REGAN Secretary TRACY DAVIS Director On May 12, 2017, personnel of this office inspected the Buna Mine in Mitchell County. This inspection was performed due to a complaint. The Buna Mine was issued an exemption from monitoring during dormant status on April 8, 2016. This inspection revealed that industrial activity has taken place on the site without prior 30-day notification to this office as required to maintain granted dormancy status. The following deficiencies and permit condition violations and the necessary corrective actions are as follows: ' Section B: Permitted Activities: If mining activities will expand or change such that the types of discharges are affected; the perm ittee must first contact DEMLR's Stormwater Permitting Program to determine if modifications to the COC are necessary. The permitter is also responsible for contacting DEMLR if modifications to the Mining Permit are necessary, as compliance with the Mining Permit is a stipulation of this permit. Oneratina Condition No. 11 (Plan Modification): The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approval application for a mining permit and any approved revisions to it. Approval to implement such changes must be obtained from the Department prior to on -site implementation of the revisions. The Mining permit modification needs to be sent to the State Mining Specialist in the Raleigh office for approval. The stormwater map modification needs to be sent to this office for approval. 2. Your response is to be received by the regional office and the Raleigh office within 30 business days following receipt of this Notice. Your recent request to keep the NCG020273 permit, but to discontinue stormwater monitoring is hereby approved based on the following conditions: There shall be no industrial activities taking place, no stockpiles of raw materials (to include chemical additives) stored on the site, or wastewater or stormwater industrial discharges while the permittee is not monitoring. No wastewater shall be generated and all wastewater treatment units, if any, shall be cleaned and stabilized, and inactivated as to render them harmless to the environment while the site is dormant. The Stormwater Pollution Prevention Plan (SPPP) shall be kept updated to reflect the status of the facility. Updates and conditions of the SPPP of note are: o The BMP Summary shall be reviewed and updated annually. o Training programs shall be developed and training provided at least once a year for facility personnel with responsibilities for: spill response and cleanup, preventative maintenance activities, and for any of the facility's operations that have the potential to contaminate stormwater runoff. o All aspects of the Stormwater Pollution Prevention Plan shall he reviewed and updated on an annual basis. The annual update shall include an updated list of significant spills or leaks of pollutants for the previous three years, or the notation that no spills have occurred. The annual update shall include written recertification that the stormwater outfalls have been evaluated for the presence of nonstormwater discharges. (Should non-stormwater discharges be discovered the permittee shall contact this office as soon as possible but in no case greater than 24 hours or the next business day). o Inspections of the facility and all stormwater systems shall occur as part of the Preventative Maintenance and Good Housekeeping Program at a minimum on a semi-annual schedule. The Buna Quarry is not active and had no activity occuring. The site is being monitored and maintained. On a previous inspection 1 had suggested that Unimin request an additional'inspeclion of the site and request dormant status to discontinue stormwater mohitoring. Their mining permit is current and they are in oompliance with DLR. We discussed that the annual stormwater permit fees will still need to be paid, and If at any time the mine wants to start back up a request would need to be submitted to return to active status. I suggested to Jeff that he submit his request in writing. We received the request on March 21, 2016. I recommend granting dormant status for the quarry. What are key stormwater requirements? NCG020000 requires periodic discharge monitoring and a Stormwater Pollution Prevention Plan (SPPP): • Develop and implement an SPPP, and update it at least annually. • Inspect Stormwater Best Management Practices (BMPs) once every seven (7) calendar days. • Semi-annual analytical monitoring and qualitative (visual) monitoring. • Report stormwater monitoring data once a year by March 1 st to DEQ Central Office. • Report benchmark exceedances or Tier 2 monitoring to the DEMLR Regional Office within 30 days. • Respond to benchmark exceedances according to Tier response requirements. What -are key wastewater requirements? NCG020000 stipulates wastewater treatment facility operational requirements and periodic discharge monitoring: • Notify DEQ if facility fails to perform satisfactorily or creates nuisance conditions. • Only DEQ-evaluated flocculonts may be used, if administered according to maximum application doses. • Quarterly analytical monitoring for first year, or until four consecutive samples comply with all limits (then semi-annual monitoring allowed). Quarterly monitoring schedule resumes upon any limit violation. • Settleable solids (SS) monitoring applies to discharges to HQW, ORW, SA, SB, PNA, or Tr designated waters. • Total Suspended Solids (TSS) limits specific to industrial sand mines, and to any mine discharging to HQW. • Report wastewater effluent monitoring data once a year (by March 1 st) to DEQ Central Office. • Report effluent limitation violations to the DEMLR Regional Office within 30 days. • Effluent turbidity levels above the water quality standard