Coverage under this general permit is applicable to all owners or operator, of stormwater point source discharges associated with activities classified as establishments primarily engaged in activities classified as Used Motor Vehicle Pans [Standard Indtntnal Classification (SIC) 50151 and Automobile Wrecking for Scrap(a portion of SIC 5093). The following activities am specifically excluded from coverage under this General Permit: establishments primarily engaged in the wholesale trade of metal waste and scrap, iron and steel scrap. and nonferrous metal scrap (hereafter referred to as the metal waste recycling industry). Other Information PART IV LIMITATIONS REOPENER PART V ADMINISTERING AND COMPLIANCE MONITORING FEE REQUIREMENTS PART VI DEFINITIONS Permit No. NCGI00000 PART INTRODUCTION SECTIONA: GENERALPERMIT COVERAGE All persons desiring In he covered by this General Permit must register with the Division of Water Quality by the filing of a Notice of Intent (NOp and applicable fees. The NOI shall be submitted and a certificate of cmnrage issued prior to any discharge of stmorwater associated with industrial activity that has a point source discharge to the surface waters of the state. Any owner or operator not wishing to be covered or limited by this General Permit may make application for an individual NPDFS permit in accordance with NPDES procedures in 15A NCAC 211.0100, stating the reasons supporting the request. Any application for an individual permit should be made at least 180 days prior to commencement of discharge. This General Permit does not cover activities or discharges covered by an individual NPDES permit until the individual permit has expired or has been revoked. Any person conducting an activity covered by an individual permit but which could be covered by this General Permit may request that the individual permit he revoked and coverage under this General Permit be provided. If industrial materials and activities are not exposed to precipitation or runoff as described in 40 CFR § 12226(g), the facility may qualify for a No Exposure Exclusion from NPDES Stormwater diwhzrgepermilrequirerucels- Any owner or operator wishing to obtain a No Exposure Certification most submit a No Exposure Cenification NOI form to the Division, must receive approval by the Division, must maintain no exposure conditions unless authorized to discharge under a valid NPDES stomiwater permit, and must reapply for the No Exposure Exclusion once every five (5) years. Facilities submitting NOI for coverage under this permit, and facilities submitting renewal fomu for continued coverage under this permit, prior to establishment or approval of a Total Maximum Daily Load (TMDL) for pollutant(s) for stormwater discharge,%(i.e. we( weather flows), may be covered under this Perron during its (errs. For such facilities, continued coverage under the rei,nom a of Ellis permit is subject to the facility demonstrating that it does not have a reasonable potential to violate applicable water quality standards for such pollutants due to the s(orrnwater dischuge(s). For facilities that do have a reasonable potential for violation of applicable water quality standards due to the stonnwater discharge(s). the facility shall apply for an individual permit 180 days prior to the expiration of this general permit. Once the individual permit is issued and becomes effective the facility will no longer have coverage under the general permit. Any other point source discharge to surface waters of the state is prohibited unless it is an allowable non-smrmwmer discharge or is covered by another permit.:mthraimtion or approval The stormwater discharges allowed by this General Permit shall not cause or contribute to violations of Water Quality Standards. This permit does not relieve the permittee from responsibility for compliance with any other applicable federal. state- or local law, rule, standard, ordinance, order, judgment, or decree. Permit No. NCG 100000 PART II MONITORING, CONTROLS. AND LIMITATIONS FOR PERMITTED DISCHARGES SECFION A: S'rORslWATER POLLUTION PREVENTION PLAN The perminee shall develop a Stormwuter Pollution Prevention Plan, herein after referred to as the Plan. This Plan shall be considered public information in accordance with Part III, Standard Conditions. Section E. Paragraph 3 of this general permit. The Plan shall include, at a minimum. the following items: Site Plan. The site plan shall provide description of the physical facility and the potential pollutant sources which may be expected to contribute to contamination of stormwater discharges. The site plan shall contain the following: (a) A general location map (USGS quadrangle map or appropriately drafted equivalent map), showing the facility, location in relation to transportation rowel and sufface waters, the name of the receiving water(s) to which the stormwater outfall(s) discharges, or if the discharge is to a municipal separate storm sewer system, the name of the municipality and the ultimate receiving waters. and accurate latitude and longitude of the point(s) of discharge. The map should identify whether each receiving water is impaired too the rate 303(d) list of impaired waters) or is located in a watershed for which a TMDL has been estsblLshed, and what the parameters) of concern are. A narrative description of the potential pollutants which could be expected to be present in the stormwater discharge from each outfall. (c) A site map drawn to scale (including a distance legend) identifying and indicating the location of: the site property boundary, the stormwater discharge points, all on -site and adjacent surface waters and wetlands, industrial activity areas (including storage of materials. disposal areas, process areas, loading and unloading are,, and haul mods), site topography, all drainage features and structures, drainage areas for each outfall, industrial activities occurring in each drainage area, buildings, existing BMPs, and impervious surfaces. The site map must indicate the percentage of each drainage area that is impers'ions. (d) A list of significant spills or leaks of pollutants that have occurred at the facility during the three (3) previous years and any corrective actions taken to mitigate spill impacts. The certification statement will be signed in accordance with the requirements found in Pan III, Standard Conditions Section B. Paragraph 5. 2. Stomtwater Management Plan. The s menwater management plan shall contain a narrative description of the materials management practices employed which control or minimize the exposure of significant materials to stormwater. including structural and nonsuucmral measures. The stonnwater management plan, at a minimum. shall ocoTmwe the following: (a) Feasibility Study. A review of the technical and economic feasibility ofchanging the methods of operations and/or storage practices to eliminate or reduce exposurc of materials and processes to stormwater. Wherever pmetical. the permittee shall prevent exposure of all stomge areas, material handling opcations, and manufacturing or fueling operations. In areas where elimination of exposure is not practical, the sumerwater management plan shall document the feasibility of diverting the stornwater runoff away from areas of potential contamination. (h) Secondary Containment Requirements and Records. Secondary containment is required for: bulk storage of liquid materials; storage in any amount of Section 313 of Title I❑ of the Superfund Amendments and Reauthorization Act (SARA) water priority chemicals; and storage in any amount of hazardous substances, in order to prevent leaks and spills Item contaminating stornwater mnoff. Amble or summary of all such tanks and stored materials and their associated secondary containment areas shall be maintained if the secondary containment devices are connected directly to stormwater conveyance systems, the connection shall be controlled by manually activated valves mother similar devices (which shall be secured closed with a locking mechanism), and any, stmowater that accumulates in the containment area shall be at a minimum visually observed for color, foam, outfall staining. visible sheens and dry weather Bow, prior to release of the accumulated smienwater. Accumulated amrnuaw, shall be released if found to be uncontaminated by the material stored within the containment area. Records documenting the individual making the observation, the description of the accumulated stannwater, and the date and time of the release shall be kept for a petted of five years. s. (c) BMP Summary. A narrative description shall be provided of Best Management Practices (BMPs) to be considered such as, but not limited to, oil and grease separation, debris control, vegetative filter strips, infiltration and onto water detention or retention, where necessary. The need for structural BMPs shall be based on the maesserem of the potential of pollutant sources to contribute significant quantities of pollutants to stormwater discharges and data collected through monitoring of stormwater discharges. 