The mining permit states that water will be contained within the mine. The first letter had stated a single stormwater discharge was leaving the property form the farm pond, but this was in error. The farm pond will remain as a farm pond and will not capture any sediment -runoff from the mine. The pond's outlet and spillway were improved for better hydraulics, maintenance, and to serve as a future waterfowl impoundment. There are discharges to a blue -line stream from swales that will be constructed along the haul road. Stone filter check dams will filter stormwater runoff before discharging into the blue line stream 50' buffer. The haul road crosses the blue -line stream where the existing farm road is currently located. The mine will be dewatered, if necessary, and used for irrigation (approx. 250 gal/min pump) on the crop fields. The mine will not be dewatered when irrigation is not needed. The dewatering or irrigation will not discharge directly into adjacent wetlands and streams. The mining permit is currently in review with the Division of Land Quality. The angle for graded slopes and fills shall be no greater than the angle, which can be . retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause off -site damage because of siltation, shall be planted or otherwise provided with ground cover, devices or structures sufficient to restrain such erosion. 7. The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. 8. Existing vegetation or vegetated earthen berms shall be maintained between the mine and public thoroughfares whenever practical to screen the operation from the public. 9. A. Sufficient buffer shall be maintained between any excavation and any mining permit boundary to protect adjacent property. B. Buffers shall be maintained as indicated on the mine map updated on April 28, 2008. 10. A. No on -site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Waste Management and the Land Quality Section, Department of Environment and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Waste Management. No petroleum products, acids, solvents or their storage containers or any other material that may be considered hazardous shall be disposed of within the permitted area. C. For the purposes of this permit, the Division of Land Resources considers the following materials to be "mining refuse" (in addition to those specifically listed under G.S. 74-49 (14) of the N.C. Vendemia: Dee Freeman Secretary The Division of Water Quality's Stormwater Permitting Unit received a National Pollutant Discharge Elimination System (NPDES) permit application for the River Road Mine on September 21, 2009. The application indicated an associated application for a mining permit was submitted to the Division of Land Resources (DLR). Please be aware that the issuance of an NPDES pemiit is contingent upon the issuance of an associated mining permit from DLR. Our office will process your stormwater permit application once a DLR mining permit has been issued for your project. A copy of the mining plans :with all wetlands clearly delineated was not included with the application. I talked with Branch Smith of GS3 and he said he would provide the plans as well as the Sediment and Erosion Control Calculations. Please also be aware that if your project is located near wetlands, your NPDES permit will require dewatering operations without wetland impacts. The specific requirements for mine dewatering at facilities near wetlands can be found in the text of the general NPDES mining permit number NCG 020000 available on our website, http://h2o.enr.state.uc.us/su/Forms_ Documents.litm. See Section C, Part I of the permit on the page labeled, "fart III Page 5 of 9". An approved Operation and Monitoring Plan is required for NPDES-permitted mining facilities. Discharging mine dewatering wastewater without Plan approval will be subject to enforcement -action. A Plan for your facility must be submitted to the Washington Regional Office within 60 days of your receipt of an NPDES permit. We encourage you to contact Thom Edgerton at the Washington Regional Office at (252) 946-6481 to address any wetland concerns for your facility in order to ensure a successful NPDES application review. I checked at this mine finally has its DLR Permit. 1 have attached the N01 and maps sent in for this mine, River Road Mine in Greenville (Pitt County). The site discharges stormwater into the Tar River (WS-IV; NSW). The only Stormwater should be swales along the haul roads. Does the Washington Regional Office have any concerns about issuing this facility a COC for this general permit, and are there any potential impacts to wetlands? If we don't receive any objections, we'll issue the COC in 30 days. Instead, we intend to proceed with our original plan to mine the sand 'wet'. This is a common practice in sand mines, where the operator excavates down to a point just above the existing water table, then steps the trackhoe down to this level to excavate as deep as the excavator can reach, For this particular mine, Mr. Vendemia should be able to excavate down as far as 25 feet below existing ground. No dewatering will be performed within the mine excavation area. In the future, Mr. Vendemia can reclaim a pond section of the excavation area, have it inspected by the DENR, and get it released from the mining permit and returned to agricultural use. At this point, the farm owner will be able to use the pond for any agricultural purposes allowed, including irrigation. Please let me know if you have any questions. Joey W. The regional office approves the 0&M plan. You will need to contact Thom Edgerton in the Washington Office about what they will require. The 0&M are required for mine dewatering activities that have the potential to drain wetlands. Here is an outline of what is required. 0&M Plan must include groundwater monitoring strategies to demonstrate the effect of pumping and, as necessary, establish the pumping regime necessary to reduce impacts. The 0&M plan must include detailed plans to maintain the surrounding hydrology and the respective monitoring to demonstrate compliance. In order to complete the plan you will need to determine the amount of wastewater expected to be discharged daily as a result of the dewatering and determine the cone of influence from the dewatering. The site must be delineated and existing as well as seasonal wetland hydrology determined. The 0&M plan must have a wetland monitoring plan that includes a Map of landscape positions, well information, physical monitoring for the wetlands areas, settling ponds for sediment prior to dewatering, and explanation of how the dewatering will be conducted. The site is bordered by the Tar River Creek to the south. SOILS According to the Web Soil Survey, the main soils are Lakeland sand and Chipley sand. Other soils consist of Portsmouth, Tuckerman, Altavista, and Ocilla loams (occasionally wet soils). Lakeland has hydrologic soil group type A and Chipley has hydrologic soil group type B. The main soils were used to determine the SCS Runoff Curve Number. FARM POND DESIGN NARRATIVE The Tar River mine has an existing farm pond that will remain as is and no proposed mining will affect the drainage to the pond. The pond will have a normal pool with a riser -barrel outlet device. This detail can be found on the mine drawings. The pond was routed for the 10-yr, 25-yr, and 100-yr design storms, which can be found in the attached routing spreadsheets. The 100-yr storm was analyzed for dam overtopping, although the 100-yr storm on the dam will be outlet controlled due to the Tar River floodplain. A rip -rap apron was sized per the Surface Mining Manual and is shown on the mine drawings.