prompt upstream and downstream monitoring. What has changed from the previous permit? Some changes specific to Stormwater: • Reduced BMP inspections (weekly) for active mines; additional allowances for inactive mines that quality for "dormant status." • Changes to SPPP Annual Update. • "Measureable storm event" (any size that results in a discharge) replaces "Representative" event. • New benchmarks and Tiers specific to turbidity. • Total Flow and event duration no longer required. • pH removed from VMA monitoring. Some changes specific to Wastewater: • May drop to semi-annual WW monitoring after four quarterly samples that comply with all limitations. • Turbidity instream monitoring is required if effluent levels above the water quality standard. • SS monitoring for sensitive waters only (HQW, etc.) • TSS limits apply to industrial sand mines and HQWs. The permit makes allowances for Inactive mines that have sus- pended all industrial activities and that certify to DEMLR that the site has been stabilized. If approved for "dormant status," these operations qualify for re- duced BMP inspections and may be exempted from outfall moni- toring by the Regional Engineer, Do I have to monitor all outfalls? Yes. However, you may request Representative Outfall Status (ROS). If approved, ROS allows monitoring at fewer outfalls. To request ROS, submit on ROS Re- quest Form to the DEMLR Region- al Office. The form is available on our website (below). Also, the Regional Office may exempt mines with "dormant sta- tus" from analytical and/or quali- tative monitoring. What if l sell my business, or the name changes? You are required to notify DEMLR of those changes in writing, and continuation of permit coverage is subject to the Director's ap- proval. Please submit the Name/ Ownership Change form located on our Program website. What do I do when my permit expires? Permitees are not required to sub- mit an application for renewal un- less directed by the Division, The permittee should continue to abide by this general permit if it expires and renewed coverage has not yet been issued. What is wastewater, and what is stormwater at a mine site? Any water contacting an actively mined area, water used to pro- cess mined materials, and mine dewatering water are all consid- ered "wastewater." For some mines, "mine dewatering" also means wet pit overflows, and not just pumped -out water. Any stormwater that commingles with these waters is "wastewater." "stormwater" includes runoff from areas related to mining, pro- cessing, or raw material storage areas, such as haul roads or pro- cessing plant areas at the mine. Sometimes the answer is not clear because of how broad the defini- tions are. For example, N.C. con- siders runoff from areas that con- tain overburden only (no mined or processed material), and that does not commingle with wastewater (including runoff from the mine), to be stormwater. If you are unsure about discharges, please contact the DEMLR Re- gional Office for assistance. Does a certified lab need to analyze my samples? Monitoring under NPDES permits must be conducted in accord- ance with test procedures ap- proved in federal regulations in 40 CFR § 136. All labs certified by LAST REV. 1(18115 North Carolina perform analysis in accordance with those proce- dures. While N.C. certification re- quirements do not apply to testing stormwater-only discharges, data gathered under an NPDES permit must still conform to federal re- quirements. Using a North Caroli- na certified lab is one way to en- sure compliance. If this happens, please sample for the missing parameter during the next measureable storm event or wastewater discharge. If I sample my discharge, do I have to do visual monitoring at the same time? You may, but it is not necessary under NCG02. Some other gen- eral permits require it, however. What if there is no flow for a period between two samples that exceed a benchmark? Are those consecutive exceedances? Yes. This scenario still puts you in Tier 2. The new permit is more clear about how the Tier 2 trigger omits periods of no discharge. This permit is expressly conditioned upon compliance with all the requirements of the approved Reclamation Plan. However, completed performance of the approved Reclamation Plan is a separable obligation, secured by the bond or other security on file with the Department, and may survive the expiration, revocation or suspension of this permit. This permit is not transferable by the permittee with the following exception: If another operator succeeds to the interest of the permittee in the permitted mining operation, by virtue of a sale, lease, assignment or otherwise, the Department may release the permittee from the duties imposed upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the successor operator, provided that both operators have complied with the requirements of the Mining Act and that the successor operator agrees to assume the duties of the permittee with reference to reclamation of the affected land and posts a suitable bond or other security. In the event that the Department determines that the permittee or permittee's successor is not complying with the Reclamation Plan or other terms and conditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act, the Department may give the operator written notice of its intent to modify, revolve or suspend the permit, or its intent to modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a hearing at a designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Definitions Wherever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49.,. Wastewater and Quarry Dewatering A. Any wastewater processing or mine dewatering shall be in accordance witF the -requirements and rules promulgated by the N.C. Environmental