In accordance with your application for a discharge permit received on October 3,
2014, and additional information received on November 10, 2014, we are forwarding
herewith the subject certificate of coverage to discharge under the subject state - NPDES
general permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
This certificate of coverage is not transferable. If the facility changes ownership or is
closed, the Division of Energy Mineral & Land Resources may require modification, revocation
or reissuance of the certificate of coverage.
Please be aware that mine dewatering at your site has the potential to impact adjacent
wetlands. The specific requirements for mine dewatering at facilities near wetlands can be
found in Part 11I, Section E of your permit. You must have an approved Operation and
Monitoring Plan before mine dewatering discharges occur at your facility. Discharging
mine dewatering wastewater without Plan approval will be subject to enforcement action. An
Operation and Monitoring Plan for your facility must be submitted to the Wilmington Regional
Office within 60 days of your receipt of this permit. Contact Dan Sams at the Wilmington

Please note that mine dewatering wastewater includes wet pit overflows caused
solely by direct rainfall and groundwater see a e for this type of mining operation. Any

This general permit allows the discharge of stormwater and certain types of
wastewater from your facility. In your application, you specified that only mine dewatering
water would be discharged from this facility. If separate point -source discharges of
stormwater occur (i.e., stormwater not combined with mine dewatering water), you will be
required to adhere to the conditions in this permit for stormwater discharges.
This project is located in one of North Carolina's 20 coastal counties. Coastal
stormwater management rules (15A NCAC 2H .1000) may require an additional State
Stormwater Permit (different from the NPDES mining activities discharge permit). Please

1. Please indicate the size and volume of the existing abandoned mine you will be discharging into.

1. They should indicate the size of the receiving existing abandoned mine
2. They should indicate whether the receiving existing abandoned mine has an outlet and the details for any outlet

3. If the receiving existing abandoned mine has an outlet calculations should be submitted showing that the

This letter is in response to your email to Elijah Morton and per our discussion on
October 31, 2014, concerning the above referenced project.
The existing abandoned mine/pond that the Peyton Mine will be pumping to is
approximately 135'± wide and 1240'f long at the water surface, per the image on Google Earth.
At the southern end of the pond, it is about 10' to the top of the pond and at the northern end, it is
15'-20' to the top. Using 3:1 sideslopes, the volume for an 8' rise of water, would be
1,612,416 CF = 12,060,872 Gallons. Assuming using dewatering pumps with 1,000 GPM
capacity, this would allow 200 hours of pumping time.
Per site inspection, there does not appear to be a gravity overflow/discharge point in the
existing pond. It appears that the existing water level is the natural water table and that any
water entering the pond infiltrates into the sandy soils.
It is anticipated that as the new mine pumps water into the existing pond, the water level
may temporarily rise, then slowly infiltrate into the ground. It is anticipated that leaving a 2'
freeboard, the large available volume in the existing pond will be all that is needed to keep the
mine dewatered. If it becomes evident that this is not the case, then an alternate pumping plan
would be submitted to NC DEMLR for approval.
As shown on the plan, there are two proposed subdivisions that are adjacent to the
proposed mine. Both subdivisions, Peyton Lake and Peytons Ridge, Section VI, have been
designed and have received Erosion Control and Stormwater Permits.
On the Mine Site Plan, we have shown the two wetland areas that are closest (100'-115')
to the mine. There is another wetland area near Lots 283 and 282 of Peyton Lake

The intent of this plan is to provide a detailed plan/guide for the Operation and
Maintenance of the Peyton Mine so that it complies with Part III Section A of the NPDES
General Permit No. NCG020000 for Mine Dewatering. This plan has been prepared by
Parker & Associates, Inc.
1. SITE PLAN
A. See the attached Exhibit 1 — Color Portion of Hubert USGS map, and Exhibit
2 -- Portion of Onslow County D.O.T. Map, and Mine Site Plan.
B. The Peyton Mine is a proposed sand mining operation only. Sand shall be
excavated and loaded directly into trucks and hauled off site to other locations. Loading
shall be performed with an excavator. Other than normal daily maintenance, all
equipment service shall be performed off site. No fuels or lubricants shall be stored near
or in the mining area. Excavated material is normally wet so dust shall not be a problem
in mine. The haul road shall be monitored and periodically dampened utilizing a water
truck when necessary to control any dust created from hauling operations. There shall be
no waste generated from this operation, therefore, no disposal plan is needed. The
possible pollutants to be concerned with are small amounts of fuel or hydraulic oil
created by a ruptured hose or pipe on trucks or equipment. This should not be a normal
occurrence but in the unlikely event that it does happen there always shall be someone on
site to minimize and contain the spill before it reaches any water source. Any
contaminated soils shall be removed and disposed of at a facility certified to treat soils.
C. See the attached Mine Site Plan by Parker & Associates, Inc.
D. There have been no significant spills or leaks at this location, therefore, no
corrective actions have been needed.
E. The discharge pipe for the dewatering pump shall be inspected daily when
pumping. The discharge line is located in close proximity to power source for plump and

