Resources (DEMLR) is forwarding herewith the reissued Certificate of Coverage and
Stormwater/Wastewater General Permit. This permit is reissued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently
amended.) The following information is included with your permit package:

Significant changes to the General Permit are outlined in the Technical Bulletin.
Your coverage under the General Permit is transferable only through the specific action of DEMLR. This
permit does not affect the legal requirements to obtain other permits which may be required by the N.C.
Department of Environmental Quality, nor does it relieve the permittee from responsibility for
compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order,
judgment or decree.

In accordance with your application for a discharge permit received on April 22, 2014,
we are forwarding herewith the subject certificate of coverage to discharge under the subject
state - NPDES general permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
This certificate of coverage is not transferable. If the facility changes ownership or is
closed, the Division of Energy Mineral & Land Resources may require modification, revocation
or reissuance of the certificate of coverage.
Please be aware that mine dewatering at your site has the potential to impact adjacent
wetlands. The specific requirements for mine dewatering at facilities near wetlands can be
found in Part III, Section E of your permit. You must have an approved Operation and
Monitoring Plan before mine dewatering discharges occur at your facility. Discharging
mine dewatering wastewater without Plan approval will be subject to enforcement action. An
Operation and Monitoring Plan for your facility must be submitted to the Wilmington Regional
Office within 60 days of your receipt of this permit. Contact Dan Sams at the Wilmington
Regional Office at [phone] for more information about the approval process.
Please note that mine dewatering wastewater includes wet pit overflows caused
solely by direct rainfall and groundwater seepage for this type of mining operation. Any
discharge of this water (and any stormwater commingled with it) is subject to the effluent
limitations in this permit.

This general permit allows the discharge of stormwater and certain types of
wastewater from your facility. In your application, you specified that only mine dewatering
water would be discharged from this facility. If separate point -source discharges of
stormwater occur (i.e., stormwater not combined with mine dewatering water), you will be
required to adhere to the conditions in this permit for stormwater discharges.
This project is located in one of North Carolina's 20 coastal counties. Coastal
stormwater management rules (15A NCAC 2H .1000) may require an additional State
Stormwater Permit (different from the NPDES mining activities discharge permit). Please
contact Patrick McClain in the Washington Regional Office at [phone] to determine
if you will be required to submit an application for a State Stormwater permit.
Per the requirements of the Neuse Riparian Buffer Rule, all stormwater drainage to
stream buffers, from portions of this site that have been constructed after July 22,1997, must
be discharged through a correctly designed level spreader or another device that meets
diffuse flow requirements per 15A NCAC 2B .0233. Diffuse flow requirements are described
in Chapter 8 of the North Carolina Stormwater BMP Manual, available at:

This permit does not affect the legal obligation to obtain other permits which may be
required by the Division of Energy, Mining, and Land Resources, or any other federal, state, or

You guys should (if you haven't already) received more info on this one from Larry Wade (he is assigned the review).
One thing to note for this one and to coordinate with Robert on is that it is around 1MGD for the dewatering and we
want to make sure that the receiving stream can handle the potential flow without instream concerns. For some with
much larger flows (Vanceboro) we have moved people to individual NPDES W W permits due to the use impact. This
flow may be intermittent so it may not be too much of a problem and I also think it is going to the Neuse River rather
than a small trib. Just something we need to be aware of and make sure we consider.
You and Tankard can call to discuss this if you need to. I've had a few years without having to talk to Robert, so I think I
can handle it if I have to!

Please be aware that mine dewatering at your site has the potential to impact adjacent
wetlands. The specific requirements for mine dewatering at facilities near wetlands can be
found in Part III, Section E of your permit. You must have an approved Operation and
Monitoring Plan before mine dewatering_ discharges occur at your facility. Discharging
mine dewatering wastewater without Plan approval will be subject to enforcement action. An
Operation and Monitoring Plan for your facility must be submitted to the Wilmington Regional

This general permit allows the discharge of stormwater and certain types of
wastewater from your facility. In your application, you specified that only mine dewatering
water would be discharged from this facility. If separate point -source discharges of
stormwater occur (i.e., stormwater not combined with mine dewatering water), you will be
required to adhere to the conditions in this permit for stormwater discharges.
This project is located in one of North Carolina's 20 coastal counties. Coastal
stormwater management rules (15A NCAC 2H .1000) may require an additional State
Stormwater Permit (different from the NPDES mining activities discharge permit). Please

if you will be required to submit an application for a State Stormwater permit.
Per the requirements of the Neuse Riparian Buffer Rule, all stormwater drainage to
stream buffers, from portions of this site that have been constructed after July 22,1997, must
be discharged through a correctly designed level spreader or another device that meets
diffuse flow requirements per 15A NCAC 213.0233. Diffuse flow requirements are described
in Chapter 8 of the North Carolina Stormwater BMP Manual, available at:

