Dear Mr. Dukham:
This is written approval of your request dated April 8, 2020, to uncover greater than 20 acres
in a High Quality Water (HQW) Zone per 15A NCAC 04B .0124(a) of the administrative code
and to proceed with the subject project per the Erosion and Sedimentation Control Plan
"Approved" by the Orange County Local Sediment and Erosion Control Program of the
Division of Energy, Mineral, and Land Resources on April 16, 2020. The following
condition(s) apply:
1. The amount of acreage to be disturbed at any one time under this waiver is
56.6 acres. This total acreage includes 36.6 acres of land above the 20 acres of
disturbance allowed in a High Quality Water Zone.
2. This waiver does not relieve you of any other High Quality Water
requirements or environmental regulatory requirements for High Quality
Waters with regard to the Sedimentation Pollution Control Act, its
Administrative Code, or any other Local, State or Federal requirements.
In addition to any modification, stipulations, comments, or performance reservations placed
in the Approval Letter from the Orange County Local Sediment and Erosion Control Program,
if the subject project receives a Notice of Violation for violation(s) of the Sedimentation
Control Act (NCGS 113A-50 through 69) or its Administrative Code (15A NCAC 04A), this
Approval Memorandum maybe revoked and this project will be limited to a maximum total

uncovered area within the boundaries of the tract of 20 acres. Any uncovered area beyond
the 20 acres limit will be immediately required to be provided with adequate ground cover.