3. Spill Prevention and Response Plan. The Spill Prevention and Response Plan (SPRP) shall incorporate an assessment of potential pollutant sources based on it materials inventory of the facility. Facility personnel (or team) responsible for implementing the Permit No. XCG 100000 SPRP shall be identified. A responsible person shall be on -site at all times during facility operations that have the potential to contaminate stormwater mnoff ibmugh spills or exposure of materials associated with the facility operations. The SPRP must be site ,amerwamr specif ic. Therefore. an oil SPCC plan maybe a component of the SPRP but may not he sufficient to completely address the stormwater aspens of the SPRP. The common elements of the SPCC with the SPRP may be incorporated by reference into the SPRP. 3. Preventative Maintenance and Good Housekeeping Program. A preventative maintenance program shall be developed. The program shall document schedules of inspections and maintenance activities of saornwater control systems, plant equipment and systems- Inspection of material handling areas and regular cleaning schedules of these areas shall be incorporated into the program. 5. Employee Training. Training schedules shall be developed and training provided at a minimum on an annual basis on proper spill response and cleanup procedures and preventative maintenance activities for all personnel involved in any of the facilit-v's operations that have the potential to contaminate stomtwater runoff. Facility personnel (or team) responsible for implementing the training shall he idenifed. 6. Responsible Party. The Storhwater Pollution Prevention Plan shall identify a specific positions) responsible for the overall coordination, development, implementation, and revision to the Plan_ Responsibilities for all components of the Plan shall he documented and position assignment, provided. 7. Plan Amendment. The permittee shall amend the Plan whenever there is a change in design, construction. Operation, or maintenance which has a significant effect on the potential for the discharge of pollutants to surface water. The Stonnv,nw, Pollution Prevention Plan shall be reviewed and updated on an annual basis. The annual update shall include an updated list of significant spills or leaks of pollutant, for the previous three years. or the notation that no spills have occurred. The annual update shall include recertification that the stormwater omfalls have been evaluated for the presence of non- stnnnwmer discharges. The Director may notify the permittee when the Plan does not meet one or more of the minimum requirements of the permit. Within 30 days of such notice, the permittee shall submit a time schedule to the Director for modifying the Plan to meet minimum requirements. The permittee shull provide certification in writing (in accordance with Pan BI. Standard Conditions, Section B. Paragraph 5) to the Director that the changes have been made. Facility Inspection Program. Inspections of the facility and all stormwater systems shall occur at a minimum on a semi-annual schedule, once during the first half of the year (January to June) and once during the second half (July to December), with at least 60- days separating inspection dates (unless performed more frequentlyl. The inspection and any subsequent maintenance activities performed shall be documented, recording date and time Of inspection, indiv idual(s) making the inspection and a narrative description of the facility's stormwater control systems. plant equipment and systems. Records of these inspections shall be incorporated into the Stormuater Pollution Prevention Plan. The parmittee shall comply with standurds or prohibitions es'tablu'hed under section 307(a) of the Clean Water Act for toxic pollutants within the time provided in the regulations that establish these standards or prohibitions, even if the permit has not yet been modified to incorporate the requirement. The Clean Water Act provides that any person who violates section 301. 302. 306, 307, 308. 318 or 405 of the Act. or any permit condition or limitation implementing any such sections in a permit issued under section 402, is subject to a civil penalty not to exceed S27,500 Per day for each violation. Any person who negligently violates such sections. or any permit condition or limitation is subject to criminal penalties of S2,500 to S25.000 Per day of violation, or imprisonment for not more than I year, or both. In the case of a second or subsequent conviction for a negligent violation, a person shall be subject to criminal penalties of not more than $50.000 per day of violation, or by imprisonment of rim more than'_ years, nr both- Any person who knowingly violates such sections, or any permit conditions or limitations is subject to criminal penalties of $5,000 to S50MO per day of violation, or imprisonment for not more than 3 )'ears, or both. In the case of a second or subsequent conviction for a knowing endangerment violation, a person shall be subject to a fine of not more than S500,000 or by imprisonment of not more than 30 years, or both. An organization (as defined in section 309 of the Clean Water Act) shall. upon conviction of violating the imminent danger provision. be subject to a fine of not more than $1,000,000 and can he fined up in $2,000,000 for second or subsequent convictions. Also, any person who violates a permit condition may be assessed an ad mi n ismmi ve penalty not to exceed $11.000 per violation with the maximum amount not to exceed $137,500. [Ref: Section 309 of the Federal An 33 USC 1319 and 40 CFR 122 4[(a).1 c. Under state law, a dai lj civil penal tv of not more than twenty-five thousand dollars ($25,000) per violation may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of a petit. Any person may be assessed an administrative penalty by the Director for violating section 301. 302. 306, 307, 308, 318. or 405 of the Act, or any permit condition or limitation implementing any of such sections in a permit issued under section 402 of the Act_ Administrative penalties for Class I violations are not to exceed $11.000 per violation, with the maximum amount of any Class I penalty assessed not In exceed $27,500. Penalties for Class II violations are not to exceed $11.000 per day for each day during which the violation continues, with the maximum amount of any Class II penalty' not to exceed $137,500. Duty to Mitigate The permiuee shall take all reasonable steps to minimize or prevent any discharge in violation of this general permit which has a masm able likelihood of adsxrsely affecting human health orthe environment. Civil and Criminal LiabTty Except as provided in Section D of this permit regarding bypassing of storwater control facilities, nothing in this general permit shall be consumed to relieve the pemiuee from any responsibilities, liabilities, or penahies for noncompliance pursuant to NCGS 143- 215.3, 143-215.6A. 143 215.613, 143-215.6C or Section 309 of the Federal Act, 33 USC l319. Furthermore, the perittee is responsible for consequential damages. such as fish kil6, even though the responsibility for effective compliance may be temporarily