You guys should (if you haven't already) received more info on this one from Larry Wade (he is assigned the review).
One thing to note for this one and to coordinate with Robert on is that it is around 1MGD for the dewatering and we
want to make sure that the receiving stream can handle the potential flow without instream concerns. For some with
much larger flows (Vanceboro) we have moved people to individual NPDES WW permits due to the use impact. This
flow may be intermittent so it may not be too much of a problem and I also think it is going to the Neuse River rather
than a small trib. Just something we need to be aware of and make sure we consider.
You and Tankard can call to discuss this if you need to. I've had a few years without having to talk to Robert, so I think I
can handle it if I have to!

I am respectfully submitting an application for an NPDES
discharge permit for a borrow pit in Craven County. I have been in
contact with Thom Edgerton of the Washington Regional office. in
regards to the new operation and discharge permit requirements.
An on -site determination of potential jurisdictional features was -pJL
performed by the Land Management Group which determined that wetlands
are located within the proposed permitted area along the most
southwestern property line. The location of the wetlands and the
proposed buffers are also shown on the enclosed site plan.
iZ Ho":rJ }cs Barnhill Contracting Company proposes to pump water from a rim
X�o^^' ditch into the dewatering basin as shown on the mine map during the
�Zon^'"'initial start of the excavation. This basin has been designed for a bk
0 1,000 gallons per min pump and a detention time of 2 days. Once this
�I�oppO area is mined out, it will then be used for storage of dewatering from
72�'D the next phase of the mining area. Water will be pumped into the
G� basin and pond utilising a 611 submersible pump (Thompson Pump Model
ThP;ca'l� 46NST) at an average rate of approximately 650 gallons per minute.
This pit will be operated for Barnhill Contracting projects only and
will not be run on a continual basis. Use will be determined by
�4S demand for sand for local projects. Because of the nature of this
pis work, withdrawal rates and discharge will vary greatly from month to
month. We intend to dewater only when we are actively mining sand and
}p not on a continuous basis. During times of mining we will typically -)4
g3(a0o0 work 12 hour days and pump during those times. Therefore, any
discharges will be kept to a minimum. We have also applied for a /I
CCPCUA withdrawal permit through division of Water Resources since 6,003
this site is within Craven County.
Erosion control measures will be installed onsite prior to any
land disturbance taking place. Please reference the site plan for a
more detailed depiction of these measures. Any water within the

mining area will be directed to drain towards the pit. There are also
diversion ditches with check dams along both sides of the haul road to
control runoff from this area.
I have contacted Thom Edgerton in the Washington Regional office
prior to submitting this Notice of Intent.' We have discussed the
operation and intent and I will also submit an Operations and
Monitoring Plan to his attention.

Dear Mr. Bennett:
We are submitting an Operations and Monitoring Plan for the Williams Pit in Craven County,
North CarolinaRo:ensure:that'any_dewatering,activities that may occur in correlation with mining
activities sh4ll:nQt:have-any adverse effects:on:any_nearby: jurisdictional wetlands,that may be present on
the propertT Referenceis made to the site plan that accompanies this Operations and Monitoring Plan, _
The type of discharge that will be preseenTon the site will be mine dewatering. Reference is made
to the site plan that illustrates the points of discharge from the mine. Barnhill Contracting Company
proposes to dewater mining operations through the following sequence of events:
I) Erosion Control items will be installed prior to any mining activities on the site. Sediment Basins
and Diversion Ditches will be installed per plan design before mining activities begin in the
mining area.
2)' Mining will begin in on the most southern portion of the mine. Any topsoil in this area will he
stripped and stockpiled as shown. The topsoil within this area will be used to build any slopes
after mining this area. The topsoil stockpile will be seeded as needed to stabilize. We will strip
areas as mining progresses to prevent unnecessary erosion from occurring. Diversion ditches will
be utilized to divert shed water towards the sediment basin.
3) As mining activities extend below the water table, water will be pumped as needed into the borrow
pit dewatering basin. As water is pumped into the basin, it will dewater through a riser and onto a
rip rap outlet pad as shown on the plan. This discharge will then dissipate through the 50'
undisturbed buffer to the on -site wetland.
4) After all mining activities in the initial excavation area are complete, remaining topsoil stockpiled
will be used to build the finished slopes of the pond to a grade of 3:1 or flatter above the water
table, and permanently seeded.
'5) Mining will then begin along the southwester edge of the mine in the same manner. Topsoil will
be stripped as needed and stockpiled as mining progress. As mining activities extend below the

