Failure to provide the listed items may result in processing delays or denial of the transfer. 1. This completed and signed form. This certification must be completed and signed by both the current permit holder and the new applicant if this is a change of ownership. 2. Legal documentation of the property transfer to a new owner. 3. A copy of any recorded deed restrictions, covenants, or easements, if required by the permit. 4. The designer's certification (DWQ Engineer and Designer Certification Forms are available from each DWQ Regional office), if required by the permit and if not already submitted to DWQ. 5. If the proposed permittee is a firm, partnership, association, institution, corporation, limited liability company, or other corporate entity, provide documentation showing the authority of the named representative to act on behalf of the proposed permittee. I will say that the native grasses may shade out any remaining turf grass, so you may need to cover bare spots with double or triple shredded hardwood mulch. A review of the documentation provided and discussions with Division staff reveal that inspections have been conducted and deficiencies in the Bioretention Cell had been noted by County staff. It is essential in the future that all inspection results be addressed in a timely manner. Please review Condition II. 3 of Permit No. SW4O8O701 and ensure that future records clearly document all activities required by the permit. You have proposed a two-phase corrective action and Division approves your proposal. •Phase I has been completed and involved seeding the biocell with an appropriate seed mix and utilizing landscape matting in an effort to obtain a dense, uniform, stand of vegetation without the presence of weeds. Phase 11 involves replacing the vegetation with an appropriate species of sod in the spring/summer if the bioretention cell is insufficiently vegetated at that time. You must contact Sue Homewood, Division staff by phone or email 3O days prior to the appropriate time to plant sod in order to conduct a site visit to determine if sod is necessary. Assuming that you can provide that justification, then if you want to try to use landscape matting in the interim and a dense stand of grass results before the time to plant the spring sod, we would not require sod in the spring. But if the matting does not work to provide adequate vegetation we will still require you to re -sod in the spring, we will not allow any longer to try to enhance the grass that was planted with the landscape matting. WS/FCS has also talked to the Rural Hall Principal and explained that no other vegetation can be placed in the biocell, and for him to educate his staff and PTA. WS/FCS would like to request a 30 day extension to ensure our sod choice is sustainable and drought resistant, and that it still meets the Bioretention Operation and Maintenance Agreement. This would allow a wider window to locate, acquire, and install new sod in case completion ran past September 2011. Mr. Basinger Page 2 August 25, 2011 Sue Homewood was a big help meeting with us on site August 24, 2011. This allowed us to ask some questions to help understand WS/FCS obligation for this biocell. Sue graciously listened to our questions and said she would follow up with Raleigh about a couple of options regarding species of sod that will would be expectable but less water reliant and get back to WS/FCS with their interpretation. We believe these actions, once completed will finalize the necessary steps to be in compliance with our permit. If you can't put your seal on something that goes back to a certain date, then we'd say it was never certified and need a certification now (which might be a problem if the cell is having trouble with vegetation) Their permit states that they are supposed to be keeping 0&M records that and submit an annual summary of those records. That would be required 1 year after the BMP was considered complete (certified). I've dealt with someone from Forsyth County schools recently on another school's BMP so I'm going to contact them and ask them what records they have. They may ask you for assistance with any records you have if you've been helping them with maintenance. If the sod died then they need to put sod back. I took pictures yesterday of straw, I did not move it to see what was under it but assumed it was grass seed. If the sod died in 10/10 based on your picture, seeding and mulching in July 2011 would not be considered sufficient corrective actions. We are in the process of having the GC re -sod it. It was supposed to be done last week but I have not been by since. When I looked at it last, maybe 3 weeks ago, the old sod was still intact for the most part, just dead. The original installer is refusing to re -sod it, so the GC has hired another. The seed and mulch could be a PTA effort; Original contractor attempt at rectification before deciding to bail out, or the new contractor misunderstanding what was to be done. I have not any pictures of the biocell that I can find, but I know that the contractor was perturbed that he had to get a sprinkler and put out there. I was out there one day doing a punch list and they were watering the biocell. I don't know if the school turned it into an outdoor classroom or if the PTA thought some plants would look great there. I thought I had certified that a while back. I am on my way out the office now and I will look for it tomorrow. Jay Bill, Do you have any photos showing the biocell was sodded at one point? The total site area is 24.23 acres with construction impacting; only 8.85 acres. The remaining acreage will remain undisturbed and storn water controls are proposed for the areas that are undisturbed. The impacted 8.85 acres can be divided into three sub -basins. Of the three sub -basins, only one basin will have an increase in impervious area. Erosion control has been granted by the NCDENR Winston-Salem Regional Office on December 16, 2008. A copy of the Letter of Approval from NCDENR is enclosed. Drainage from this site has been divided into approximately 3 sub basins as shown on the overall storm water plan. Sub -basin #1 discharges into a rip rap ditch on the northern portion of the property adjacent to the play fields. Work included in the sub -basin will be removal and replacement of existing pavement due to pavement failure and reworking the grades to a more uniform slope.