suspended. Oil and Hazardous Substance Liability Nothing in this general permit shall be consumed to preclude the institution of any legal action or relieve the permittee from any responsibilities, liabilities, or penalties to which Permit No. NCG 100000 the pennume is or may be subject to under NCGS 143-215 75 et seq_ or Section 31 1 of the Federal Act- 33 USC 1321, _ 6. Prooerty Riehts The issuance of this general permit does not convey any property rights in either real or personal property, or any exclusive privileges, nor does it authorize any injury to private property or any invasion of personal rights, nor any infringement of Federal, State or local Inws or regulations. T Sever bility The provisions of this general permit are severable, and if any provision of this general permit, or the application of any prevision of this general permit to any circumstances, is held invalid, the application of -such provision m other circumstances, and the remainder of this general permit. shall not be affected thereby. - 8. Duty to Provide Information The permitter, shall famish to the Director, within a reasonable time, any information which the Director may request to determine whether cause exists for modifying, revoking and reissuing, or terminating the certificate of coverage issued pursuant to this general permit or to determine compliance with this general permit. The permittee shall also famish to the Director upon request. copies of records required to be kept by this general permit. 9. Penalties for Tam smra The Clean Water Act provides that any person who falsifies. tampers with. or knowingly renders inaccurate, any monitoring device or method required to be maintained under this general permit shall, upon conviction. be punished by a fine of not more than $10,000 per violation. or by imprisonment for not more than two years per violation, or by both. If a conviction of a person is for a violation committed after a first conviction of such person under this paragraph, punishment is a fine of not more that $20.000 per day of violation, orby imprisonment of not more than 4 years, or troth. 10. Penalties for PalsiOcation of Renons The Clean Water Act provides that any person who knowingly makes any false statement. representation, or certification in any record or other document submitted or required to be maintained under this general permit, including monitoring reports or reports of compliance or noncompliance shal I. upon conviction, be punished by a fine of not more than $10,000 per violation, or by imprisonment for not more than two years per violation, or by both. In order to receive automatic authorisation to discharge beyond the expiration date, the permiuee shall submit forms and fees as are required by the agency authorized to issue pemift no later than I80 dap prior to the expiration date. Any peninttee that has not requested renewal at least 180 days prior to expiration, or any perniuce that does not have a permit after the expiration and has not requested renewal at least 180 days prior to expiation. will be subjected to enforcement procedures as provided in NCGS § 143-2153.6 and 33 USC 1251 et. seq. Trmsfers The certificate of coverage issued pursuant to this general permit is not transferable to any person except after notice to and approval by the Director, The Director may require modification or revocation and ork,a or, of the certificate of coverage to change the name and incorporate such other requirements as may be necessary under the Clean Water Act. When an Individual Permit Mav be Retuned The Director may require any owner/operdior authorized to discharge under a certificate of coverage issued pursuant to this general permit to apply for and obtain an individual Permit or an ahemame general permit. Any interested person may petition the Director to take action under this paragraph. Cases where an individual permit may be required include, but are not limited to, the following: a. The discharger is a significant contributor of pollutants: b- Conditions at the permitted site change, altering the constituents and/or characteristics of the discharge such that the discharge no longer qualifies for a general permit: c. The discharge violates the terms or conditions of this general permit: d- A change has occurred in the availability of demonstrated technology or practices I., the control or abatement of pollutants applicable to the point source; c. Effluent limitations are promulgated for the point sources covered by'this general permit: f A water quality management plan containing requirements applicable to such point sources is approved after the issuance of this general permit. Permit No. NCG IO(1000 The Director determines at his or her own discretion that an individual permit is required. 3. When an Individual Perri t Slay be Requested Any permitter operating under this general permit may request to be excluded from the coverage of this general permit by applying for an individual permit. When an individual permit is issued to at owner/operutnr the applicability of this general permit is automatically terminated on the effective date of the individual permit. Signatory Requiremrnls All applications, repair, or information submitted to the Director shall be signed and certified. All notices of intent to be covered under this general permit shall be signed as follows. (1) For a corporation: by a responsible corporate officer. For the purpose of this Section. a responsible corporate officer means: (a) a president, secretary, treasurer or vice president of the corporation in charge of a principal business function, art any other person who performs similar policy or decision making functions for the corporation. or (bl the manager of one or more manufacturing production or operating facilities employing more than 250 persons or having gross annual sales or expenditures exceeding 25 million (in second quarter 1980 dollars), if authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures. (2) For a partnership or sole proprietorship: by a general partner or the proprietor, respectively: or (3) For a municipality, State, Federal, or other public agency': by either a principal executive officer or ranking elected official. All reports required by the general permit and other information requested by the Director shall he signed by a person described above or by a duly authorized representative of that person. A person is a duly authorized representative only if: (1) The authorization is made in writing by a person described above: (2) The authorization specified either an individual or a position having responsibility for the overall operation of the regulated facility or activity, such as the position of plant manager, operator of a well or well field, superintendent, a position of equivalent responsibility, or an individual or position having overall responsibility for environmental matters for the company. (A duly authorized representative may thus be either a named individual or any individual occupying a named position.): and Part III Page 4 of I I Pages Pan III Page 5 of I I Page, Permit No. NCG1000)0 (3) The written authorization is submitted to the Director. c. Any person signing a document under paragraphs a. Or b. of this section shall make the following certification: "I certify, under penalty of law, that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to in rare that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system, or those persons directly responsible for gathering the information, the information submitted is to the best of my knowledge and belief, we, accurate, and complete 1 am aware that there are significant penalties for saddening false information, including the possibility of fines and imprisonment for knowing violations." General Permit Modification. Revocation and Reissuance or Termination The issuance of this general permit does not prombil the Director from reopening and modifying the general permit. revoking and reissuing the general permit. or terminating the general permit as allowed by the laws, rules, and regulations contained in Title 40. Code of