Management Commission. B. Any stormwater runoff from the affected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Protection Agency and enforced by the N.C. Environmental Management Commission. It shall be the permittee's responsibility to contact the Water Quality Section, Division of Environmental Management, to'secure any necessary stormwater permits or other approval documents. Z. Air Quality and Dust. Control A. Any mining related process producing air contaminant emissions including fugitive dust shall be subject to the requirements and rules promulgated by the N.C. Environmental Management Commission. B. The haul roads shall be sufficiently stabilized. During quarry operation, water trucks or other means that may be necessary shall be utilized to prevent dust from leaving the permitted area. 3. Buffer Zongs A. Any mining activity affecting wetlands shall be in accordance with the requirements and regulations promulgated by the U.S. Army Corps of Engineers. B. The buffer zones indicated on the mine map revised October 11, 1993 shall be maintained between any affected land and any adjoining waterway to prevent sedimentation of that waterway from erosion of the affected land and to preserve the integrity of the natural watercourse. These buffer zones shall be undisturbed. C. The buffer zones shown on the mine map revised October 11, 19;93 shall bE maintained to prevent caving of any adjoining property and to,allow grading of the side slopes to the required angle. These buffer zones, with the exception of the installation of required sedimgnt control measures and earthen berms, shall remain undisturbed. r m Page 4 of 10 4. Erosion and Sediment Control A. Adequate mechanical barriers including, but not limited to diversions, earthen dikes, silt check dams, silt retarding structures, rip rap pit. or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake or natural watercourse in proximity to the affected land. B. The mine map revised October 11, 1993 and supporting details submitted . with the letter dated October 28, 1993 shall be followed. C. Runoff from disturbed areas at the site shall be directed into the excavations or into the sediment basins noted on the above referenced mine map. D. An erosion and sediment control plan(s) shall be submitted to the Department for approval prior to any land disturbing activities not indicated on the revised erosion control plan or mine maps submitted with the approved application for the renewal and modification of this mining permit. Such areas include, but are not limited to, expansion outside of the pit area, creek crossings, or expansion of overburden disposal areas. 5. Groundwater Protection Groundwater monitoring wells shall be installed and monitored as deemed necessary by the Department. 6. Graded Slopes and Fills A. The angle for graded slopes and fills shall be no greater than the angl which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause off -site damage because of siltation, shall be planted or otherwise provided with groundcover, devices or structures sufficient to restrain such erosion. B. Overburden cut slopes along the perimeter of the any pit walls created or disturbed after December 29, 1993 shall be graded to a minimum 3 horizontal to 1 vertical or flatter and shall be stabilized within 60 days of completion. Furthermore, a minimum ten (10) foot wide horizontal safety bench shall be provided at the top of the rock and at the toe of the overburden slope along any pit walls created pr disturbE after December 29, 1993. c 1. Surface Drainage n; rn The affected land shall be graded so as to prevent collection-Lof pools of water that are, or likely to become, noxious or foul. In all blasting operations, except as hereinafter otherwise provided, the maximum peak particle velocity of any component of ground motion shall not exceed 1 inch per second at the immediate location of any building outside of the permitted area regularly occupied by human beings such as dwelling house, church, school, public building, or commercial or institutional building outside of the permitted area. The operator shall monitor each blast with a seismograph. B. Airblast overpressure shall not exceed 128 decibels linear (dBL) as measured at the immediate location of any regularly occupied building such as any dwelling house, church, school, public building, or commercial or institutional building. C. The operator shall take all reasonable precautions to insure that flyrock is not thrown beyond areas where the access is temporarily or permanently guarded by the operator. Should flyrock occur beyond the guarded area or the levels in Items A and B above are exceeded, the operator shall report the incident to the Department immediately and further use of explosive at the site shall be immediately suspended until the following actions have been taken: I. A thorough investigation as to the cause(s) of the incident shall be conducted. 2. A satisfactory report detailing the investigation shall be provided to the Department within 10 days of the incident. Said report shall, at a minimum, document the cause(s) of the incident along with technical and management actions that will be taken to prevent further incidents. The report shall meet with the approval of the Department before blasting may resume at the site. Failure to take corrective Teasures to prevent flyrock and repeated instances of flyrock shall be considered a violation of this permit. Xh D. The operator shall maintain records on each individual beast describing: the total number of holes; pattern of holes and delay ofinte'rvals; depth and size of holes; type and total pounds of exploscives,•- maximum pounds per delay interval; amount of stemming and burden ForCeach hole; and blast location. Records shall be maintained at the pernti;ttee's mine office and copies shall be provided to the Department upon request. Page 6 of 10 E 10. 