water table in this area, water will be pumped into the previously mined out area. We will use the
newly created pond for storage of pumped water from the new mining area. Pumping will be
shared between the on -site pond and dewatering basin as needed to ensure that discharge is kept to
a minimum, if any at all.
6) After all mining activities are complete, any remaining topsoil stockpiled will be used to build the
slopes of the pond to a grade of 3:1 or flatter above the water table, and permanently seeded.
The proposed operation has been designed so that any overflow from dewatering activities or
extreme rainfall events will take a natural course to the closest wetland. Water will be pumped at a rate.
not to exceed 936,000 gallons per day, as dictated by our CCPCUA withdrawal permit, utilizing a
Thompson 6" submersible pump (model 46HST or comparable). The estimated volume of water
withdrawal from dewatering activities will be recorded Storm water will be managed within the pit
utilizing silt fence, diversion ditches, sediment basins, buffers, and berms when topsoil is available.
Reference is made to the site plan, which illustrates the design specifications and size of the sediment
basin.
There will be an undisturbed buffer established between the mine footprint edges and the
jurisdictional wetland edge. The 50' undisturbed buffer along the edge of the mine limits will be
adequately marked with orange safety fence to ensure that heavy equipment does not enter into this area
and land disturbing activities do not occur.
Barnhill Contracting Company will work to inspect and monitor the jurisdictional features that
appear within the property boundary daily, during times that pumping and discharge are occurring.
Barnhill Contracting Company will inspect and monitor the features to reaffirm the presence of the
jurisdictional feature and soils, as well as, for the instability, erosion, sloughing, subsidence, collapse,
newly formed sinkholes, wetland vegetation degradation, and/or flooding of ditches from discharge
activities. Barnhill Contracting Company does not foresee any impacts to the adjacent features or
wetlands, but will secure the appropriate permit if the need arises.
Together with data collected by NCDENR- Division of Water Quality from their inspections,
Barnhill Contracting Company and NCDENR- Division of Water Quality can determine if there are any
detrimental impacts to the'property's jurisdictional features. During inspections conducted by Barnhill
Contracting Company, if there are any detrimental impacts to the property's wetlands discovered, Barnhill
Contracting Company will immediately cease dewatering activities, and report the discovery to
NCDENR- Division of Water Quality Washington Regional Office. Together, Barnhill Contracting
Company and NCDENR- Division of Water Quality will determine how these impacts can be abated.

We are submitting an Operations and Monitoring Plan for the Williams Pit in Craven County,
North Carolina to ensure that any dewatering activities that may occur in correlation with mining
activities shall not have any adverse effects on any nearby jurisdictional wetlands that may be present on
the property. Reference is made to the site plan that accompanies this Operations and Monitoring Plan,
which illustrates the mining activities as they shall occur on the site.
The type of discharge that will be present on the site will be mine dewatering. Reference is made
to the site plan that illustrates the points of discharge from the mine. Barnhill Contracting Company
proposes to dewater mining operations through the following sequence of events:
1) Erosion Control items will be installed prior to any mining activities on the site. Sediment Basins
and Diversion Ditches will be installed per plan design before mining activities begin in the
mining area.
2) Mining will begin in on the most southern portion of the mine. Any topsoil in this area will be
stripped and stockpiled as shown. The topsoil within this area will be used to build any slopes
after mining this area. The topsoil stockpile will be seeded as needed to stabilize. We will strip
areas as mining progresses to prevent unnecessary erosion from occurring. Diversion ditches will
be utilized to divert shed water towards the sediment basin.
3) As mining activities extend below the water table, water will be pumped as needed into the borrow
pit dewatering basin. As water is pumped into the basin, it will dewater through a riser and onto a
rip rap outlet pad as shown on the plan. This discharge will then dissipate through the 50'
undisturbed buffer to the on -site wetland.
4) After all mining activities in the initial excavation area are complete, remaining topsoil stockpiled
will be used to build the finished slopes of the pond to a grade of 3:1 or flatter above the water
table, and permanently seeded.
5) Mining will then begin along the southwester edge of the mine in the same manner. Topsoil will
be stripped as needed and stockpiled as mining progress. As mining activities extend below the