Federal Regulations, Parts 122 and 123: Title 15A of the North Cambria Administrative Code. Subchapter 2H .0100: and North Carolina General Statute 143- 215.1 et. al. After public notice and opportunity for a hearing the general permit may be terminated for cause. The filing of a request for a general permit modification, revocation and reissuance, or termination does not stay any general permit condition. The certificate of coverage shall expire when the general permit is terminated. Certificate of Coverage Actions The certificate of coverage issued in accordance with this general permit may be modified. revoked and reissued, or terminated for cause. The notification of planned changes or anticipated noncompliance does not say any general permit condition. SECTION C: OPERATION AND ,MAINTENANCE OF POLLUTION CONTROLS Prover Operation and Maintenance The pernimee shall at all times properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by the perrollot to achieve compliance with the conditions of this general permit. Proper operation and maintenance also includes adequate laboratory control and appropriate quality assurance procedures. This prevision requires the operation of back-up or auxiliary facilities or similar systems which are installed by a permittee only when the operation is necessary to achieve compliance with the conditions of the general permit. Permit No. NCG 100000 Need to Halt or Reduce not a Defense It shall not be a defense for a pent in an enforcement action that it would have been necessary to halt or reduce the permitted activity in order to maintain compliance with the condition of this general permit. Bvnassing of Slormwatcr Control Faci Iitics Bypass is prohibited and the Director may take enforcement anion against a pernittee for bypass unless: Bypass was unavoidable to prevent loss of life, personal injury or severe property damage; and b. There were no feasible alternatives to the bypass. such as the use of auxiliary control facilities, retention of sio rawater or maintenance during normal periods of equipment downtime or dry weather. This condition is not satisfied if adequate backup controls should have been installed in the exercise of reasonable engineering judgment to prevent a bypass which occurred during normal periods of equipment downtime or preventive maintenance: and The pe rnittee submitted notices as required under Section F of this permit. If the Director determines that it will meet the three condition, listed above, the Director may approve an anticipated bypass after considering its adverse effects. SECTION D: MONITORING AND RECORDS Representative Sampling Samples collected and measurements taken, as required herein, shall he characteristic of the volume and nature of the perudtted discharge. Analytical sampling shall be performed during a representative spun event. Samples shall be taken on a day and time that is characteristic of the discharge. All samples shall be taken before the discharge joins or is diluted by any other waste stream, body of water, or substance. Monitoring points as specified in this permit shall not be changed without notification to and approval of the Director. Test Procedures Test procedures for the analysis of pollutants shall conform to the EMC regulations published pursuant to NCGS 143-215.63 et. ,eq, the Water and Air Quality Reporting Acts, and to regulations published pursuant to Section 304(g). 33 USC 1914, of the Federal Water Pollution Control Act, as Amended, and Regulation 40 CFR 136, To meet the intent of the monitoring required by this general permit. all test procedures must produce minimum detection and reporting levels and all data generated must be reported down to the minimum detection or lower reporting level of the procedure. Remm,eman,x, Outfall If a facility has multiple discharge locations with substantially identical ,tormwmer discharges that arc required to be sampled. the pemtittee may petition the Director for representative outfall status. If it is established that the storrnwater discharges are substantially identical and the pennhnce is granted representative outfall status,, then sampling requirements may he performed at a reduced number of outfalls. Records Retention Visual monitoring shall be documented and records maintained at the facility along with the Stormwmer Pollution Prevention Plan. Copies of anal)tical monitoring results shall also be maintained on -site. The permiuee shall retain records ofall monitoring information, including all calibration and maintenance records and all original step chart recordings for continuous monitoring instrumentation. and copies of all reporo required by this general permit for a period of m least 5 years from the date of the sample, measurement, repair or application. This period may be extended by request of the Direct., at anv time. Sample or monitor at reasonable times, far the purposes of assuring general permit compliance or as otherwise authorized by the Clean Water Act, any substances or parameter at any location. SECTION E: REPORTING REQUIREMENTS Discharge Monitoring Report Samples analyzed in accordance with the terms of this permit ,hall be submitted to the Division on Discharge Marinating Report forms provided by the Director. Submittals shall be received by the Division no later than 30 days from the date the facility receives the sampling remits from the 1.1ac ry. When no discharge has occurred from the facility during the repon penod, the permitter is required to submit a discharge monitoring repair within 30 love of the end of the six- month sampling period giving all required information and indicating "NO FLOW" as Par NCAC T I5A 02B .0506. Avuilabilityof Renom Except for data determined to be eonfidemi ul under NCGS 143-215.3(a)(2) or Sermon -n=1�of the Federal Act, 33 USC 1318. all repons prepared in accordance with the terms shall be available for public inspection at the offices of the Division of Water Quality As required by the Act. analytical data shall not be considered confidential. Knowingly making any false statement on any such report may result in the imposition of criminal penalties as provided for in NCGS 143-215.6B or in Section 309 of the Federal Act. 4. Non-Stormwater Discharges If the storm event monitored in accordance with this general permit coincides with a non- stormwaterdischarge, the perchance shall separately monitor all parameters as required under the non-stormwater discharge permit and provide this information with the stormwater discharge monitoring report. 5. Planned Chimer, The perm itee shall give notice to the Director as soon as possible of any planned changes at the permitted facility which could significantly alter the nature or quantity of pollutants discharged. This notification requirement includes pollutants which are not specifically listed in the general permit or subject to notification requirements under 40 CFR Pan 122.421.). 6. Anticipated Noncompliance The perouttee shall give notice to the Director as soon as possible of any planned changes at the permitted facility which may result in noncompliance with the general permit requirements. 7. Bypass Anticipated bypass. If the perminee knows in advance of the need for a bypass. it shall submit prior notice, if possible at least ten days before the date of the bypass, including an evaluation of the anticipated quality and affect of the bypass. Unanticipated bypass. The perchance shall submit notice within 24 hours of an unanticipated bypass. 