Box 644 Murphy, North Carolina 28906 Dear Mr. Charles: July 25, 2001 Subject: NOTICE OF VIOLATION Unpermitted Discharge Charles Redi-Mix, Cherokee Plant COC #NCG140240 Cherokee County On July 3, 2001, Division of Water Quality staff member Kerry S. Becker inspected the Charles Redi-Mix facility located in Cherokee County. At the time of the inspection, the concrete holding tanks for the wash water were overflowing onto the adjacent ground. The dam for the stormwater pond located on the lower end of the property had been breached allowing wastewater to flow across the property. These conditions are violations of the requirements contained in the Certificate of Coverage for this facility. Ms. Becker states she discussed ttiese problems with an employee and he assured her the problems would be corrected. She will conduct a follow-up inspection in August. Please be aware that failure to correct the above noted problems can lead to the initiation of enforcement proceedings against you. If you should have any questions, please contact Kerry S. Becker at 828-251-6308, ext. 258. Although wastewater did not escape the immediate premises of this company's property at anytime, the broken dam coupled with heavy rails allowed water to gather in an undesignated area. The dam has been repaired and all wastewater run-off is again confined to the designated pond area. Respectfully, Ar Roger Charles pD Il JUL 3 0 2001 i )A' i '.
