Morris, Director MAC 1 2003 NO QITY SECTION Lgt�Ab._ W .SHINk-P j MAR 17 2R03 We visited the Malco Mine on March 10, 2003 and met with Mr. Robert Stewart (Performance Engineering) and Mr. Gary Thompson (TR Equipment Company). There have been concerns expressed by adjacent property owners about the operation of the mine affecting their water quantity and water quality in their private wells. We made a thorough physical survey of the mine locale and of neighboring properties. We also had conversations with two adjacent property owners. Summarized below are our comments and conclusions. 1. Water quality issues seem to stem from poorly designed wells and lack of water filtration/purification systems. Iron staining and sediment in the well water attest to the poor quality of the water in the aquifer and/or improper well construction. A filtration device connected to home plumbing would remedy this. The mine has no impact on this issue. No well heads are visible above land surface. These homeowner wells are probably in violation of the NC Well Construction Standards. 2. Water quantity issues were discussed with the homeowners. Nothing homeowners spoke of suggested that they lack well water. Our calculations indicate dewatering of the mine (to the permitted 25 feet) over the course of a week would affect water levels less than an inch, 400 feet from the edge of the pit (neighboring wells are over 500 feet from the pit now). 3. There seems to be a noise concern for some homeowners. The main culprit is the pump that is used to dewater the pit. This equipment does not operate constantly. Neighbors complained that some trees were dying because of low water levels stemming from the mining activity. Last year, 2002, was an extremely dry year. Drought issues affected the majority of North Carolina. It is more likelythat the drought played a role in trees dyinal. There are many trees that are closer to the mine that seem unaffected. The concerns expressed by adjacent property owners have no relation'to the mining activities other than the noise issue. We defer to the Division of Land Resources on that matter. This modification includes increasing the maximum depth of the mine from 25 feet to 50 feet with the stipulation that dewatering activities shall remain limited to 25 feet below the natural ground surface (with wet mining being allowed from 25 feet to 50 feet). A copy of the modified permit is enclosed. The conditions in the modified permit were based primarily upon the initial application. Modifications were made as indicated by modification request and as required to insure compliance with The Mining Act of 1971. The expiration date, mine name and permit number shall remain the same as before the modification. G.S. 74-65 states that the issuance of a mining permit does not supersede or otherwise affect or prevent the enforcement of any zoning regulation or ordinance duly adopted by an incorporated city or county or by any agency or department of the State of North Carolina. R. Equipment Company, Inc. Malco Mine Currituck County - Permit No. 27-39 for the operation of a Sand Mine which shall provide that the usefulness, productivity and scenic values of all lands and waters affected by this mining operation will receive the greatest practical degree of protection and restoration. MINING PERMIT EXPIRATION DATE: Se tember 27 2004 Page 2 In accordance with the application for this mining permit, which is hereby approved by the Department of Environment and Natural Resources, hereinafter referred to as the Department, and in conformity with the approved Reclamation Plan attached to and incorporated as part of this permit, provisions must be made for the protection of the surrounding environment and for reclamation of the land and water affected by the permitted mining operation. This permit is expressly conditioned upon compliance with all the requirements of the approved Reclamation Plan. However, completed performance of the approved Reclamation Plan is a separable obligation, secured by the bond or other security on file with the Department, and may survive the expiration, revocation or suspension of this permit. This permit is not transferable by the permittee with the following exception: If another operator succeeds to the interest of the permittee in the permitted mining operation, by virtue of a sale, lease, assignment or otherwise, the Department may release the permittee from the duties imposed upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the successor operator, provided that both operators have complied with the requirements of the Mining Act and that the successor operator agrees to assume the duties of the permittee with reference to reclamation of the affected land and posts a suitable bond or other security. In the event that the Department determines that the permittee or permittee's successor is not complying with the Reclamation Plan or other terms and conditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act, the Department may give the operator written notice of its intent to modify, revoke or suspend the permit, or its intent, to modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a hearing at a designated time and place on any -proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Definitions Wherever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49. Modifications November 12, 1996: This permit has been modified to allow dewatering and to increase the mining depth to 25 feet as indicated on the Malco Mine Dewatering Plan dated August 16, 1996. January 22, 1998: This permit has been modified to increase the permitted and affected acreage to 4.15 acres as indicated on the mine map received by the Land Quality Section on December 11, 1997. March 15. 2002: This permit has been modified to increase the permitted acreage to 7.02 acres and the affected acreage to 6.43 acres as indicated on the Mine Map last revised March 6, 2002. This modification includes increasing the maximum depth of the mine from 25 feet to 50 feet with the stipulation that dewatering activities shall remain limited to 25 feet below the natural ground surface (with wet mining being allowed from 25 feet to 50 feet). Expiration Date This permit shall be effective from the date of its issuance until September 27, 2004. Page 3 Conditions This permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et, seq., and to the following conditions and limitations: OPERATING CONDITIONS: 1. A. Any wastewater processing or mine dewatering shall be in accordance with the permitting requirements and rules promulgated by the N.C. Environmental Management Commission. B. No mine dewatering activities shall commence at this site until the Operation and Monitoring Plan has been approved by the Division of Water Quality, Water Quality Section, and said Plan has been properly implemented as required. C. Any stormwater runoff from the affected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Protection Agency and enforced by the N.C. Environmental Management Commission. It shall be the permittee's responsibility to contact the Stormwater Section, Division of Water Quality, to secure any necessary- stormwater permits or other approval documents. 