8. Twenty-four flour Retuning The peonioee shall report to the central office or the appropriate regional office any noncompliance which may endanger health or the environment. Any information shall be provided orally within 24 hours from the time the permatee became aware of the circumstances. A written submission shall also he provided within 5 days of the time the permittce becomes aware of the circumstances. Permit No. NCG 100000 The written submission shall contain a description of the noncompliance, and its causes: the period of noncompliance, including exact dates and times. and if the noncompliance has not been corrected, the anticipated time compliance is expected to continue: and steps taken or planned to reduce, eliminate, and prevent reoccurrence of the noncompliance, The Director may waive the written report on a case -by -case basis if the oral report has been received within 24 hours. Other Noncompliance The pemtittee shall report all instances of noncompliance not reported under 24 hour reporting at the time monimring reports are submitted_ 10. Other Information Where the permimee becomes aware that it failed to submit any relevant facts in a Notice of Intent to be covered under this general permit or in any report to the Director, it shall promptly submit such facts or infomtaion. These permits are issued under the final NPDES as outlined in Title 40 of the CFR, Part 122.26(b) (14). The North Carolina General Statutes, Chapter 143-215.1, authorizes and directs the Environment Management Commission of the Department of Environment and Natural Resources to protect and preserve the water and air resources of the state. The NCDENR is responsible for implementing the NPDES General Permit through the Division of Water Quality under General Permit NCG200000 (NCG20). 1.1 Objective The objective of this SWPPP is to identify potential pollutants or uncontrolled discharges and to provide the structural and/or management practices necessary to minimize the possibility of introducing pollutants into the waters of the state as a result of activities at Woodfin Auto Salvage. This plan is designed to satisfy the requirements of NCG200000. 1.2 Methodology Conclusions and recommendations contained in this plan are based on information gathered during site recons, discussions with operations personnel, engineering and management. 1.3 General Plan Requirements The plan is to be maintained on -site. Submittal of the plan to the NCDENR is for compliance review only. Internal facility inspections by qualified personnel should be conducted at specified intervals, and inspection records should be kept with this plan. Employee training is required annually with records of personnel who were trained also kept with the plan, The plan must be reviewed annually and updated as necessary or as directed by the NCDENR. Records should be maintained for three years after the permits lapses or expires. 2.0 Pollution Prevention Committee The pollution prevention committee team will assist the Team Leader, Connie Ledford in implementing this plan. As shown in Table 2.1, the individuals on this team have varying responsibilities for the storm water pollution prevention. The facility engages in scrap metal recycling with an 5093 SIC The facility is bordered to the north by industrial property, to the east by Riverside Drive to the south by industrial property and to the west by the French Broad River. The limit of the industrial activity on site will encompass approximately 2.88 acres. The operations began in 1959 3.2 Materials and Processes The scrap materials handled at the site are: Household metal scrap Ferrous Metals Non -Ferrous Metals Automobiles Processing equipment includes the following: - Magnets - Front Loaders - Auto Crushers - Balers - Trucks - Cranes - Fluid Reclamation Stations Material handling and process flows are as follows: 1. Raw material (ferrous and non-ferrous metal), is delivered by individuals using various means, weighed, and unloaded into storage piles on the yard. The materials are then moved by front loaders, magnets or cranes to the proper processing equipment. The process is dependent upon the commodity, but includes cutting, sizing, baling, or crushing. 2. Finished goods are accumulated in storage piles, bales or bins and then sold. Waste products are accumulated in piles loaded in waste containers and appropriately disposed of. 3.3 Site Drainage Most of the water drains from the property via a swale running east to west on the north side of the site. A small amount of water drains from the property through a vegetated swale running east to west on the south side of the site. See site drainage map on Drawing 3.0. 3.3.1 Outfalls and Drainage Areas Outfalls with direction of drainage areas are shown on the site drainage map drawing. 3.3.2 Structural Stormwater Controls One structural stormwater control device has been constructed within each of the drainage areas to assist in controlling the direction of stormwater flow, the soil erosion control system and the sediment settling control and to provide an access control point for storm water sampling. This control device is a bermed containment reservoir with a pipe for discharge sampling. 3.3.3 Surface Waters There are no surface waters on the site. The closest surface water is the French Broad River that is adjacent to the west boundary of the site. 3.3.4 Potential Pollutant Sources The potential for pollutant sources are as follows; Hydrocarbons and other contaminates from materials brought on site for processing Oil. gasoline, grease, coolants and battery fluids from equipment operating on site. Heavy metals from materials brought on site for processing. 3.4 Non -Storm Water Discharge USEPA has four methods for testing for non -storm water discharge: 1. Visual inspection 2. Plant schematic review 3. Smoke test 4. The outfall was visually checked for non - storm water discharge on February 25, 2008. After several days of dry weather, the outfalls were dry. Connie Ledford Date Site Manager/ Owner 3.4 Significant Spill USEPA defines "significant spills," to include releases within a 24-hour period of hazardous substances in excess of reportable quantities under Section 311 of the Clean Water Act and Section 102 of CERCLA. Reportable quantities are set amounts of substances in pounds, gallons, or other units and listed in 40 CFR Part 117 and 40 CFR Part 302. A list is found as Appendix H of this plan. Significant spills also may include a discharge of oil in harmful quantities, defined as any discharge which: I. Violates applicable water quality standards, or 2. Cause a film or sheen upon or discoloration or the surface of the water or adjoining shorelines, or 3. Causes a sludge or emulsion to be deposited beneath the surface of the water or upon adjoining shoreline. Oil includes any petroleum product or other type of oil, whether of synthetic, animal, or vegetable origin. It also includes oily scum or sludge and mixtures of oil and other waste A discharge is defined as any spilling, leaking, pumping, pouring, emitting, emptying, dumping or washing of materials into the environment. Shills of hazardous substances or oil which meet anv of these criteria must be reported to the National response Center (800) 424-8801 and NCDENR. Woodfin Auto Salvage has not had any significant spills or releases in the past year. If a spill of any type occurs it will be documented on the form found in Appendix G of this SWPPP. 4.0 Best Management Practices 4.1 General BMPS include but are not limited to housekeeping, preventative maintenance, spill prevention and response, sediment and erosion control, proper materials handling, and employee training. 4.2 Good Housekeeping Program Good housekeeping practices will ensure a clean and orderly work environment. They can be implemented by initiating good material inventory, identifying and labeling of storage containers, scheduling routine cleanup operations, maintaining well organized work areas, and training employees about good housekeeping practices. The policy of Woodfin Auto Salvage Inc., is that all leaks will be cleaned immediately and surfaces where leaks occur be covered with covered with an adsorbent material until the product is recovered and barreled. All materials will be labeled so that employees can quickly determine the type of material spilled and how to clean and report the spill as necessary. 4.2.1 Outside Storage Storage of any raw material, by-product, finished products, containers, or waste in areas exposed to rain and/or runoff can create the potential for storm water pollution. Storm water can be contaminated by spills, leaks, or by substances which wash off containers, or overflow from non -capped buckets, barrels, or cans. The best way to avoid this is to prevent storm water or rain from coming in contact with materials by: 1. Storing any container that holds a potential pollutant indoors. 