In accordance with your request, Certificate of Coverage Number NCG020517 is rescinded effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without valid coverage under an NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential need for NPDES permit coverage. WE are in the process of preparing the proper paper work to subnut an "Ownership Transfer Norm" to transfer the permit to the current owners of the property. The "ditch system" that was discharging stor.mwater from the mine pit was not created by the property owners but ct-eated by people that had trespassed on the property and had been four wheeling and riding motorcycles on the property. A low spot had formed at the discharge location and the continual four wheeling and rutting of tires created the "ditch" allowing water to leave the site. This low spot has been filled and .eater is not being allowcd to leave the site at this time. I regard to the violations that are mentioned. The mine has been closed for over a N=car. The paper work notifying the Division within 90 days of the permitted facility being sold was inadvertently not submitted. One party thought the other party had submitted the paper work. Since the mine has been closed, monitoring reports were not kept and the water leaving the site was not known. This has since been corrected once we found out water was leaving the site. The inspection was conducted to determine whether the facility is in compliance with the conditions required by the certificate of coverage (NCG020517) issued pursuant to NPDES General Stormwater Pert -nit NCG020000. Stormwater and/or wastewater discharges from this mine site drain to Turkey Creek in the Cape Fear River Basin. Turkey Creek is classified SA, ORW waters of the State. During a phone conversation with Division Representative, Linda Willis, on June 1, 2010, you indicated that you had sold the property where this mine pit is located. The certificate of coverage issued pursuant to this General Permit is not transferable to any person except after notice to and approval by the Director. The permittee is required to notify the division within 90 days in the event the permitted facility is sold or closed. A record review indicates the Division has not received any request for transfer of the permit. For your convenience, a copy of the ownership transfer form is included with this correspondence. Until this permit is transferred properly you remain the permittee for the certificate of coverage (NCG020517) under the NPDES General Permit NCG020000, and are responsible for compliance with the permit conditions. The mine pit is being dewatered through the use of a ditch system that discharges a combination of stormwater and wastewater from the mine pit at the east side of the pit. The discharge is of extremely poor quality. A sample of the discharge was collected and sent to the State laboratory for total suspended solids analyses. A portion of the sample was tested for turbidity in the regional office. Turbidity was measured to be 405 Nephelometric Turbidity Units (NTU). The stream standard for water classified SA is 25 NTU. You are hereby instructed to discontinue the discharge from this mine site immediately until the quality of the discharge can be addressed through appropriate best management practices (BMPs). The permit was transferred without notification to the Division or appropriate transfer of ownership.
