Fps and Discounts - Fees listed in our Schedules of Services are based on current costs of performing analyses and may be changed without prior notice,
except where bound by contract. Discounts may be offered based on the guaranteed work volume on a project -by- project, or amoral contract basis. All
discounts from standard fee schedules are given subject to compliance with our standard payment terms. Discounts are automatically revoked as invoices
become past due. unless other arrangements are made in advance.
Saniffile Pickup Service - A sample pickup fee of $20.00 per stop (10 minutes or less) is charged when we pick up samples on our regularly scheduled
routes. Sample pickup, on weekdays other than our scheduled routes, is available for an additional charge, provided at least 24 hour notice is given prior
to date of requested pickup. If a sample pickup is requested that is not on a regular route, we can arrange for a drop/pickup site at one of regularly
scheduled stops. If a meeting site cannot be arranged we can provide pickup based on Time ($50.00/hr) and Mileage ($.50/mile).

submitted to Southern Testing for analysis. If Data Retention requirements are greater than 5 years arrangements must be made with Southern Testing.
Confidentiality - All work will be performed in strict confidence. Results are released only to the client or his/her designated agent Confidentiality
agreements will gladly be provided and executed upon request.
Warranty and Limits of Liabilify - Our wairaniy is limited to the accuracy of analyses of samples as received. We assume no responsibility for the
pgrposes for which the client use's the test results, nor liability for any other warranties, expressed or implied. including warranties of fitness for a
particular purpose art for merchantability madtihyahe client. These terms and conditions shall supersede any conflicting terms and conditions stated on
any purchase order, or other order of work submitted by the client.
Additional Fees and Legal Cases - By subntiTtmg samples for analysis, the Client agrees that our analysis fees do no include the cost of any additional
orincidental services that may become associ$tedwith the analytical results. such as but not limited to interpretation ofresults to the client ors third party

Dear Mr. Vick:
On December 2, 2005 Mr. Christopher Wu of the Raleigh Regional Office conducted a
stormwater evaluation inspection of S.T. Wooten Corporation's Asphalt Mixing Facilities in
Pittsboro and Moncure with the assistance of Mr. James Washburn, safety associate of the
facilities. His help was appreciated as it eased the inspection processes.
The purpose of the evaluation was to see if S.T. Wooten was abiding by the guidelines provided
under general permits NCG160057 (Pittsboro) and NCG160148 (Moncure). A maintained
stormwater program is essential for protecting the integrity of surface waters. Both facilities
produce asphalt and keep all production materials (e.g. sand, recycled asphalt, ground stone, and
ground granite) stockpiled on -site. These piles have the capability to contaminate the adjacent
unnamed tributaries (UTs) to Jordan Lake. Mr. Washburn monitors all of S.T. Wooten's
facilities and outfalls on a monthly basis (at a minimum) and ensures that all sampling is
conducted when required.
The S.T. Wooten Pittsboro site has 4 outfalls. The facility is sloped to drain to four separate
containment pits that are surrounded with gravel berms. Under conditions of excess rain, the pits
will discharge to the woods. Only Outfall 4 at the Pittsboro site discharges near a UT that drains
to Jordan Lake. During the last sampling event, Outfalls 3 and 4 did not discharge, but the other
2 exceeded the cutoff concentration for TSS (225 mg/L — OF 1; 136 mg/L — OF 2). The
Moncure site has 3 outfalls, 2 of which discharged during the last sampling event. Only one
outfall exceeded the cutoff concentration (198 mg/L — OF 1), but according to the permits all
outfalls from both facilities must be sampled and analytically monitored next year. Microbac
Laboratories is the contract laboratory used by S.T. Wooten. Along with the analytical
monitoring, Mr. Washburn is conducting semi-annual qualitative monitoring as required by the
permit and all records are kept in a logbook. He also inspects the conditions of all basins on a
regular basis to ensure the structural integrity of each.

Pittsboro site. After further investigation it was discovered that some of S.T. Wooten's forested
property (outside the perimeter of its asphalt production) had been cleared and proper controls
were not placed around the perimeter to sequester the sediment. It was recommended that, at a
minimum, silt fences be placed around the cleared land to sequester any runoff. Mr. Washburn
stated that sediment and erosion plans have been submitted to the Division of Land Resources
and is waiting for approval prior to grubbing the land.
Regarding documentation, all qualitative and quantitative monitoring was conducted and the
proper DMR forms were used and submitted to the Division for review. All components of the
Stormwater Pollution Prevention Plan were present including: detailed site maps with clearly
labeled storm drains, a list of potential contaminants, a spill and response plan, a narrative
describing BMPs, and emergency response. There are also annual spill and mitigation training
sessions that are required for all employees and new hires.

forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and
the Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding: "
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal
Area Management Act or any other Federal or Local governmental permit that may be required.