immediately after starting, pump discharge shall be evaluated to determine if any turbid
non-stormwater discharge is present. Pumping shall be performed only as needed and
never immediately after or during a rain event. Water shall be drawn from just below the
surface (6"-12") of the water to pump the clearest water. Visual checks for clarity shall
be performed each time pump is operated. Any foam, discoloration or unusual odor shall
result in immediate shut down of pump and discharge.
Samples shall be collected and analyzed by a certified laboratory as required in the
General Permit -- NCG020000 and results shall be kept on site. Results shall also be
forwarded to NC DEMLR annually as required by the General Permit. At any time
sampling results exceed acceptable levels, discharging shall cease until conditions
become more favorable and samples shall be taken monthly for a period of one year or as
outlined in the General Permit. After such time, if levels have been consistently lower
than acceptable levels, samples shall be drawn on a quarterly basis at minimum or as
deemed necessary. Daily records shall be maintained on site recording times and amounts
of pumping as well as recorded rainfall.
2. EROSION AND SEDIMENTATION CONTROL
There shall be no gravity discharge of stormwater to the adjacent wetlands or
creek; therefore, there are no special erosion and sedimentation control measures. The
dewatering discharge shall pump to an existing pond/abandoned mine. The facility shall
be operated and maintained in compliance with the mining permit issued by the Division
of Energy, Mineral and Land Resources.
3. STORMWATER MANAGEMENT PLAN
A. All excavation and land disturbance shall be confined to the mine area with
only one controlled discharge source (dewatering pump). Natural grade in the area
prohibits stormwater run-on as all areas sheet flow to wetlands away from mining area.
No discharge of stormwater (pumping) shall occur until all solids have settled and water
is clear.
B. An inspection of mine slopes, entrance/exit, and stormwater protection devices
(BMP's) shall be conducted weekly or within 24 hours of any storm event by the mine
operator or other competent person. No discharge shall take place during or immediately
after a storm event. A rain gauge shall be kept on site and monitored and all rainfall
recorded. A record of inspections, deficiencies and corrections shall be recorded and kept
on site.
C. There shall be no bulk storage of any kind on this site.
4. WETLANDS MONITORING
The adjacent wetlands shall be monitored annually by a Soil Scientist to
determine if the mine dewatering is having a detrimental effect on the wetlands. A yearly

report shall be filed and kept by the mine operator. If it is determined that the wetlands
are being affected, a mitigation plan shall be developed by the Soil Scientist and
presented to NC DEMLR for approval.
5. SPILL PREVENTION AND RESPONSE PLAN (SPRP)
There shall be no bulk storage of any kind on site; therefore, there is no potential
for spills.
6. PREVENTATIVE MAINTENANCE AND GOOD HOUSEKEEPING PROGRAM
All equipment and trucks shall be kept in good working order and kept on a
regular maintenance schedule. Operators shall be trained and required to inspect
equipment prior to starting work each day and periodically throughout each shift.
Operators shall look for fluid leaks as well as potential leaks and shall not use equipment
if any problems are found. All equipment with any type of leak shall be removed from
mine immediately and repaired. Equipment shall be removed from mine and washed
periodically to prevent rainwater from washing contaminants from machine onto ground.
All equipment shall be checked by mine operator or qualified mechanic weekly.
7. EMPLOYEE TRAINING
Training for all involved in mine operation shall be required semi-annually. This
training will include safety, things to look for that could possibly contaminate water,
equipment inspections, and instructions on what to do if a spill occurs. All new
employees and anyone working in mine area shall be required to receive training before
entering mine. Training shall be provided by mine operator. Mine operator shall stay up
to date on new references and resources pertaining to mining safety and stormwater
management.
8. RESPONSIBLE PARTY
The mine operator shall be responsible for all mine and dewatering practices. He
shall ensure that all requirements are met and all records are up to date. The operator
shall be also responsible for training of employees and personnel.
9. PLAN AMENDMENT
The SPPP shall be reviewed annually and amended as needed and all changes
incorporated into training and Best Management Practices.
10. PLAN IMPLEMENTATION
The SPPP shall be implemented immediately upon approval and a copy
maintained on site. Additional copies of the plan and recorded data shall be provided
upon request. Information shall be kept on site for a minimum period of five years.

