Reference is made to your recent request for rescission of the subject NPDES General Permit. It has come
to our attention that your facility is already covered under Certificate of Coverage NCGI00042. In
accordance with your request, NPDES General Permit NCG 100111 is rescinded, effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters
of the State without a valid NPDES permit will subject the responsible party to a civil penalty of up to
$25,000 per day. Enforcement action will be certain for persons that have voluntarily relinquished permit
coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still
requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish
to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

Your facility is currently covered for stormwater discharge under General Permit NCG 100000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion' to all operators of industrial
facilities in any of the 1 I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional
information contact the Central Office Stormwater Staff member listed below or check the Stormwater & General
Permits Unit Web Site at http://h2o.enr.state.nc.us/su/stormwater.htm]
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottom of the form. You will be notified when the
rescission process has been completed.

Aisha-
Thanks for the information you sent me on the U-Pull-It Auto Parts
stormwater application located in McDowell Co. I visited the site
yesterday, and it actually is located along the edge of a soybean
field. They were even combining the soybeans while I was there!
Nix Creek and this section of the Catawba River are classified as "C",
so there are no Water Supply streams on the site. The site looked
okay - about 4-5 dozen used/wrecked cars located between the soybean
field and the small UT. I did not observe any evidence of spills
from the vehicles. The vegetative buffer along the unnamed tributary
has not been disturbed.
You can proceed with the issuance of the Certificate of Coverage for a
stormwater permit for the site.

Good morning Jim. I just spoke to Forrest, here in the Ivory

and he told me that he is passing the monthly list I've been sending
him to you for review. He also said that since ya'II are using Quatro
Pro and Word Perfect he has been unable to open the attachments. So,
I'll try including Asheville's facilities in the body of the message.
This past list had only two facilities in the Asheville region,
they
were NCG060232, Earthgrains Baking Companies, Inc. in Burke County;
and NCG100111, U-Pull-It Auto Parts, Inc., in McDowell County. Please
let me know by October 23 whether or not we should proceed with
issuance of the Certificates of Coverage, require an individual

On June 25, 1998, I visited this site as the result of
a complaint through your office from a McDowell County
citizen. The concern was the release of automotive fluids
being released to the Catawba River from a site owned my
Larry Hollifield on Roby Connelly Road.
The site had been filled and graded for what appears to
be a building site. There was an improvements certificate
on a tree from the McDowell County Health Department. The
site also contained 17 automobiles of which only two
appeared to be in a condition that would not be driveable.
Most of the other cars where in pretty good shape. I looked
over the ground around and under the cars. All the cars had
motors in them and there was no evidence of oil or
antifreeze being drained or poured on the ground.
There had been a culvert installed in a stream
providing access to the property, with some riparian
wetlands that had been filled and a small stream which had
been channelized and rerouted.

On June 22, 1998, 1 received a complaint concening the storage of "junk" automobiles on
property owned by Mr. Larry Hollifield. The complainant alleged that the automobiles are being
stored on the flood plain and that the automobiles may be covered with water during flood
periods. The complainant was concerned about the release of automotive fluids and that
automobile fluids were being released into the Catawba River. The property is located off Roby
Connelly (7) Road off Hwy. 70 west near Marion. Mr Hollifield's number is 828/756-4203.
After review of the information provided by phone, it has been determined that at this time, the
hazardous waste regulations (RCRA) do not apply to the site. However our review did indicate
that site conditions exist which may warrant a review by your section. Consequently, we
respectfully refer this site to your section for consideration.

application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
