in the soil and observing the matrix and mottle colors. Depending on the soil texture, the soil color will indicate processes that are driven by seasonally high water table fluctuations, such as iron reduction and oxidation and organic matter staining. Please note that SHWT evaluations are based on secondary evidence and not on direct groundwater level measurements. Groundwater levels fluctuate for numerous reasons and these findings do not indicate that groundwater levels have not or will not rise above the noted depths. The approximate SHWT test locations are identified in Figure 2, and the approximated SHWT depths are located in Table 1, and further identified in the attached soil profile descriptions.