The intent of this plan is to provide a detailed planiguide for the Operation and
Maintenance of the Peyton Mine so that it complies with Part III Section A-ofthe.NPDES;

1. SITE PLAN

B. The Peyton Mine is a proposed sand mining operation only. Sand shall be
excavated and loaded directly into trucks and hauled off site to other locations. Loading
shall be performed with an excavator. Other than normal daily maintenance, all
equipment service shall be performed off site. No fuels or lubricants shall be stored near
or in the mining area. Excavated material is normally wet so dust shall not be a problem
in mine. The haul road shall be monitored and periodically dampened utilizing a water
truck when necessary to control any dust created from hauling operations. There shall be
no waste generated from this operation, therefore, no disposal plan is needed. The
possible pollutants to be concerned with are small amounts of fuel or hydraulic oil
created by a ruptured hose or pipe on trucks or equipment. This should not be a normal
occurrence but in the unlikely event that it does happen there always shall be someone on
site to minimize and contain the spill before it reaches any water source. Any
contaminated soils shall be removed and disposed of at a facility certified to treat soils.
C. See the attached Mine Site Plan by Parker & Associates, Inc.
D. There have been no significant Spills or leaks at this location, therefore, no
corrective actions have been needed.
E. The discharge pipe for the dewatering pump shall be inspected daily when
pumping. The discharge line is located in close proximity to power source for pump and
immediately after starting, pump discharge shall be evaluated to determine if any turbid
non-stormwater discharge is present. Pumping shall be performed only as needed and

never immediately after or during a rain event. Water shall be drawn from just below the
surface (6"—] 2") of the water to pump the clearest water. Visual checks for clarity shall
be performed each time pump is operated. Any foam, discoloration or unusual odor shall
result in immediate shut down of pump and discharge.
Samples shall be collected and analyzed by a certified laboratory as required in the
General Permit — NCG020000 and results shall be kept on site. Results shall also be
forwarded to NC DEMLR annually as required. At any time sampling results exceed
acceptable levels, discharging shall cease until conditions become more favorable and
samples shall be taken monthly for a period of one year. After such time, if levels have
been consistently lower than acceptable levels, samples shall be drawn on a quarterly
basis at minimum or as deemed necessary. Daily records shall be maintained on site
recording times and amounts of pumping as well as recorded rainfall.
2. EROSION AND SEDIMENTATION CONTROL
There shall be no gravity discharge of stormwater to the adjacent wetlands or
creek; therefore; there are no special erosion and sedimentation control measures. The
dewatering discharge shall pump to an existing pond/abandoned mine. The facility shall
be operated and maintained in compliance with the mining permit issued by the Division
of Energy, Mineral and Land Resources.
3. STORMWATER MANAGEMENT PLAN
A. All excavation and land disturbance shall be confined to the mine area with
only one controlled discharge source (dewatering pump). Natural grade in the area
prohibits stormwater run-on as all areas sheet flow to wetlands away from mining area.
No discharge of stormwater (pumping) shall occur until all solids have settled and water
is clear.
B. An inspection of mine slopes, entrance/exit, and stormwater protection devices
(BMP's) shall be conducted weekly or within 24 hours of any storm event by the mine
operator or other competent person. No discharge shall take place during or immediately
after a storm event. A rain gauge shall be kept on site and monitored and all rainfall
recorded. A record of inspections, deficiencies and corrections shall be recorded and kept
on site.
C. There shall be no bulk storage of any kind on this site.
4. SPILL PREVENTION AND RESPONSE PLAN (SPRP)
There shall be no bulk storage of any kind on site; therefore, there is no potential
for spills.