2. Covering the storage area with a roof. 3. Covering the containers with a temporary covering made of polyethylene, polyurethane, polypropylene, or Hypalon. 4. Any storage area that is not determined to be an "inside storage area," should be enclosed within berm that has a ground cover. The new policy for all containers used on site at Woodfin Auto Salvage Inc., is that each opened and unopened container will be stored in an enclosed facility and that empty containers will be disposed of using proper waste disposal procedures. No containers will be left around operating equipment, discarded or stacked where storm water or rain could potentially cause a pollutant to impact the soil or the storm water runoff. 4.2.2 Inventory of Exposed materials The permit requires a general inventory of significant materials handled at the facility which may potentially be exposed to storm water. Significant materials (to the extent known by the permitee) that have been handled, treated, stored, or disposed in a manner to allow exposure to storm water may include the following: Types of Scrap A. Coolant or refrigerant from automobiles G. Oil, grease, hydraulic oils, transmission oils or other hydrocarbon, vegetable oil, or synthetic oils used for maintenance or other operational activities. Table 4.1 will be updated as the types of materials with the potential to be exposed to storm water change. Outfall locations should be monitored to ensure proper discharge, berms should be monitored to ensure effective runoff control and material storage areas should be monitored to ensure that storm water and/or rain is not infiltrating the containment system. 4.2.4 Loading and Unloading of Materials Materials spilled, leaked, or lost during loading/unloading may collect in the soils or other surfaces and be carried away during rainfall or cleaning. Loading/unloading activities that can contaminate storm water include the transfer of scrap from the seller, transfer of scrap to or from the processing areas or devices, materials shipment activities, equipment maintenance products handling or equipment transfers. Covering loading and unloading areas with buildings or overhangs can reduce exposure of materials, vehicles, and equipment to rain. Runoff flowing across a loading/unloading areas can wash contaminates into storm drains or surface waters. This can be minimized by grading, berming, or curbing the area. Also, roof downspouts should be positioned so storm water is directed away from loading/unloading areas, preferably to a non -evasive runoff system. 4.2.5 Waste Disposal Practices On -site waste piles, dumpsters and processing debris can result in considerable release of pollutants during storms. These areas are of concern since they can concentrate pollutants. All waste should be placed in covered containers or under a roof while awaiting disposal. Therefore, no waste should be left on the ground for any period of time. Any waste left in piles should be covered with a waterproof material, but should only remain on -site for the least amount of time as possible. 4.3 Preventative Maintenance Measures for Equipment Preventative maintenance involves the routine inspection and testing of processing, handling and plant equipment. These inspections should look for conditions such as cracks or slow leaks which could cause breakdowns or failures that would result in significant releases of pollutants to storm water or surface waters. The program should prevent breakdowns and failures by adjustment, repair or replacement of parts or removing the equipment from service if necessary. An effective preventative maintenance program should therefore, include the following: Identification of equipment, systems and facility areas that should be inspected, A schedule for periodic inspections or test of the equipment and systems, Appropriate and timely adjustment, repair, or replacement of equipment and systems, Maintenance records of completed inspections, adjustments, or repairs should be maintained with the plan. Identification of equipment or systems to inspect would be the first step in the process of equipment preventative maintenance. The items that should be inspected are those that may malfunction and cause spills, leaks, or other situations that could lead to storm water contamination. Look at the section of the plan that describes the potential sources that were identified during the pollutant assessment phase. The following list identifies some types of equipment to include in your program: Storage tanks Front loaders Balers Crushers Vehicles Erosion Control devices The facility should schedule routine preventative maintenance inspections. These inspections will identify the majority of potential problems with pollutant releases. Look for leaks, corrosion, support or foundation failure, or other forms of deterioration. Look for spots or puddles of chemicals and document any detection of smoke, fumes, or other signs of leaks. Promptly repair or replace defective equipment found during an inspection. Record all inspections and finding in a general equipment maintenance log that should be kept with all other site documentation that relates to this SWPPP. As part of the pollution prevention committee include a member that is responsible for the inspection of equipment and systems. This individual should create a checklist of equipment and areas on that equipment that should be of concern. The items listed below might be on that list: Motors Hoses Pumps Tanks Berms Outfall Pipes Chemical retention devices Oil handling systems There should be a place on the inspection form or checklist to record the date, time, name of the inspector, weather conditions, findings and intended follow-up actions needed/taken. A designated person should keep the records of incidents such as spills, leaks or other repairs, along with required cleanup caused by the needed repair. 4.3.1 Facility Visual Inspections Procedures for visual inspections in compliance with new NCDENR directives are described in Section 7 of this plan. Frequent visual inspections help to ensure that all facets of the plan are in place and properly functioning. Records of the inspection should be maintained with this plan. The records should indicate who preformed the inspection, what areas were inspected, what problems were found, and what actions were taken. 4.3.2 Sediment and Erosion Control A sediment and erosion control program will identify areas of stress and areas that present a potential for significant soil erosion so that appropriate measures can be taken. Sediment control will be an ongoing program at Woodfin Auto Salvage, in that we will be covering much of the area in concrete over the next year and diverting storm water into designated oil water separators prior to release of the storm water. Water entering the facility will be diverted around the facility into the current storm water runoff device adjacent to the facility. 4.3.3 Traditional Storm water Management Practices The following is a list of traditional controls for storm water exposure and runoff: Berm Door Skirt Canopy Drip Pan Catch Basin Grit Chamber Cisterns Guard Container (covered) Gutter Cover device Filtration Device Ground Cover Manhole Culvert Overhang Curb Pipe Ditch Pump Retention Basin Roof Secondary Containment Sump Tank Trench Valve Water treatment for reuse Weir 4.4 Recommended BMPS 4.4.1 Material Receipt and Unloading Trucks deliver ferrous and non-ferrous metals to the site. These metals are dumped in piles on the yard or stacked in piles when they are cars. Potential pollutant -_Residual oils or other contaminants on the scrap material or inside housings may pollute the storm water if they contact precipitation or runoff. BMP --Inbound materials are inspected by trained employees to identify materials that could pose a threat to human health or to the environment. Any oil containing or oil -covered items are removed and disposed of properly prior to the remaining materials being processed. 