This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.) Please review the new permit to familiarize yourself with all changes in the reissued permit. Significant changes to the General Permit are outlined in the Technical Bulletin. Your coverage under the General Permit is transferable only through the specific action off DEMLR, This permit does not affect the legal requirements to obtain other permits which may be required by the N.C. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). The Division of Water Quality may require modification or revocation and reissuance of the certificate of coverage. A requirement of this permit is compliance with the Division of Land Resources' (DLR1 Mining Permit: therefore, you must hold an approved DLR permit before any mining industrial activities take place. Please be aware that mine dewatering at your site has the potential to impact adjacent wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found in Part III, Section E of your permit. You must have an approved Operation and Monitoring Plan before mine dewatering discharges occur at your facility. Discharging mine dewatering wastewater without Plan approval will be subject to enforcement action. Before dewatering is to begin, the Pumping Operation and Monitoring Plan for your facility that was previously submitted by your engineer to the Wilmington Regional Office must be finalized and approved. Any discharge of this water (and any stormwater commingled with it) is subject to the effluent iimiiaiions in this permit. This general, permit allows the discharge of stormwater and certain types of wastewater from your facility. In your application, you specified that only mine dewatering water would be discharged from this facility. If separate point -source discharges of stormwater occur (i.e., stormwater not combined with mine dewatering water), you will be required to adhere to the conditions in this permit for stormwater discharges. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other federal or local governmental permit that may be required. We need an 0 & M but I won't have time to mess with this one for at least a couple weeks. Jim, Can you find someone to jump on this one? I need to clear my board before I take too much else on.. I have two mine pits to work on getting approvable 0 & Ms but I'm working up in Carteret and Onslow. This one is in Chad's county. If he's too busy, maybe Jean would be willing to tackle this one. With the recently discussed changes in how we process these to issue them faster, we are no longer going to wait for the DLR permit to be issued...as long as DLR is ok with us moving forward with each specific mine. After discussion with DLR about it, Bradley gave us the go ahead yesterday to move forward with this new approach. They are dewatering near wetlands, and I didn't see in BIMS where you had ever received or approved an O&M plan. The applicant and consultant were instructed to contact you about it in a letter I sent 7/29/09. The consultant responded with a letter on 8/3/09 that they submitted the O&M plan to you 7/14/09. Are you ok with us issuing the COC for this mine? Ashley — Is DLR ok with us moving forward with this one even though they have not submitted the bond to you yet? Thank you both! Robert D. The Division of Water Quality's Stormwater Permitting Unit received a National Pollutant Discharge Elimination System (NPDES) permit application for Hughes -Smith Road Pit No. 2 on July 22, 2009. The application included a statement that an associated application for a mining permit has been submitted to the Division of Land Resources (DLR). Please be aware that the issuance of an NPDES permit is contingent upon the issuance of an associated mining permit from DLR. Our office will process your stormwater permit application once a DLR mining permit has been issued for your project.' Please also be aware that if your project is located near wetlands, your NPDES permit will require dewatering operations without wetland impacts. The specific requirements for mine dewatering at facilities near wetlands can be found in the text of the general NPDES mining permit number NCG 020000 available on our website, http://h2o.enr.state.nc.us/sti/Forms_Documents.htni. See Section C, Part 1 of the permit on the page labeled, "Part III Page 5 of 9". An approved Operation and Monitoring Plan is required for NPDES-permitted mining facilities. Discharging mine dewatering wastewater without Plan approval will be subject to enforcement action. A Plan for your facility must be submitted to the Washington Regional Office within 60 days of your receipt of an NPDES permit.