5. PREVENTATIVE MAINTENANCE AND GOOD HOUSEKEEPING PROGRAM
All equipment and trucks shall be kept in good working order and kept on a
regular maintenance schedule. Operators shall be trained and required to inspect
equipment prior to starting work each day and periodically throughout each shift.
Operators shall look for fluid leaks as well as potential leaks and shall not use equipment
if any problems are found. All equipment with any type of leak shall be removed from
mine immediately and repaired. Equipment shall be removed from mine and washed
periodically to prevent rainwater from washing contaminants from machine onto ground.
All equipment shall be checked by mine operator or qualified mechanic weekly.
6. EMPLOYEE TRAINING
Training for all involved in mine operation shall be required semi-annually. This
training will include safety, things to look for that could possibly contaminate water,
equipment inspections, and instructions.on what to do if a spill occurs. All new
employees and anyone working in mine area shall be required to receive training before
entering mine. Training shall be provided by mine operator. Mine operator shall stay up
to date on new references and resources pertaining to mining safety and stormwater
management.
7. RESPONSIBLE PARTY
The mine operator shall be responsible for all mine and dewatering practices. He
shall ensure that all requirements are met and all records are up to date. The operator
shall be also responsible for training of employees and personnel.
8. PLAN AMENDMENT
The SPPP shall be reviewed annually and amended as needed and all changes
incorporated into training and Best Management Practices.
9. PLAN IMPLEMENTATION
The SPPP shall be implemented immediately upon approval and a copy
maintained on site. Additional copies of the plan and recorded data shall be provided
upon request. Information shall be kept on site for a minimum period of five years.

Ref. Morton Mine located off Hwy 24 in Hubert
Dear Mr. Parker,
The NCDOT document "The Skaggs Method for Determining Lateral Effects of a
Borrow Pit on Adjacent Wetlands" was used to determine the appropriate setback from
the wetland line to the borrow pit.
Pittman Soil Consulting performed a soil study to make certain that the Onslow County
Soil Survey map was somewhat accurate. This evaluation determined that the listed soils
on the soil survey were concurrent with what was indentified in the field.
According to the soil survey Norfolk, Baymeade, Onslow, and Leon soils are present in
the proposed mine area.
The provided topographic data survey showed ground elevations of 3340' above sea
level in the mine area.
-For this evaluation we used the average of the low and high ground elevations
which was calculated to be 36.5' above sea level
-Average published seasonally high water table for each soil series( Norfolk 5,0'
bgs, Baymeade 4.5' bgs, Onslow 2.25' bgs, and Leon 0.5' bgs)
-Water elevation in the pit once the mining operation has concluded will be
approximately 2' lower than the published seasonally high water table
Using this data and the topographic map provided by Parker and Associates the following
elevations were determined for water in the proposed mine per each soil series versus
ground surface elevations in the adjacent wetlands.

Based on these calculations the elevation of the water in the pit for the Norfolk and
Baymeade series would be lower than the wetland elevation, and for the Onslow and
Leon series the water in the pit elevation is higher than the wetland elevation. For the
Leon and Onslow soil series flow will be from the pit into the wetlands, so a minimum
setback of 50' would apply. For the Norfolk and Baymeade soil series the water flow will
be from the wetland to the pit therefore the Skaggs Method will be used to determine the
required setback from the wetlands.
The Norfolk soil series is not adjacent to the wetlands, but the calculations were
completed.
The published soil data was input into the Skaggs Method model and the following
setbacks were calculated.(Average conductivity values were used for the various
horizons)
Norfolk-81.4 ft
Baymeade- 89.7 ft
The proposed setback to the mine as currently dcsigned is 110' from the wetlands at the
closest point(Leon and Baymeade series). This setback is more than sufficient to assure
that the mining operation will not dewater the wetlands.

6TSV-DJ DST-45T
The 6TSV-DJDST-45T, vacuum -assisted dry prime trash pump, combines the rugged Thompson
heavy-duty wet priming centrifugal open trash/sewage pump and an vacuum pump to deliver the
fastest priming in the industry. This Super Suction vacuum -assisted pump is used for sewer
bypasses, excavation dewatering, wellpoint systems and sock underdrains. The 6TSV-DJDST-45T
provides continuous pumping of liquids mixed with a high percentage of air and can handle high
abrasives or solids in suspension. Thompson Super Suction vacuum -assisted pumps are especially
useful in high lift situations not suitable for standard trash pumps.

2. Mine maps must be accurate and appropriately scaled drawings, aerial photographs or enlarged
topographic maps of the entire mine site. All aspects of the mine site must be clearly labeled on the
maps along with their corresponding (approximate) acreage. As a reminder, mining permits can
only be issued for up to 10 years; thus, all mine and reclamation maps must only denote those
activities that are intended to be conducted during the life of the mining permit. Al I maps must be
of a scale sufficient (see minimum requirements listed below) to clearly illustrate the following, at a
minimum:
a. Property lines of the tract or tracts of land on which the proposed mining activity is to be located
including easements and rights -of -way.
b. Existing or proposed permit boundaries.
c. Initial and ultimate limits of clearing and grading.
d. Outline and width of all buffer zones (both undisturbed and unexcavated).
e. Outline and acreage of all pits/excavations.
f Outline and acreage of all stockpile areas.
g. Outline and acreage of all temporary and/or permanent overburden disposal areas.
h. Location and acreage of all processing plants (processing plants may be described as to location and
distance from mine if sufficiently far removed).

k. Location and acreage of all planned and existing access roads and on -site haul roads.

and is not designated as an Interstate Highway.

