Dear Mr. Isaiah Reed:
On February 28, 2020 the Town of Black Mountain received a Notice of Violation (NOV-2020-
PC-0116) regarding the MS4 Program audit. The Town understands that the Notice of Violation
requires written acknowledgement of the Notice of Violation and expressed intent to comply.
The Town intends to comply with the requirements of this notice, including this written response,
adoption of a resolution from the governing board, submit post-construction self-audit and draft
stormwater management plan for review, submit a new NPDES MS4 application upon
concurrence from DEQ on stormwater management plan, and respond to public comments on the
draft stormwater management plan and submit for final approval and permit issuance.
The Town will work diligently to meet these requirements and achieve compliance in the future.
