Division of Water Quality APR 16 2008 Subject: General Permit No. NCG020000 Canady Mine COC NCG020724 Beaufort County Dear Mr. Singleton: In accordance with your application for a discharge permit received on October 24, 2007, we are forwarding herewith the subject certificate of coverage to discharge under the subject state — NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This general permit allows the discharge of stormwater and certain types of wastewater from mining facilities. The Washington Regional Office granted approval to issue this certificate of coverage (COC) on the condition that no mine dewatering will occur at this site. Therefore, only authorization to discharge (1) stormwater and (2) pit overflows caused solely by direct rainfall and groundwater seepage (which are subject to Monitoring Requirements for Wastewater from Sand and/or Gravel mining) is reflected on the certificate of coverage (COC). Discharging mine dewatering wastewater without permit coverage will be subject to enforcement action. Should it be necessary to pump water out of the mining pit(s) in the future, you must apply for a modification to your COC to allow mine dewatering. Please also be aware that mine dewatering has the potential to impact adjacent wetlands at this site. The specific requirements for mine dewatering at facilities near wetlands can be found in Section C, Part 1 of the permit (Part III Page 5 of 9) and include an approved Operation and Monitoring Plan prior to discharge. Please note that wastewater includes wet pit overflows caused solely by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of this water (and any stormwater commingled with it) is subject to the sampling requirements of Part 1I1, Section C. 2 and effluent limitations in this permit. Georgoulias B.E. Singleton & Son - Canady Mine rev. 3/31/08 Summary This facility submitted a Notice of Intent to be covered under General Permit NCG020000 (Mineral & Mining Industry). The stormwater and mine dewatering discharge drains to Broad Creek (C-NSW), in the Tar -Pamlico River Basin. This facility is located in Beaufort County, handled by the Washington Regional Office. Application review a) The permit application has been signed and sufficiently completed. Yes. b) The SIC code accurately describes this facility's activities and is covered by this general permit. SIC 1442 (Construction Sand & Gravel). Note — overflows from pits caused solely by rain events are still considered [mine dewateringl wastewater discharges for this industry. However, no discharges from pumping to dewater will be allowed, per WaRO. Consider how to specify on COC. c) Does the facility propose a new or expanding wastewater• discharge to ORW waters (not allowed), or waters upstream of ORW (special limits may apply)? No. d) Does the facility propose a new or expanding wastewater discharge to an area with threatened or endangered aquatic species? No (just Red Wolf). e) DEH or Shellfish Sanitation Approval Required? NIA f) Does this facility have other permits? Applied for Mining Permit #07-55 from DLR. Issued March 17, 2008. g) Hazardous Waste Activities? No. h) DLR Mining Permit status: Issued 3/17/08. i) Reg. Office input requested: 12/20/07 & 3/28/08 (WaRO contact Jeff A. Manning), RO Approval received: 3/31/2008, contingent on no dewatering. Does discharge have potential to impact wetlands? Likely if deivaterl.ng. Howeuer, Region granted approval for permit issuance without derua.tering after rrr.eeti.ng with applicant. Explained that dewatering would violate perrni.t. j) Is an ATC Required (NCG02 or NCG14)? No. k) Erosion/Sedimentation Plan Approval for NCG14 or NCG02 ATC? NIA 1) Application approved? Yes. NCG020724 December 20, 2007 B. Georgoulias m) In Mecklenburg or Wake County (If so, copy final COC there)? No. n) Special Notes: a. From map, mine property contains and is contiguous to wetlands. O&M Plan will be required. b. Mine lies very close to the1.0 mile mark above SR1325 where Broad Creek's classification changes from C-NSW to SB-NSW. If tracked along the stream segment, discharge appears to be above this point (i.e., before transition to salt waters). Phone togs 3/31/08: Message from Jeff A. Manning at the WaRO. Met with applicant and will recommend we move forward with COC; however, active dewatering should not be included (no O&M Plan). Re: NOI from B.E. Singleton Subject: Re: NOI from B.I. Singleton From: Jeff Manning <JeffA.Manning a ncmail.net> Date: Wed, 02 Jan 2008 08:28:14 -0500 To: Bethany Georgoulias <Bethany.Georgoulias a?ncmail.net> Bethany: I would definitely require them to have a wetlands delineation for this one. I think they will find wetlands are present and that should be dealt with in their 0&M plan. I hope you had a very Merry Christmas and a Most Happy New Year. Jeffery Hi Jeff, We've received an NOI from B.E. Singleton and Sons, Inc. for Canady Mine there in Washington for coverage under Mining Permit NCG02. They'll be mining construction sand, filldirt and topsoil. They've applied for a Mining Permit (MP 07-55), but it hasn't yet been issued. They'll discharge mine dewatering and stormwater to Broad Creek, near where the classification changes from Class C-NSW to saltwaters (SB-NSW). From what I can tell on the map, the mine is above that transition, so I'm calling it C-NSW. A copy of the NOI is attached. You can see from the topo map they submitted that the mine property appears to include wetlands. (In fact, I wonder if a 401/404 is required ... not sure if it's triggered or not.) I'm pretty certain they'll need an 0&M Plan, so I sent an acknowledgement letter letting them know about that requirement (copy attached); they may get in touch with you (Al) about that. The NOI also says something about sheet flow, but it also refers to a settling pond and ditches, so I don't think there's a question here about whether it's a point source. Does the Washington Regional Office have any concerns about issuing this fac-lily a COC for this general permit? Normally if we don't receive any objections, we'll issue the COC in 30 days, but I usually hold mining permits until we hear from the RO (we have to hold until they get the Mining Permit anyway). By the way, Sarah Young is sending copies of the Travel Authorization to you and Ed Warren. Thanks, and have a wonderful Christmas! i of 1 3/28/2008 2:33 PM Re: Canady Mine COC and letter - preview Subject: Re: Canady Mine COC and letter - preview From: Jeff Manning <Jeff.A.Manning@ncmai1.net> Date: Tue, 01 Apr 2008 15:50:36 -0400 To: Bethany Georgoulias<Bethany.Georgoulias@ncmail.net> I hope it will work. I was there when Al talked to him and he DEFINITELY knows he cannot dewater. Jeffery Bethany Georgoulias wrote: I Jeff, Since the WaRO gave the go-ahead to issue this COC without mine dewatering, I started to write it for stormwater only. Then I realized another nuance of the mining permit and regs (which make our lives oh so simple, as we know): overflows from pits at construction sand mines that happen just from rainfall (not pumped) are technically also considered 'mine dewatering' (i.e., wastewater). That's in 40 CFR 436. I tried to be accurate here and wrote the COC to allow stormwater discharge and pit overflows only from rainfall or groundwater seepage (the way the federal regs put it). Instead of making it confusing by saying that's "mine dewatering," (the federal regs include overflows in that definition for construction sand/gravel), I just point out that the overflows are subject to the wastewater monitoring and limits for sand/gravel (which are the same as dewatering). I don't think this COC could be interpreted to allow pumping out of water from the mine, but let me know if WaRO has concerns about it. I'm also attaching the draft cover letter. It's very confusing, but I was worried about excluding all wastewaters from the authorization if they're supposed to comply with limits even in overflow situations. Complicated, isn't it?!?! I'll send it Bradley's way to issue by Friday if you're okay with it.