4.4.2 Scrap Storage Equipment used for scrap processing includes shears, balers, eddy current separators, and shredders. Front-end loaders, magnets, cranes and forklifts move the materials to the processing equipment and into storage piles. Potential Pollutant -_Oils and grease from equipment and scrap material may pollute stone water if precipitation or runoff contacts the contaminant. BPM --Practicable containment systems, such as a concrete pad with berms, should be provided under the hydraulic system of any stationary scrap processing equipment exposed to storm water. Drip pans or equivalent measures should be placed under any leaking piece of stationary equipment until the leak is repaired. Where parts of the hydraulic system are not visible to the operator, an alarm and/or shutoff system should be installed and maintained on all outside equipment with hydraulic reservoirs exceeding 150 gallons in order to prevent draining the tank contents if a line breaks. As an alternative, such equipment may have a secondary containment system capable of containing the contents of the hydraulic reservoir plus rainfall from a 24-hour, 10-year storm event. 4.4.3 Waste Material Waste material resulting from the processing are found throughout the site. Potential Pollutants- Residuals oils on waste material may contaminate storm water BMP- The waste material is collected and relocated into trucks or bins for proper disposal. All waste is disposed of at an approved sanitary landfill. The storage areas should be on concrete to prevent contamination from entering the ground surface and basins should be used for settling and filtering of pollutants reaching the storm water. 4.4.4 Containers and Dumpsters Trash is dumped into covered dumpsters located near the trash discharge point of the processing equipment. Drums, containers, pallets are located throughout the site. All drums and containers are properly labeled to indicate chemical or hazardous material content. Potential Pollutant- Open containers can collect storm water, which can be polluted by the contents and leak onto the ground. Trash, debris, pollutants, and residual oils on containers can wash into storm water. BMP-All open containers should be moved indoors or covered. The site will be checked for open containers during quarterly inspection. Dumpsters should remain covered. 4.4.5 Preventive Maintenance for Site Scrap metal, waste material, various containers, and equipment are used to stored throughout the site. Potential Pollutant- _These items or materials can come in contact with storm water and pollute the runoff. BMP- The following BMPS have been implemented in all areas where storm water pollution is a concern: l . Sweep accessible paved areas, as needed, on a regular basis. 2. Do not flush paved or concrete areas with water, except that small amount of water necessary for dust control. 3. Post notices to prohibit the dumping of materials into storm drains. 4. Contain and repair all significant leaks and spills as soon as practicable. 5. Use dry cleanup methods, where appropriate, on all significant leaks and spills. Ensure that an adequate supply of absorbent material is maintained, and used absorbent material is cleaned up and properly disposed. 6. Store all open containers and all drums containing liquids, including oil and lubricants, indoors; in a bermed or curbed outdoor area; in over pack containers or in spill pallets; or in similar containment devices. 4.4.6 Preventive Maintenance Measures for Equipment Vehicles and scrap processing equipment are used in every aspect of the recycling process. The vehicles and equipment are regularly tested and inspected for any fluid leaks, malfunctioning parts, parts (such as gaskets) in need of replacement, and worn or corroder equipment. Maintenance and lubrication are conducted indoors, when practical. Polenlial Pollutants _This equipment can become wom or malfunction and may leak pollutants onto the ground. BMP- Woodfin Auto Salvage's preventive inspection and testing program involves regular inspections and maintenance of major equipment and vehicles used or stored outside. The program includes: Service checklists and maintenance logs for each major piece of equipment. 2 Employee education and instruction materials. 3. Review of manufactures -recommended frequency of parts replacement and maintenance activities. 4. Frequent cleaning of major processing equipment or systems used or stored outside to remove accumulated oil and grease that may be exposed to storm water (except where needed for proper operation of the equipment) or that may hide equipment trouble area. 5. Scheduled maintenance of vehicles and major equipment in a -covered, curbed or bermed area. Use of drip pans under equipment and vehicles during all maintenance to capture leaks. Use dry cleanup methods for leaks and spills. 4.4.7 Sediment and Erosion Control Areas of the facility that are not paved can have the potential for erosion and suspended solids loading. Potential Pollutants - Erosion can cause silt, sand and rock to be carried away by storm water BMP- The facility will install storm water catch basins to catch runoff and allow settling of storm water. 4.4.8 Employee Training The employees at Woodfin Auto Salvage are critical to the prevention of storm water contamination. Potential Pollutant- _Uninformed employees could inadvertently contaminate the storrr water by spilling or pouring oils or other pollutants on the ground or down the catch basins. BMP- Woodfin Auto Salvage has a training program for employees and suppliers. The employee training program addresses those conditions that cause pollution, the effective use of the BMPS presented in this plan, and proper scrap inspection handling and storage procedures. Appropriate training is provided for: A. Truck drivers. B. Scale operators. C. Supervisors D. Operating personnel A supplier notification program has been developed to inform the major suppliers of the following: A. Types of material not accepted at this facility. B. Conditions for the acceptance of certain types of materials C. Potential liability for cleanup costs if hazardous substances are contained in the material or scrap they supply. Additionally, these items along with housekeeping, cleaning, etc., are discussed in the monthly safety meeting held at the site. 5.0 Monitoring Program 5.1 General Monitoring requirements for storm water compliance are described below. (This monitoring and laboratory analysis is in addition to the visual examination of storm water quality. Each storm water outfall should be monitored in each year beginning January I, through December 31 each outfall shall be monitored at least quarterly (four times a year.) 2. The quarterly monitoring periods for are January through March, April through June, July through September, and October through December. 3. Samples shall be collected from a qualifying rainfall event of more than 0.1 inch at 72 hours after any previous rainfall. 4. Grab and composite samples shall be taken during the first thirty minutes of the discharge. 5. The following information shall be provided: A. Date B. Duration of rainfall event (in hours) C. Rainfall measured or estimated in inches D. Duration between rainfall event monitored and the previous rainfall event. 5.2 Monitoring Procedures Samples shall be taken at the outfall locations as shown on Drawing 3.0. To take the grab sample, the sampler will use a glass jar any fill the jar with one event, while composite samples will be with multiple grabs. The laboratory that will perform the test should be contracted for any special instructions and procedures for preserving and shipping the samples. Testing procedures for storm water samples shall be standard EPA - approved analysis methods. Results shall be recorded on NCDENR Storm Water Monitoring Report Forms which will be supplied by the state. 