A copy of the DEMLR letter granting ROS shall be kept on site. 4 For each sampled measureable storm event, the total precipitation must be recorded. An on -site rain gauge reading must be recorded. Where isolated sites are unmanned for extended periods of time, a local rain gauge reading may be substituted for an on -site reading. S Arsenic, chromium, and copper shall be monitored twice per year (unless other provisions of this permit prompt monthly sampling) during the first year of permit coverage only. No benchmarks apply to these metals, but DEQ may use sample results to assess whether coverage under this General Permit should be renewed when the General Permit is renewed in 2018. Preservative is applied in a closed system process (including the drip -pad; no exposure to rainfall). • The site was covered under an individual permit (NCS000004) several years ago that was rescinded in 2007 because the Division of Water Quality determined there was no point source discharge of stormwater. • The plant has expanded to include a post -peeling operation for trees. The outlet for sediment control at the southern corner of the property will now be the only outfall associated with industrial activity. This is what prompted the need for a new discharge permit. • Ken Pickle had communicated with the consultant last June and advised that DEQ would consider it for coverage under the NCG21 permit with an augmented COC, so they are aware that GP coverage could come with extra stipulations. • After receiving the NOI, we requested additional sampling; results are attached. [They mailed it in Jan 2017, but a lot of our mail went missing around then, and we never received the hard copy. I got a digital copy in March after following up on it.] • Copper (Cu) and TSS were over current benchmarks. As, Cr, and COD were well under current benchmarks. Cu levels (0.047 mg/I vs. 0.010mg/I benchmark) were not atypical or unusually high, though; we have encountered many sites where Cu is over the benchmark as a result of other influences. • Based on potential pollutants (and possible legacy issues), we think the COC should (1) require the COD/TSS monitoring despite there being no material piles stored on site, and (2) include additional monitoring for constituents found in CCA wood preserver. I have proposed they monitor these metals for the first year without any benchmarks. The GP is up for renewal in 2018, so they would not trigger monthly monitoring until the first two semi-annual samples in the first year anyway. They will trigger Tiers 1 and/or 2 if elevated TSS levels persist, though. • We can review the data at the time of GP renewal to determine whether it is appropriate for this site to continue being covered under the General Permit. At that time, it may be fine to let them have coverage under NCG21 as written, or to continue requiring special monitoring. Please let us know if the MRO is in concurrence with granting a COC for this site under NCG210000. The preservative used since inception is CCA ( chromated copper arsenate). The operation is a closed system meaning that all excess preservative is captured and returned to the process tank for reuse via a drip pad and door pit. A vacuum / pressure process is employed for treating. Material is loaded into the retort and an initial vacuum is applied to prepare the material to better absorb the treating chemical. Next the retort is filled with chemical and put under pressure until the proper amount of preservative is absorbed. At the end of the treating cycle another vacuum is established to reclaim excess preservative and partially dry the material. In the last step in the process the material is placed on a drip pad until dry. The treating plant is the only operation that has been on the property to date. The current expansion includes a post peeling operation where full length trees will be processed into round fence posts. No byproducts (peelings, chips, bark) will be stockpiled on the ground. Based on your description of the site and operations over the phone, I think we may be able to permit this facility under NCG21, with an augmented Certificate of Coverage (COC). Unless we see something unanticipated in the NO1 submittal it seems likely that we will modify the monitoring portion of the permit with additional conditions in the COC under NCG21. This approach will let your client have permit coverage quicker, and will require less effort on our part. In order to be comfortable with this permitting approach we will need a good site plan and a good narrative description of the site and processes along with the first submittal of the NOI. Per our discussion today, I think you already know the sort of information we need on the submitted site plan: good graphic description of the site facilities, outfalls located, any stormwater drainage features or treatment practices, operating areas identified, exposures identified, sub - drainage areas identified if multiple ones on site, chemical storage areas identified, etc. See attached the NOI that you reported some difficulty downloading from our website.