water table in this area, water will be pumped into the previously mined out area. We will use the
newly created pond for storage of pumped water from the new mining area. Pumping will be
shared between the on -site pond and dewatering basin as needed to ensure that discharge is kept to
a minimum, if any at all.
6) After all mining activities are complete, any remaining topsoil stockpiled will be used to build the
slopes of the pond to a grade of 3:1 or flatter above the water table, and permanently seeded.
The proposed operation has been designed so that any overflow from dewatering activities or
extreme rainfall events will take a natural course to the closest wetland. Water will be pumped at a rate
not to exceed 936,000 gallons per day, as dictated by our CCPCUA withdrawal permit, utilizing a
Thompson 6" submersible pump (model 46HST or comparable). The estimated volume of water
withdrawal from dewatering activities will be recorded. Storm water will be managed within the pit
utilizing silt fence, diversion ditches, sediment basins, buffers, and berms when topsoil is available.
Reference is made to the site plan, which illustrates the design specifications and size of the sediment
basin.
There will be an undisturbed buffer established between the mine footprint edges and the
jurisdictional wetland edge. The 50' undisturbed buffer along the edge of the mine limits will be
adequately marked with orange safety fence to ensure that heavy equipment does not enter into this area
and land disturbing activities do not occur.
Barnhill Contracting Company will work to inspect and monitor thejurisdictional features that
appear within the property boundary daily, during times that pumping and discharge are occurring.
Barnhill Contracting Company will inspect and monitor the features to reaffirm the presence of the
jurisdictional feature and soils, as well as, for the instability, erosion, sloughing, subsidence, collapse,
newly formed sinkholes, wetland vegetation degradation, and/or flooding of ditches from discharge
activities. Barnhill Contracting Company does not foresee any impacts to the adjacent features or
wetlands, but will secure the appropriate permit if the need arises.
Together with data collected by NCDENR- Division of Water Quality from their inspections,
Barnhill Contracting Company and NCDENR- Division of Water Quality can determine if there are any
detrimental impacts to the property's jurisdictional features. During inspections conducted by Barnhill
Contracting Company, if there are any detrimental impacts to the property's wetlands discovered, Barnhill
Contracting Company will immediately cease dewatering activities, and report the discovery to
NCDENR- Division of Water Quality Washington Regional Office. Together, Barnhill Contracting
Company and NCDENR- Division of Water Quality will determine how these impacts can be abated.

I am respectfully submitting an application for a mining
permit in Craven County. The mining permit will comprise
approximately 37.50 acres off of River Road. There will be a
minimum 50' unexcavated buffer between all property lines and
the excavation limits. We are proposing a permitted area of
37.50 acres with an affected area of 32.06,,aores. An onsite
wetland is shown on the mine map and will have a minimum 50'
undisturbed buffer along its boundary_I)LMining will begin in the
area shown as "Initial Start of Excavation Area" on the mine
map. This area will be stripped and the basin will be
installed. Once this area has been -mined we will move across
the Southwestern property line with the next cut. As mining
progresses to this area, we will install another basin to
control any runoff from stripping operations.,Once stripping is
complete, we will install diversion ditches to shed water
towards the basin. As mining continues we will grade the
property to drain towards the pit to divert any runoff from
leaving the site. We will only strip areas as mining progresses
into those areas to limit the amount of land disturbance and
erosion.
There will be a need to dewater the pit and we have -
enclosed our application for a new CCPCUA permit for this,
operation. Please reference this application for specifics
regarding dewatering. We intend to dewater into a dewatering•
basin as shown on the plans. This basin will then overflow -
through the undisturbed buffer and follow a natural courserto
the wetland area. Although we do not intend to discharge water
off -site, we have applied for an NPDES permit which is included

in this submittal as well. We will not dewater on a continual
basis, but only when this pit is in operation.
Please find enclosed one (1) original and five (5) copies
of the Mining Permit Application and Mine Map. All adjoining
landowners and County Manager have been properly notified. We
have also included a copy of our CCPCUA permit application and
supporting documents for your review, and a copy of our NPDES
permit application, along with a check in the amount of
$5,000.00 for the application fee.

2. Mine maps must be accurate and appropriately scaled drawings, aerial photographs or enlarged
topographic maps of the entire mine site. All aspects of the mine site must be clearly labeled on the
maps along with their corresponding (approximate) acreage. As a reminder, mining permits can
only be issued for up to 10 years; thus, all mine and reclamation maps must only denote those
activities that are intended to be conducted during the life of the mining permit. All maps must be
of a scale sufficient (see minimum requirements listed below) to clearly illustrate the following, at a
minimum:
a. Property lines of the tract or tracts of land on which the proposed mining activity is to be located
including easements and rights -of -way.
b. Existing or proposed permit boundaries.
c. Initial and ultimate limits of clearing and grading.
d. Outline and width of all buffer zones (both undisturbed and unexcavated).
e. Outline and acreage of all pits/excavations.
f. Outline and acreage of all stockpile areas.
g. Outline and acreage of all temporary and/or permanent overburden disposal areas.
h. Location and acreage of all processing plants (processing plants may be described as to location and
distance from mine if sufficiently far removed).
i. Locations and names of all streams, rivers and lakes.
j. Outline and acreage of all settling and/or processing wastewater ponds.
k. Location and acreage of all planned and existing access roads and on -site haul roads.
I. Location of planned and existing on -site buildings.
m. Location and dimensions of all proposed sediment and erosion control measures.
n. Location of I00-year floodplain limits and wetland boundaries.