5.3 Reporting One Storm Water Monitoring Report Form must be submitted for each event and for each outfall sampled. Two signed copies of the report are to be sent to the following address no later than the 3 P day of March following the monitoring year. Employees will have an annual training session and all new employees will have said training prior to beginning work on -site. The training program should include the following: Preventative maintenance activities 2. Spill prevention procedures, cleanup and disposal Materials management 4. Good housekeeping (exp. containers exposed to rain) 5. Basic of water pollution laws 6. Spill reporting requirements 7. Potential activities where spills are likely to occur 8. Proper documentation of scheduled maintenance and reporting 9. Document the personnel training with a signup sheet for all training 7.0 Visual Inspections Revised requirements for visual inspections in compliance with MSP regulations are discussed in this chapter. Three types of inspections are stipulated: 1. Comprehensive annual site compliance evaluation. 2. Quarterly visual inspection of site. 3. Quarterly visual examination of storm water quality. Specifically, the areas involved in the following should be inspected: I. Scrap processing 2. Scrap material unloading and loading 3. Scrap handling 4. Scrap Storage 5. Sediment and erosion BMPS 6. Outdoor vehicle end equipment maintenance 7. Vehicle and equipment refueling 8. Other areas where scrap is generated, stored, received, treated, or disposed of which are exposed to storm water runoff or precipitation. 7.1 Comprehensive Annual Site Compliance Evaluation A member of the pollution prevention team or a qualified professional designated by the team shall conduct an annual site compliance evaluation. All areas within the site shall be visually inspected for evidence of, or the potential for, pollutants entering the storm water drainage system. 2. Measures to reduce pollutant loading shall be evaluated to determine whether they are adequate and properly implemented in accordance with the tenns of the permit or whether additional control measures are needed. 3. Structural stone water management measures, sediment and erosion control measures, structural pollution prevention measures that are identified in the plan, and process -related pollution control equipment shall be observed or tested to ensure that they are operating correctly. 4. A visual inspection of equipment needed to implement the plan, such as spill response equipment, shall be made. Based on the results of the evaluation, any modifications to the plan shall be made within 2 weeks of the evaluation. Implementation of any change shall be complete within 12 weeks of the evaluation. The form used to document this inspection is included in Appendix D. This report shal. be retained as part of the plan at least three years after the date of the evaluation. The report shall identify any incidents of noncompliance. If the report does not identify any incidents of noncompliance, it shall contain a certification that the facility is in compliance with the plan and the permit. 7.2 Quarterly Visual Inspection of Site In addition to the comprehensive annual inspection, quarterly visual inspections should be conducted to determine the status of the ground surfaces. All areas exposed to precipitation shall be visually inspected for evidence of, or the potential for, pollutants entering the storm water drainage system. A form for recording inspection results is contained in Appendix E Documentation of the inspection shall be retained with the SWPPP. 7.3 Quarterly Visual Examination of Storm Water Quality Visual examinations of storm water collected at the outfall shall be conducted at least once in each of the following quarters: January through March, April through May, June through September, and October through December. Procedures are as follows: Examinations should be conducted during daylight hours. 2. A qualified rainfall event for sample collection is 0.1 inch in magnitude that occurs at least 72 hours after the previous rainfall event. 3. Storm water samples shall be collected within the first 30 minute after runoff begins. 4. The examinations shall document observations of color, odor, clarity, floating solids, settled solids, suspended solids, foam, oil sheen, and obvious indications of storm water pollution. The same individual should perform the sample collection and examination for the entire permit teen. A form to document the quarterly visual examination of storm water quality is included in Appendix F. Laboratory analysis of samples is required every year. 8.0 Spill Prevention and Response Procedure A spill prevention and response procedures plan is required to define personnel, procedures and reporting of all spills that might contaminate storm water. The plan must include: A risk assessment of potential sources based on material inventory. 2. Facility personnel responsible for implementing the plan 3. Notice that a responsible person must be on -site at all times during operations that might have a potential for storm water runoff contamination. 4. The Spill Prevention and Countermeasure Control (SPCC) plan should describe the following: A. Areas where spills can occur and their discharge points 1) Equipment repair, fueling, and station 2) Materials transfer points 3) Scrap stockpiles and transfer points 4) Container storage, fuel storage, oil and grease storage B. Reporting procedures, with names and numbers C. The Compliance Evaluation Inspection was conducted by Starr Silvis and Jim Reid of the Asheville Regional Office. The facility was found to be deficient with regard to permit NCG100109. Woodfin Auto and Salvage is covered under General Permit number NCG100000 (NCG10). A copy of NCG10 was delivered to your facility on February 8, 2006 during the inspection. Requirements of NCG10 include development of a Stormwater Pollution Prevention Plan (SPPP). NCG10 details the requirements of the SPPP. Additionally, guidance from Automotive Recyclers Association on preparation of a SPPP was delivered to your facility during the inspection. You must prepare and implement a site specific SPPP in order to be in compliance with your permit. Implementation includes specific monitoring, inspection, maintenance and training of employees as detailed in NCG10. A follow up inspection will be scheduled to review your SPPP and monitoring data. During the inspection three possible stormwater discharge points were identified. The first and most probable discharge point is located adjacent to the entrance of the facility. Runoff from the site appears to run from the site toward the entrance and into a ditch that discharges into the French Broad River. The soil in the ditch is stained with petroleum products. At a minimum stormwater runoff from this discharge point must be monitored as required in NCG10. The other two discharge points are located along the perimeter of the site. Please see attached map for location of potential discharge points. It is your responsibility to identify all discharge points. Analytical monitoring is required to be performed during the first and last year of the permit (2002 and 2007). This facility has not performed any analytical monitoring to date. This Office requires that the facility perform analytical monitoring during the first representative storm event following receipt of this letter. A copy of the Automotive Recyclers Association guidance for SPPP components was given to Ms. Ledford during the inspection. Additionally a copy of the NCG10 permit was also give to Ms. Ledford. The NCG10 permit details requirements for compliance with the permit. To date no sampling has been done for the facility. The inspectors walked the perimeter of the site and identified three possible outfalls. The outfall located at the entrance to the facility appears to convey the majority of the flow. The outfall drains to a ditch that runs approximately 100 yards and then empties into the French Broad River. The ditch contains evidence of soil staining and large flow volumes. This outfal must be sampled during a representative storm event at least the first and last year of the permit cycle. Monitoring and sampling requirements are contained in the NCG10 permit.
