In accordance with your request, Certificate of Coverage Number NCG 140368 is rescinded effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwatcr to waters of the State without valid coverage under an NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will occur for persons that have voluntarily relinquished pernut coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential heed for NPDES permit coverage. The incoming cement is transferred to the cement silos. Aggregate, sand, cement, and flyash from the storage silos are combined in the cement scales where they are mixed and sent up the enclosed conveyor belt system to the mixer where water is added. Your submittal contained a check for $80, one transmittal letter, one NOI form, one location map, three sets of calculations, three different site layout drawings, and an erosion controls details drawing. The submittal is significantly deficient, and we are returning it unprocessed. The submittal is deficient in the following particulars. The 11" x 17" site plan is illegible as presented. Whatever relevant information the original full size color drawing may have contained has been lost in your presentation of a reduced, black and white copy. The Topographic Survey by ECR, presumably presented as your stormwater control site plan, is illegible in part, incomplete in presenting the information relevant for our review, and apparently in error as to direction of surface water flow. Item 14 of the NOI requires the submittal of three sets of application documents. Your submittal did contain three sets of calculations, but we require three complete sets of submittal documents. Please consider that as reviewers, we can't tell from the site plans whether the measures you are proposing are sufficient, or not, because the drawing does not present a complete picture of the site with respect to our items of interest in a review. Specifically: we must know where the wastewater and stormwater discharge points are, if any. We must know where the wastewater flows originate - - the areas of the site are not labeled so that we can identify where wastewater originates (for most ready mix sites we need to see the aggregate piles, the rinse off stations, the drum wash out stations, the recycle system, the recycle system overflow piping, and the batch plant.) We must be able to identify by inspection of topography the drainage area boundaries so that we can confirm that your proposed measures indeed capture all of the stormwater and wastewater from the site. The area drains to Lake Ashnoca, Class C. The applicant chose to provide calculations showing that he can contain the 25-year, 24-hour storm. As shown on the attached facility map, there are two raw material piles, sand and rock, and a recycle system for washing the trucks which uses two rectangular recycle tanks. The stormwater that is not either recycled or contained by berms around the raw material piles drains to a single drain inlet located near the sand stock pile. I worked through the applicant's calculations to verify that the 25-year storm is contained around the raw material piles and the recycle tanks. They appear to be correct. Does the Asheville Regional office object to issuing this permit? If not, I will issue it after 30 days. Note that I have also attached the calculations (I don't know if you typically review those or not). I got basically the same numbers, but found at least one error on the tank recycle system in the application. However, this resulting in over -sizing one of the tanks.)