Division of Water Quality, Water Quality Section. In addition, the applicant is required to register water
use with the Division of Water Resources if the operation withdraws more than 10,000 gallons per day
and needs a capacity use permit from the Division of Water Resources if the operation lies in a capacity
use area and withdraws more than 100,000 gallons per day.
WE HAVE APPLIED FOR A CCPCUA PERMIT FOR WATER WITHDRAWALS WHICH IS
INCLUDED WITH THIS APPLICATION. WE HAVE ALSO APPLIED FOR AN NPDES PERMIT,
WHICH IS INCLUDED WITH THIS APPLICATION. ALL WATER FROM PUMPING
OPERATIONS WILL BE PUMPED INTO A DEWATERING BASIN. THE DEWATERING BASIN
WILL HAVE A RIP RAP WEIR THAT WILL OVERFLOW TO THROUGH A NATURAL 50,
BUFFER TO THE ONSITE WETLANDS. PLEASE REFERENCE THE SITE PLAN FOR
LOCATION. ONCE THE MINING AREA LOCATED AT THE EXISTING POND IS COMPLETELY
MINED OUT, THE RESULTING POND WILL BE USED AS STORAGE FROM PUMPING
OPERATIONS FROM THE REMAINAING MINE SITE.

a. A buffer will be required between any mining activity and any mining permit boundary or right-of-
way. It may be an unexcavated buffer (no excavation, but roadways, berms and erosion &
sedimentation control measures may be installed within it), an undisturbed buffer (no disturbance
within the buffer whatsoever), or a combination of the two, depending upon the site conditions. Note
that all buffers must be located within the mining permit boundaries.
How wide a buffer will be maintained between any mining activity and any mining permit boundary
or right-of-way at this site? A minimum buffer of 25 feet is recommended, although a wider buffer
may be needed depending on site conditions. Show all buffer locations and widths on the mine
map(s).
ALL PROPERTY LINE BUFFERS WILL BE A MINIMUM OF 50'. IN AREAS THAT ARE
CURRENTLY WOODED, THE BUFFER AREA WILL NOT BE CLEARED AND ACT AS A
NATURAL BUFFER. PLEASE REFERENCE THE SITE MAP FOR BUFFER DETAILS.
b. A minimum 50 foot wide undisturbed buffer will be required between any land disturbing activities
within the mining permit boundaries and any natural watercourses and wetlands unless smaller
undisturbed buffers can bejustified. Depending on site conditions, a buffer wider than 50 feet may

Provide a cross-section on the mine map(s) for all fill slopes (berms, wastepiles, overburden
disposal areas, etc.), clearly indicating the intended side slope gradient, installation of any benches
and/or slope drains (with supporting design information) ifneeded, and the method of final
.stabilization.
AS NOTED ABOVE, ALL SLOPES WILL BE 3:1 ABOVE THE WATER LEVEL AND 2:1
BELOW THE WATER TABLE.
c. In excavation(s) of unconsolidated (non -rock) materials, specify the angle of all cut slopes including
specifications for benching and sloping. Cross -sections for all cut slopes must be provided on the
mine map(s).
SLOPES WILL BE 3:1 ABOVE THE WATER LEVEL AND 2:1 BELOW THE WATER TABLE.
d. In hardrock excavations, specify proposed bench widths and heights in feet. Provide cross -sections
of the mine excavation clearly noting the angles of the cut slopes, widths of all safety benches and
mine benches, and the expected maximum depth of the excavation.
NO HARDROCK EXCAVATION EXISTS ON THIS SITE.
Describe other methods to be taken during mining to prevent physical hazard to any neighboring dwelling
house, public road, public, commercial or industrial building from any mine excavation. Locate all such
structures on the mine map if they are within 300 feet of any proposed excavation.
NONE ARE LOCATED ON -SITE OR WITHIN 300 FEET OTHER THAN THE EXISTING LAf NDOWER
OF THE MINE SITE, WHICH IS SHOWN ON THE SITE PLAN. NO DWELLINGS, ROADS, OR
BUILDINGS WILL BE AFFECTED BY THIS OPERATION.
8. Describe what kind of barricade will be used to prevent inadvertent public access along any high wall area
and when it will be implemented. Vegetated earthen berms, appropriate fencing and adequate boulder
barriers may be acceptable high wall barricades. A construction detail/cross-section and location of each
type gfbarricade to be used must be indicated on the mine map(s).
THERE WILL BE A LOCKED GATE AT THE ENTRANCE OF THE PIT ON THE HAUL ROAD. NO
HIGHWALL AREAS WILL BE LOCATED ON THIS SITE. A BERM WILL PREVENT ANYONE
FROM ACCESSING THE ACTIVE MINING AREA.

