This permit expires on December 9, 2009. Section .1003(h) of 15 A NCAC 2H .1000 (the stormwater rules) requires that applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $506.00. If this is still an active project please complete and submit the enclosed renewal application in a timely manner. If this project has not been constructed and a permit is no longer needed, please submit a request to have the permit rescinded. If you have sold the project, or are no longer the permittee, please provide the name, mailing address and phone number of the person or entity that is now responsible for this permit. Enclosed is a form for change of ownership, which should be completed and submitted if the property has changed hands. Your permit requires that upon completion of construction and prior to operation of the permitted treatment units a certification of completion be submitted to the Division from an appropriate designer for the system installed. This is to certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and supporting documentation. Please include a copy of the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample certification. Also enclosed Is a new Operation and Maintenance agreement that shouts be completed and submitted along with your renewal applkation. You should be aware that failure to provide the Designers Certification and the operation of a stonnwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and may result In appropriate enforcement action including the assessment of civil penalties of up to $10,000 per day. This inspection was performed to determine compliance with the North Carolina Sedimentation Pollution Control Act of 1973. The inspection revealed a land - disturbing activity of approximately 2.16 acres being conducted. It is our understanding that you and your firm are responsible for this land -disturbing activity. The purpose of this letter is to inform you that this activity was found to be in violation of the Act, NCGS 113A-50 to 66, and Title 15A, North Carolina Administrative Code, Chapter 4. If you feel that you are not responsible for the following violations, please notify this office immediately. The violations that were found are: Failure to file an erosion and sedimentation control plan with this office at least 30 days prior to beginning a land -disturbing activity on a tract comprising more than one acre, when more than one acre is to be uncovered, failure to secure this office's-prior approval of the plan for any land - disturbing activity prior to beginning the land -disturbing activity. NCGS. 113A-54(d)(4), G. S. 113A- 57(4) and 15A NCAC 413.0007(c). A land -disturbing activity greater than 2 acres is occurring without an approved eoosion and sedimentation control plan. An acceptable erosion and sedimentation control plan must be filed with and approved by this office and implemented on the site sufficient to prevent off -site sedimentation. Until the required plan has been approved, temporary measures must be provided immediately to control erosion and prevent `sedimentation damage. Any additional land -disturbing activities conducted without an approved erosion and sedimentation control plan will constitute additional violations of the Act. Erosion and sediment control meausres are not present. To correct these violations, you must: Submit an erosion and sedimentation control plan. 2. Install erosion and sedimentation control measures. Protect ditches from sediment accumulation. Please note that merely planting grass seed does not satisfy the requirements of "vegetative cover" or of "ground cover sufficient to restrain erosion." These requirements are not satisfied until a standing cover of grass or other ground cover is established which is, in fact, sufficient to restrain accelerated or man-made erosion. Please be advised that if you fail to respond..to this notice or if these violations are not corrected within 30 days of receipt of this notice, the Director, Division of Land Resources, will be requested to take appropriate legal action against you pursuant to NCGS 113A-64. That action could be the assessment of a civil penalty and the amount may be up to $5000 per day for each day of the violation. The penalty may be assessed from the date of the violation, NCGS 113A-61 (a) (1). If these violations are corrected within the time period specified for compliance, no further legal action will be pursued. Please be advised that any new land -disturbing activity associated with this project must not begin until the area presently disturbed is brought into compliance with the Act.
