The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following specific conditions and limitations: I. DESIGN STAND,*RDS 1. The following built -upon area limitations are approved for this project: .r a. The allowable built -upon area per lot is Snug Harbour II- 4,830 ft2; Peppertree- 3,930 ft2; Covil Point- 6,480 ft2, based on a total of 158 lots. b. The total allowable built -upon area for the tract is 1,008,240 W. 2. The overall tract built -upon area percentage or lot sizes for the project must be maintained at levels at least as stringent as the low density levels specified in the stormwater rules. The development must demonstrate that no areas within the project site are of such high density that stormwater runoff threatens water quality. 4. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. 5. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum side slopes of 3:1 (H: V) or curb outlet systems as defined in the stormwater rules and approved by the Division. This project utilizes curb breakq and swales. 6. No piping shall be allowed except: a. That minimum amount necessary to direct runoff beneath an impervious surface such as a road. b. That minimum amount needed under driveways. to provide access to lots. 7. Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all impervious areas and surface waters. 8. No homeowner/lot owner/developer shall be allowed to fill in, alter, or pipe any vegetative practices (such as swales) shown on the approved plans as part of the stormwater management system without submitting a revision to the permit -and receiving approval from the Division. 9. Each of tie lots in the subdivision will be limited to the amount of built -upon area indicated in the approved plans and consistent with item 1 above. 10. The permittee is responsible for verifying that the proposed home plans do not exceed the allowable built -upon area. Once the lot transfer is complete, the home plan may not be revised without approval from the permittee, and responsibility for meeting the built -upon area limit is transferred to the individual homeowner: 11. Deed restrictions are incorporated into this permit by reference and must be recorded with the Office of the Register of Deeds. A copy of the recorded restrictions must be received by this Office within 30 days of the date of recording. Recorded deed restrictions must include, as a minimum, the following statements related to stormwater management: Permit No.SW8 940814 a: A statement of the allowable built -upon area per lot in the following form: "The allowable built -upon area per lot is Snug Harbour 11- 4,830 W; Peppertree- 3,930 ft2; Covil Point- 6,480 W; inclusive of that portion of the right-of-way between the front lot line and the edge of the pavement, structures, pavement, walkways of brick, stone, slate, but not including wood decking. " b. Items related to stormwater management must remain in the deed res eiction, and this must be indicated by including the following: "The covenants pertaining to stormwater regulations may not be changed or deleted without concurrence of the State. " C. To assure that vegetated conveyances are not piped (in accordance with item 5) deed restrictions must indicate that: "Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with the development except for average driveway crossings, is strictly prohibited by any persons. " 12. The Engineer/Owner/Developer/Permittee must certify in writing that the project's stormwater controls, and impervious surfaces have been constructed within substantial intent of the approved plans and specifications. 13. The fo1'nT :ns will require a modification to the permit: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. In addition, the Director may determine that other revisions to the project should require a modification to the permit. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE 1. The permittee shall comply with the following schedule for construction and maintenance of the Low Density Option stormwater systems: a. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational for their intended use prior to the construction of any built -upon surface except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. Permit No.SW8 940814 2. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b Sediment removal. C. Mowing, 'and revegetating of the side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. 3. The permittee shall submit recorded deed restrictions limiting built -upon area per lot in accordance with Part I item 9 within 30 days of the date of recording. 4. The permittee shall submit the frngineer/Owner/Designer/Permittee Certification in accordance with Part I Item 12 within 30 days of completion of the project. 5. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. III, GENERAL CONDITIONS 1. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Environmental Management, in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. 2. The permit issued shall continue in force and effect until revoked or terminated. 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al. 5. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for those revisions under any of the following conditions: a. - Any additions, deletions or redesign of the previously permitted amount of built -upon area pro- posed regardless of the size of the modification. b. Further subdivision of the project area. 6. The permit is not transferable to any person except after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the permit to change the name and incorporate such other requirements as may be necessary. A formal permit request must be submitted to the Division of Environmental Management accompanied by the appropriate fee, documentation from both parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its -merits, and may or may not be approved. Permit No.3W8 940814 7.' Andrew and Kuske Engineers 202 North Fifth Avenue Wilmington, North Carolina 28401 Subject: Swale Velocity Calculations Covil Estates, Phase III Stormwater Project No. SW8 940814 New Hanover County Dear Mr. Norris: I have again reviewed the calculations submitted for Covil Estates, for compliance with the Curb and Gutter requirements, and some things must be cleared up. First, I did not suggest using a coefficient of discharge, C, of 0.4. I was merely pointing out that using a C factor of .25 for this subdivision was not in line with accepted practice. Actual C values should be determined based on individual drainage areas, not on an assumption based on an overall density limit of 25 %. Your composite C value is obtained by assuming that each individual drainage area to each swale contains 25 % -impervious surfaces. This is not true. A lrage portion of the green area (29 acres) does not flow into a swale, therefore it is a good assumption that the individual drainage areas to the swales are of a higher density than 25 %. Second, the procedure outlined in the Erosion Control manual will determine the permissible velocity for a given section, not the normal depth of flow for a given peak flow. Your job should be to take the swale cross-section provided and, basest on. Ma_nnings roughness coefficient and the peak flow, determine how deep the water flows, and in turn, how fast. You have determined only that the swale section specified on the plans will carry the peak flow. The depth you determine in your calculations is too deep for the required flow, resulting in inflated cross -sectional areas, and hence, decreased channel velocity. Using your numbers and Malcolm's normal depth procedure, I determined that swale #1 and 8 normal depths were more shallow than you had calculated, making the cross -sectional area smaller, hence increasing channel velocity above the allowable 4.5 fps for Bahia grass. Third, the differences between my numbers and yours are not enough to get too worried over, however, I would like to be reassured that if excessive erosion occurs in any of these swales, ie., every storm event causes a problem, something will be done by Dallas Harris, not the homeowner, to fix it. As per your January 25, 1995 correspondence we have revised the calculations to include an Ilo of 6.3 inches per hour and a C of 0.40. The Composite C was calculated as follows: C = .25(.95) + 0.75(.20) = .38 (round up to 0.40) Also, note the entire swale system has been designed using the procedures outlined in Section 8.05 of the NC Sedimentation and Erosion Control Manual. A preliminary review of that information has determined that the submittal for the subject project is not complete. The following information is needed to continue the stormwater review: 1. Based on your area delineations, we match up very well, therefore, I am safe in saying that my calculations of velocity are accurate. It appears that you are assuming that the individual drainage area is 25 % density, but this is not true. The C factor in the runoff equation is a runoff coefficient, not an estaimate of density. Malcolm uses a C factor of .40 for residences at 2 dwellings per acre, but this is too low when you consider the individual drainage area, to impervious area percentages. Some are as high as 50%. Please reconsider your use of .25 a runoff coefficient. 2. The slopes that you use for the swales is considerably less steep than I used. Please add the appropriate invert elevations to the plans so that I may use the same slopes that you do. I ran the computer program with the revisions and the results are 3. A preliminary review of that information has determined that the submittal for the subject project is not complete. The following information is needed to continue the stormwater review: 1. My calculation of runoff quantity, depth, and resultant velocity for the three major swales, #1, #4, and #8, are considerably larger than yours, possibly due to the 0.02 Mannings' "n" you use and the 5.0 inches per hour rainfall intensity you use. The range of Mannings' "n" for earth channels with short grass and a few weeds is 0.022 - 0.033. I use 0.03 as an average. The regulations require that the peak flow from the 10 year storm be able to pass through the Swale in a :non -erosive velocity. The dine 6f concentration should be close to 10 minutes, since the longest distance travelled is 1,170 feet along pavement at approximately 2.5 feet per second. The peak flow would then be associated with an intensity of 6.3 inches per hour. 2. You do not delineate your drainage areas, therefore, I have assumed, based on the flow arrows, the road, lot, and house area that drains to each swale. A preliminary review of that information has determined that the submittal for the subject project is not complete. The following information is needed to continue the stormwater review: 1. Is the 31.85 acres noted as the area of the AEC measured above the Mean High Water? Please draw in and label the MHW. 2. You are accounting for the cut -de -sacs as a 41' radius in the calculations, but the detail shows a 31' radius. Which is correct? 3. You are accounting for the road width as 23' in the calculations, but the detail shows a 22' width BG-BG. 4. All velocities in the proposed grassed swales exceed the maximum permissible for Bahia grass. Installation of check dams will only provide longer detention times. It will not reduce the initial velocity above the first check dam sufficiently to prevent erosion.