PUBLIC. THIS SITE IS REMOTE ENOUGH THAT ADDITIONAL SCREENING WILL NOT BE
NEEDED.
b. Could the operation have a significantly adverse effect on the purposes of a publicly owned park,
forest or recreation area? If so, how will such effects (i.e., noise, visibility, etc.) be mitigated?
NO, THE POND THAT IS CREATED WILL ONLY CONTRIBUTE TO A PARK OR
RECREATION AREA. THIS SITE IS REMOTE ENOUGH THAT NOISE LEVELS CREATED
BY NORMAL MINING ACTIVITY WILL NOT EFFECT THE SURROUNDINGS.

D. RECLAMATION PLAN
Describe your intended plan for the final reclamation and subsequent use of all affected lands and indicate
the sequence and general methods to be used in reclaiming this land. This must include the method of
reclamation of settling ponds and/or sediment control basins and the method of restoration or establishment
of any permanent drainage channels to a condition minimizing erosion, siltation and other pollution. This
information must be illustrated on a reclamation map and must correspond directly with the information
provided on the mine map(s). In addition, design information, including typical cross -sections, of any
permanent channels to be constructed as part of the reclamation plan and the location(s) of all permanent
channels must be indicated on the reclamation map.
ALL SLOPES WILL BE GRADED, STABLILIZED, AND SEEDED AFTER MINING IS COMPLETE.
ANY DEWATERING BASINS WILL BE REMOVED AND A SELF CONTAINED POND WILL REMAIN
ONSITE. OTHER AREAS WILL BE BACKFILLED WITH UNCONTAMINATED MATERIALS FOR LATER
AGRICULTURAL USE. ALL DISTURBED AREAS WILL BE GRADED TO DRAIN TOWARDS THE PIT.
THE HAUL ROAD WILL REMAIN IN PLACE TO ACCESS THE PROPERTY.
2. Is an excavated or impounded body of water to be left as a part of the reclamation? Yes ® No ❑.

issued by DWM for the site, a copy of said permit must be attached to this application. All
temporary and permanent refuse disposal areas must be clearly delineated on the mine map(s) and
reclamation map, along with a list of items to be disposed in said areas.

F. NOTIFICATION OF ADJOINING LANDOWNERS
The "Notice" form, or a facsimile thereof, attached to this application must be sent certified or registered mail,
return receipt requested, to:
(1) the chief administrative officer of each county and municipality in which any part of the permitted
area is located as indicated on the mine map(s);
(2) all owners of record, both public and private, of all tracts of land that are adjoining the mining
permit boundary; if an adjoining tract is owned or leased by the applicant or is owned by the lessor
of the mine tract, all owners of record of tracts adjoining these tracts must be notified (that are
within 1,000 feet of the mining permit boundary) as indicated on the mine map(s); and
(3) all owners of record, both public and private, of all tracts of land that are adjoining the mining
permit boundary which lie directly across and are contiguous to any highway, creek, stream, river,
or other watercourse, railroad track, or utility or other public right-of-way. If an adjoining tract is
owned or leased by the applicant or is owned by the lessor of the mine tract, all owners of record of
tracts adjoining these tracts must be notified (that are within 1,000 feet of the mining permit
boundary) as indicated on the mine map(s). "Highway" means a road that has four lanes of travel
or less and is not designated as an Interstate Highway.
The only exception to the above method of giving notice is if another means of notice is approved in advance by
the Director, Division of Land Resources.
A copy of a tax map (or other alternative acceptable to the Department) must be mailed with the completed
"Notice" form (the proposed overall permit boundaries and the names and locations of all owners of
record of lands adjoining said boundaries must be clearly denoted on the tax map).
The "Affidavit of Notification" attached to this application must be completed, notarized and submitted to the