11. The operator shall, when requested by the Department, give 24 hour advance notice to the Land Quality Section prior to any blast during a period for which notice is requested. High Wall, Barrier A physical barrier consisting of large boulders placed end -to -end or fencing shall be maintained at all times around the perimeter of any highwall to prevent inadvertent public access. In addition, a minimum 10 foot wide horizontal safety bench shall be provided at the junction between the top of rock and the toe of the overburden cut slope along any pit walls disturbed or created after December 29, 1993. Visual Screening Existing vegetation shall be maintained between the mine and public thoroughfares to screen the operation from the public. Additional screening methods, such as constructing earthen berms, shall be -employed as deemed appropriate by the Department. Loblolly and/or Virginia pines shall be planted as deemed appropriate by the Department to improve visual and noise buffering. 1 Plan Modification The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for the renewal and modification of this mining permit. Approval to implement such changes must be obtained from the Department prior to on -site implementation of the revisions. ft 12. Refuse Disposal A. No on -site disposal of refuse or other solid waste that are generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Solid Waste Management and the Land Quality Section, Department of Environment, Health and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Solid Waste Management. No petroleum products, acids, solvents) or their storage containers or any other material that may be cons3_'der¢d hazardous shall be disposed of within the permitted area. c, m Page 7 of 10 13. Annual Reclamation'Renort An Annual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. 14. Bonding The security which was posted pursuant to N.C.6.S. 74-54 in the form of a $50,000.00 surety bond is sufficient to cover the operation as indicated on the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 15. Archaeological Resources Authorized representatives of the Division of Archives and History shall be granted access to the site to determine the presence of significant archaeological resources. Page 8 of 10 ARPROVED RECLAMATION„ PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provided By G.S. 74-53 1. The final slopes in all excavations in soil, sand, gravel and other unconsolidated materials shall be at such an angle as to minimize the possibility of slides and be consistent with the future use of the land. 2. Provisions for safety to persons and to adjoining property must be provided it all excavations in rock. 3. All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the land. 4. No small pools of water shall be allowed to collect or remain on the mined. area that are, likely to become noxious, odious or foul. 5. The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the North Carolina Agricultural Experiment Station and the North Carolina Forest Service. 6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be conducted according to the time schedule included in the plan, which shall to the extent feasible provide reclamation simultaneous with mining operations and in any event, provide reclamation at the earliest practicable time after completion or termination of mining on any segment of the permit area and shall be complete( W thin two years after completion or termination of mining. RECLAMATION CONDITIONS: 1. Provided further, and subject to the Reclamation Schedule, the planned reclamation shall be to provide a permanent barricade (fence) along the top of any highwall and grade and revegetate any areas in unconsolidated material. 2. The specifications for surface gradient restoration to a surface suitable for the planned future use are as follows: rI, A. All areas of unconsolidated material such as overburden,or waste piles shall be graded to a 3 horizontal to 1 vertical or flatter Dope and terraced as necessary to insure slope stability. r- B. Any sediment control basins shall be backfilled, graded, and stabilized or cleaned out and made into acceptable lake areas. Page 9 of 10 C. The processing, stockpile, and other disturbed areas neighboring the mine excavation shall be leveled and smoothed. D. Compacted surfaces shall be disced, subsoiled or otherwise prepared before revegetation. E. No contaminants shall be permanently disposed of at the mine site. On - site disposal of waste shall be in accordance with Operating Condition 12A and B. F. The affected land shall be graded to prevent the collection of noxious or foul water. 3. Rev_eo_etation Plan: Disturbed areas shall be permanently revegetated according to the following: Seeding Mixture Species Tail fescue Sericea lespedeza Korean lespedeza Redtop F Soil Amendments Rate, lb./ac 40 20 10 5 Seeding Dates July 15 - Aug. 30 OR Mar.5 - May 15 Fertilizer: per soil tests, or 1000 lb/ac 5-10-10 Lime: per soil tests, or 4,000 lb/ac numn� Apply 4000-5000 lb/ac grain straw or equivalent. Anchor mulch by tacking with asphalt emulsion, roving or netting. The recommendations for tree plantings made by Mr. J. Gary Hyatt, County Extension Director for the Extension Service, dated October 17, 1991 shall also be incorporated into the revegetation plan. ' Page 10 of 10 4. Reclamation Plan: Reclamation shall be conducted simultaneously with mining to the extent feasible. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining of any mine segment under permit. Final reclamation, including revegetation, shall be completed within two year. of completion or termination of mining.
