Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 211.1000. We are forwarding Permit No. SW8 990902 dated December 9, 1999, for the construction of Omega World Travel. This permit shall be effective from the date of issuance until December 8, 2009, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface except roads. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to. the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions wcrc taken. 5. Decorative spray fountains will not be allowed in the stormwater treatment system. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 8. Ifthe storm.water system was used as an Erosion Control device, it must be restored to design conditionprior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size. z b. Project name change. c. Transfer of ownership. d. Redesign or addition to the approved amount. of built -upon area. e. Further subdivision, acquisition, or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The Director may determine that other revisions to the project should require a modification to the permit. A 4 State Stormwater Management Systems Permit No. SW8 990902 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 12. Prior to the sale of any portion of the property, an access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion of the property. 13. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. 14. The runoff from all built -upon area on the project must be directed into the permitted stormwater control system. 15. The Director may notify the permittee. when the permitted site does not meet one or more of the minimum requirements of the permit.Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Permit issued this the 9th day of December, 1999. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: Please seal the revised design calculations. 2. The supplement submitted still shows the permanent pool surface area as 8,150, whereas the calculations indicate it should be 11,044. Please revise the supplement. 3. The pond section detail, 7-L2, and the principal pond spillway detail, 8-L2, both indicate that the 1" design water surface elevation (ie, temporary pool elevation) is 33.5, whereas the calculations indicate it should be 33.2 Please revise and send 2 copies of the revised sheet L2. If you wish, I can make the changes to the plans and supplement, if the engineer gives me permission to do so in writing. This can be faxed to me. The following information is needed to continue the stormwater review: The proposed grading for the vegetated filter results in a filter that appears to be about T-3.5' below the existing ground. Again, the filter is not simply a wet connector ditch from the pond to the receiving stream. It's location must be carefully planned and it must be designed correctly in order to function as a filtering device. The fact that it will be at least 3' below existing grade does not bode well for it to function as intended. T oo many of these filters, in situations exactly like this, do not work and the pond must be reconstructed after the fact to make up the additional surface area to achieve 90% TSS removal efficiency. This results in unnecessary expense for the owner. In this case,l must deny use of the vegetated filter and require you to use the 90% TSS chart and delete the filter. The outlet structure needs some revisions in order to meet the requirements. Currently, the orifice outlet end is above the permanent pool, which affects the water level in the pond, and the amount of storage available. What prevents runoff from leaving through the 36" pipe once elevation 32 is reached? The orifice outlet must be at the permanent pool elevation, and there must be some physical barrier inside the 36" pipe that prevents runoff from leaving except through the orifice all the way up to the storage elevation. You will need to show a view of the 36" pipe looking into it to show how the orifice and barrier (weir) structure are positioned. 12. Please label the 6:1 slope and width of the required vegetated shelf on the pond section detail. 13. Please add a forebay detail to the pond section detail. Include the bottom elevation and the distance from the permanent pool contour to the weir wall. / 14. Please provide a legend on the plans. The reported SA/DA ratio is incorrect. For a 5' deep pond, at 82.3% impervious, and 85%TSS P , the SA/DA ratio should be 5.34%, not 4.34%. The surface area is deficient by about 2,000 �1 square feet. 0 16. The pond's width at elevation 36 is labeled as 70', which means.that there is only 10' to get from elevation 32 to 36. In order to do this at a 3:1 slope, the width would need to be 12'.