Dear Mr. Bennett:
We are submitting an Operations and Monitoring Plan for the Williams Pit in Craven County,
North Carolina to ensure that any dewatering activities that may occur in correlation with mining
activities shall not have any adverse effects on any nearby jurisdictional wetlands that may be present on
the property. Reference is made to the site plan that accompanies this Operations and Monitoring Plan,
which illustrates the mining activities as they shall occur on the site.
The type of discharge that will be present on the site will be mine dewatering. Reference is made
to the site plan that illustrates the points of discharge from the mine. Barnhill Contracting Company
proposes to dewater mining operations through the following sequence of events:
Erosion Control items will be installed prior to any mining activities on the site. Sediment Basins
and Diversion Ditches will be installed per plan design before mining activities begin in the
mining area.
2) Mining will begin in on the most southern portion of the mine. Any topsoil in this area will be
stripped and stockpiled as shown. The topsoil within this area will be used to build any slopes
after mining this area. The topsoil stockpile will be seeded as needed to stabilize. We will strip
areas as mining progresses to prevent unnecessary erosion from occurring. Diversion ditches will
be utilized to divert shed water towards the sediment basin.
3) As mining activities extend below the water table, water will be pumped as needed into the borrow
pit dewatering basin. As water is pumped into the basin, it will dewater through a riser and onto a
rip rap outlet pad as shown on the plan. This discharge will then dissipate through the 50'
undisturbed buffer to the on -site wetland.
4) After all mining activities in the initial excavation area are complete, remaining topsoil stockpiled
will be used to build the finished slopes of the pond to a grade of 3:1 or flatter above the water
table, and permanently seeded.
5) Mining will then begin along the southwester edge of the mine in the same manner. Topsoil will
be stripped as needed and stockpiled as mining progress. As mining activities extend below the

water table in this area, water will be pumped into the previously mined out area. We will use the
newly created pond for storage of pumped water from the new mining area. Pumping will be
shared between the on -site pond and dewatering basin as needed to ensure that discharge is kept to
a minimum, if any at all.
6) After all mining activities are complete, any remaining topsoil stockpiled will be used to build the
slopes of the pond to a grade of 3:1 or flatter above the water table, and permanently seeded.
The proposed operation has been designed so that any overflow from dewatering activities or
extreme rainfall events will take a natural course to the closest wetland. Water will be pumped at a rate
not to exceed 936,000 gallons per day, as dictated by our CCPCUA withdrawal permit, utilizing a
Thompson 6" submersible pump (model 46HST or comparable). The estimated volume of water
withdrawal from dewatering activities will be recorded. Storm water will be managed within the pit
utilizing silt fence, diversion ditches, sediment basins, buffers, and berms when topsoil is available.
Reference is made to the site plan, which illustrates the design specifications and size of the sediment
basin.
There will be an undisturbed buffer established between the mine footprint edges and the
jurisdictional wetland edge. The 50' undisturbed buffer along the edge of the mine limits will be
adequately marked with orange safety fence to ensure that heavy equipment does not enter into this area
and land disturbing activities do not occur.
Barnhill Contracting Company will work to inspect and monitor the jurisdictional features that
appear within the property boundary daily, during times that pumping and discharge are occurring.
Barnhill Contracting Company will inspect and monitor the features to reaffirm the presence of the
jurisdictional feature and soils, as well as, for the instability, erosion, sloughing, subsidence, collapse,
newly formed sinkholes, wetland vegetation degradation, and/or flooding of ditches from discharge
activities. Barnhill Contracting Company does not foresee any impacts to the adjacent features or
wetlands, but will secure the appropriate permit if the need arises.
Together with data collected by NCDENR- Division of Water Quality from their inspections,
Barnhill Contracting Company and NCDENR- Division of Water Quality can determine if there are any
detrimental impacts to the property's jurisdictional features. During inspections conducted by Barnhill
Contracting Company, if there are any detrimental impacts to the property's wetlands discovered, Barnhill
Contracting Company will immediately cease dewatering activities, and report the discovery to
NCDENR- Division of Water Quality Washington Regional Office. Together, Barnhill Contracting
Company and NCDENR- Division of Water Quality will determine how these impacts can be abated.

Dear Mr. Bennett,
I am respectfully submitting an application for an NPDES
discharge permit for a borrow pit in Craven County. I have been in
contact with Thom Edgerton of the Washington Regional office in
regards to the new operation and discharge permit requirements.
An on -site determination of potential jurisdictional features was
performed by the Land Management Group which determined that wetlands
are located within the proposed permitted area along the most
southwestern property line. The location of the wetlands and the
proposed buffers are also shown on the enclosed site plan.
Barnhill Contracting Company proposes to pump water from a rim
ditch into the dewatering basin as shown on the mine map during the
initial start of the excavation. This basin has been designed for a
1,000 gallons per min pump and a detention time of 2 days. Once this
area is mined out, it will then be used for storage of dewatering from
the next phase of the mining area. Water will be pumped into the
basin and pond utilizing a 6" submersible pump (Thompson Pump Model
46HST) at an average rate of approximately 650 gallons per minute.
This pit will be operated for Barnhill Contracting projects only and
will not be run on a continual basis. Use will be determined by
demand for sand for local projects. Because of the nature of this
work, withdrawal rates and discharge will vary greatly from month to
month. We intend to dewater only when we are actively mining sand and
not on a continuous basis. During times of mining we will typically
work 12 hour days and pump during those times. Therefore, any
discharges will be kept to a minimum. We have also applied for a
CCPCUA withdrawal permit through division of Water Resources since
this site is within Craven County.
Erosion control measures will be installed onsite prior to any
land disturbance taking place. Please reference the site plan for a
more detailed depiction of these measures. Any water within the

mining area will be directed to drain towards the pit. There are also
diversion ditches with check dams along both sides of the haul road to
control runoff from this area.
I have contacted Thom Edgerton in the Washington Regional office
prior to submitting this Notice of Intent. We have discussed the
operation and intent and I will also submit an Operations and
Monitoring Plan to his attention.

