In addition, RPC has developed a Hazardous Material Control and Management Program (enclosed). It is our opinion, that the procedures and information contained therein constitute a SPPP and will insure prompt and adequate actions should a pollution event associated with the stonnwater retention system occur. Fortunately, the inspectors determined that no oil had reached the water, but were concerned that the rain expected this week could. cause a problem. Upon our review of the site, it is clear that you are in violation of our lease agreement which prohibits storage of hazardous materials. Your company placed several barrels of oil on the side of the building. Several barrels were open including two open containers and oil filters that leaked oil on the ground. With the recent rain, it was apparent that oil and rain water overflowed from two containers and oil residue was heading toward the water. They informed us that IF the water had been contaminated, substantial fines would have been levied against us. Further, our immediate action was required to avoid possible fines of S27,500 per day. Needles to say, we are taking this incident very seriously and hope that you will by working with us to resolve the matey. Our required clean-up efforts are only one aspect to consider as we move forward from this incident. Of course we expect to be reimbursed for the cost of our remediation efforts and your full cooperation by removing the oil barrels by the end of the day. The removal of the barrels from their current location was specifically required by the Coast Guard. While we do not foresee a problem, part of the remediation efforts will include verification that the soil underlying the asphalt is clean. Such verification will need to be provided by a firm capable of making such a determination. We are requiring this based on the fact that we have existing reports showing that the sites were clean prior to this incident. If you desire our assistance in arranging this test, or are unable to comply with this request immediately, we will have the study performed and include the cost of the study in our bill to clean up the site.