C. PROTECTION OF NATURAL RESOURCES
Describe in detail the.sequence of events for the development and operation of the mine and reference the
sequence to the mine map(v). Attach additional sheets as needed.
1. Clear and grub mine area one phase at a time. Install silt fence as needed.
2. Remove topsoil and stockpile in future phase areas.
3. Excavate sand and sandy loam fill.
4. Dewater as needed.
5. Maintain existing haul road as needed.
6. Maintain erosion control devices.
2. Describe specific erosion control measures to be installed prior to land disturbing activities and during
mining to prevent offsite sedimentation (include specVicplansfor sediment and erosion control.formine
excavation(S), waste piles, access/mine roads and process areas), and give a detailed sequence of
installation and schedule for maintenance of the measures. Locate and label all sediment and erosion
control measures on the mine map(s) and provide typical cross-sections/construction details of each
measure. Engineering designs and calculations are required to justify the adequacy of any proposed
measures.

use with the Division of Water Resources if the operation withdraws more than 10,000 gallons per day
and needs a capacity use permit from the Division of Water Resources if the operation lies in a capacity
use area and withdraws more than 100,000 gallons per day.

APPLICATION FOR A MINING PERMIT
A buffer will be required between any mining activity and any mining permit boundary or right-of-
way. It may be an unexcavated buffer (no excavation, but roadways, berms and erosion &
sedimentation control measures may be installed within it), an undisturbed buffer (no disturbance
within the buffer whatsoever), or a combination of the two, depending upon the site conditions. Note
that all buffers must be located within the mining permit boundaries.
How wide a buffer will be maintained between any mining activity and any mining permit boundary
or right-of-way at this site? A minimum buffer of25 feet is recommended, although a wider buffer
may be needed depending on site conditions. Show all buffer locations and widths on the mine
map(s).

F. NOTIFICATION OF ADJOINING LANDOWNERS
The "Notice" form, or a facsimile thereof, attached to this application must be sent certified or registered mail,
return receipt requested, to:
(1) the chief administrative officer of each county and municipality in which any part of the permitted
area is located as indicated on the mine map(s);
(2) all owners of record, both public and private, of all tracts of land that are adjoining the mining
permit boundary; if an adjoining tract is owned or leased by the applicant or is owned by the lessor
of the mine tract, all owners of record of tracts adjoining these tracts must be notified (that are
within 1,000 feet of the mining permit boundary) as indicated on the mine map(s); and
(3) all owners of record, both public and private, of all tracts of land that are adjoining the mining
permit boundary which lie directly across and are contiguous to any highway, creek, stream, river,
or other watercourse, railroad track, or utility or other public right-of-way. If an adjoining tract is
owned or leased by the applicant or is owned by the lessor of the mine tract, all owners of record of
tracts adjoining these tracts must be notified (that are within 1,000 feet of the mining permit
boundary) as indicated on the mine map(s). "Highway" means a road that has four lanes of travel
or less and is not designated as an Interstate Highway.
The only exception to the above method of giving notice is if another means of notice is approved in advance by
the Director, Division of Land Resources.
A copy of a tax map (or other alternative acceptable to the Department) must be mailed with the completed

record of lands adjoining said boundaries must be clearly denoted on the tax map).

Adjustments to NC 6rid NAD'83, 2007 Adjustments. Average

1. Aggregate size - Use 2-3 inch washed stone
2. Length - As effective. but not less than 50 feet.
3. Thickness - Not less than six (6) Inches.
4. Width - Not Ion than full width of all points of
ingress or egress. Minimum of 12'.
5. Install filter fabric under entire footprint of the construction entrance.
B. Washing - When necessary, wheels shall be clewed to
remove sediment prior to entrance onto public right-of-
way. When washing is required, it shall be done on an
area stabilized with crushed stone which drains Into an
approved sediment trap or sediment basin. All sediment
shall be prevented from entering any storm drain, ditch,
or watercourse through use of sandbags. gravel, boards
or other approved methods.
7. Maintenance -- The entrance shall be maintained in a
condition which will prevent trucking or flowing of
sediment onto public rights -of -way. This may require
periodic top dressing with additional stone as conditions
demand and repair and/or deanout of any measures used to
trap sediment. All sediment, spilled. dropped. washed or
tracked onto public rights -of -way must be removed