NPDES Notice of Intent Permit Application and supporting documents.

Dear Mr. Bennett:
We are submitting an Operations and Monitoring Plan for the Williams Pit in Craven County,
North Carolina to ensure that any dewatering activities that may occur in correlation with mining
activities shall not have any adverse effects on any nearby jurisdictional wetlands that may be present on
the property. Reference is made to the site plan that accompanies this Operations and Monitoring Plan,
which illustrates the mining activities as they shall occur on the site.
The type of discharge that will be present on the site will be mine dewatering. Reference is made
to the site plan that illustrates the points of discharge from the mine. Barnhill Contracting Company
proposes to dewater mining operations through the following sequence of events:
1) Erosion Control items will be installed prior to any mining activities on the site. Sediment Basins
and Diversion Ditches will be installed per plan design before mining activities begin in the
mining area.
2) Mining will begin in on the most southern portion of the mine. Any topsoil in this area will be
stripped and stockpiled as shown. The topsoil within this area will be used to build any slopes
after mining this area. The topsoil stockpile will be seeded as needed to stabilize. We will strip
areas as mining progresses to prevent unnecessary erosion from occurring. Diversion ditches will
be utilized to divert shed water towards the sediment basin.
3) As mining activities extend below the water table, water will be pumped as needed into the borrow
pit dewatering basin. As water is pumped into the basin, it will dewater through a riser and onto a
rip rap outlet pad as shown on the plan. This discharge will then dissipate through the 50'
undisturbed buffer to the on -site wetland.
4) After all mining activities in the initial excavation area are complete, remaining topsoil stockpiled
will be used to build the finished slopes of the pond to a grade of 3:1 or flatter above the water
table, and permanently seeded.
5) Mining will then begin along the southwester edge of the mine in the same manner. Topsoil will
be stripped as needed and stockpiled as mining progress. As mining activities extend below the

water table in this area, water will be pumped into the previously mined out area. We will use the
newly created pond for storage of pumped water from the new mining area. Pumping will be
shared between the on -site pond and dewatering basin as needed to ensure that discharge is kept to
a minimum, if any at all.
6) After all mining activities are complete, any remaining topsoil stockpiled will be used to build the
slopes of the pond to a grade of 3:1 or flatter above the water table, and permanently seeded.
The proposed operation has been designed so that any overflow from dewatering activities or
extreme rainfall events will take a natural course to the closest wetland. Water will be pumped at a rate
not to exceed 936,000 gallons per day, as dictated by our CCPCUA withdrawal permit, utilizing a
Thompson 6" submersible pump (model 46HST or comparable). The estimated volume of water
withdrawal from dewatering activities will be recorded. Stone water will be managed within the pit
utilizing silt fence, diversion ditches, sediment basins, buffers, and berms when topsoil is available.
Reference is made to the site plan, which illustrates the design specifications and size of the sediment
basin.
There will be an undisturbed buffer established between the mine footprint edges and the
jurisdictional wetland edge. The 50' undisturbed buffer along the edge of the mine limits will be
adequately marked with orange safety fence to ensure that heavy equipment does not enter into this area
and land disturbing activities do not occur.
Barnhill Contracting Company will work to inspect and monitor the jurisdictional features that
appear within the property boundary daily, during times that pumping and discharge are occurring.
Barnhill Contracting Company will inspect and monitor the features to reaffirm the presence of the
jurisdictional feature and soils, as well as, for the instability, erosion, sloughing, subsidence, collapse,
newly formed sinkholes, wetland vegetation degradation, and/or flooding of ditches from discharge
activities. Barnhill Contracting Company does not foresee any impacts to the adjacent features or
wetlands, but will secure the appropriate permit if the need arises.
Together with data collected by NCDENR- Division of Water Quality from their inspections,
Barnhill Contracting Company and NCDENR- Division of Water Quality can determine if there are any
detrimental impacts to the property's jurisdictional features. During inspections conducted by Barnhill
Contracting Company, if there are any detrimental impacts to the property's wetlands discovered, Barnhill
Contracting Company will immediately cease dewatering activities, and report the discovery to
NCDENR- Division of Water Quality Washington Regional Office. Together, Barnhill Contracting
Company and NCDENR- Division of Water Quality will determine how these impacts can be abated.