2. A. Any mining process producing air contamination emissions shall be subject to the permitting requirements and rules promulgated by the N.C. Environmental Management Commission and enforced by the Division of Air Quality, B. During mining operations, water trucks or other means that may be necessary shall be utilized to prevent dust from leaving the permitted area. 3. A. Sufficient buffer shall be maintained between any affected land and any adjoining waterway or wetland to prevent sedimentation of that waterway or wetland from erosion of the affected land and to preserve the integrity of the natural watercourse or wetland. B. Buffer zones shall be maintained as indicated on the mine map last revised March 6, 2002, C. Any mining activity affecting waters of the State, waters of the U. S., or wetlands shall be in accordance with the requirements and regulations promulgated and enforced by the N. C. Environmental Management Commission. 4. A. Adequate mechanical barriers including but not limited to diversions, earthen dikes, silt check dams, silt retarding structures, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake, wetland or natural watercourse in proximity to the affected land. B. All drainage from the affected area around the mine excavation shall be diverted internal to said excavation. C. The final slopes of the mine excavation shall be excavated to a three horizontal to one vertical of flatter slope. Page 4 D. Mining shall be limited to. a maximum depth of 50 feet below the surrounding natural ground surface with the following stipulations: 1} Dewatering activities shall be limited to 25 feet below the surrounding natural ground surface (with wet mining being allowed from 25 feet to 50 feet); and 2) Monitoring wells shall be installed and monitored at the site as deemed appropriate by the Department. E. All mining activities, including the construction and maintenance of the dewatering discharge basin, shall be conducted as indicated on the mine map last revised March 6, 2002 and any related approvals issued by the Division of Water Quality, Water Quality Section, for the protection of adjacent wetlands. F. A minimum 15 foot wide stabilized access area shall be provided along the length of the upstream side of the dewatering discharge basin in order to allow proper maintenance of said basin. 5. All mining permit boundaries (7.02 acres) shall be permanently marked at the site on 100 foot intervals unless the line of sight allows for larger spacing intervals. 6. The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause off -site damage because of siltation, shall be planted or otherwise provided with ground cover, devices or structures sufficient to restrain such erosion. 7. The affected land shall be graded so as to'prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. 8. Existing vegetation or vegetated earthen berms shall be maintained between the mine and public thoroughfares whenever practical to screen the operation from the public. 9. A. Sufficient buffer shall be maintained between any excavation and any mining permit boundary to protect adjacent property. B. Buffers shall be maintained as indicated on the mine map last revised March 6, 2002. 10. A. No on -site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct'said disposal has first been obtained from both the Division of Waste Management and the Land Quality Section, Department of Environment and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Waste Management. No petroleum products, acids, solvents or their storage containers or any other material that may be considered hazardous shall be disposed of within the permitted area. Page 5 C. For the purposes of this permit, the Division of Land Resources considers the following materials to be "mining refuse" (in addition to those specifically listed under G.S. 74-49 (14) of the N.C. Mining Act of 1971): 1) on -site generated land clearing debris 2) conveyor belts 3) wire cables 4) v-belts 5) steel reinforced air hoses 6) drill steel D. If mining refuse is to be permanently disposed within the mining permit boundary, the following information must be provided to and approved by the Division of Land Resources prior to commencement of such disposal. 1. the approximate boundaries and size of the refuse disposal area; 2. a list of refuse items to be disposed; 3. verification that a minimum of 4 feet of cover will be provided over the refuse; 4. verification that the refuse will be disposed at least 4 feet above the seasonally high water table; and 5. verification that a permanent vegetative groundcover will be established. 11. An Annual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. 12. The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for a mining permit or any approved revision to it. Approval to implement such changes must be obtained from the Department prior to on -site implementation of the revisions. 13. The security which was posted pursuant to N.C.G.S. 74-54 in the form of a $3,900.00 surety bond is sufficient to cover the operation as indicated in the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 14. A. Authorized representatives of the Division of Archives and History shall be granted access to the site to determine the presence of significant archaeological resources. B. Pursuant to N. C. G. S. 70 Article 3, "The Unmarked Human Burial and Human ,Skeletal Remains Protection Act," should the operator or any person in his employ encounter human skeletal remains, immediate notification shall be provided to the county medical examiner and the chief archaeologist, North Carolina Division of Archives and History. Page 6 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provided By G.S. 74-53 The final slopes in all excavations in soil, sand, gravel and other unconsolidated materials shall be at such an angle as to minimize the possibility of slides and be consistent with the future use of the land. 2. Provisions -for safety to persons and to adjoining property must be provided in all excavations in rock. 3. All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the land. 4. No small pools of water shall be allowed'to'collect or remain on the mined area that are, or are likely to become noxious, odious or foul. 5. The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the North Carolina Agricultural Experiment Station and the North Carolina Forest Service. 6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be conducted according to the time schedule included in the plan, which shall to the extent feasible provide reclamation simultaneous with mining operations and in any event, provide reclamation at the earliest practicable time after completion or termination of mining on any segment of the permit area and shall be completed within two years after completion or termination of mining. RECLAMATION CONDITIONS: 1. Provided further, and subject to the Reclamation schedule, the planned reclamation shall be to restore the mine excavation to a lake area and to grade and revegetate the adjacent disturbed areas. 2. The specifications for surface gradient restoration to a surface suitable for the planned future use are as follows: A. The lake area shall be excavated to maintain a minimum water depth of four feet measured from the low water table elevation. B. The side slopes to the lake excavation shall be graded to a 3 horizontal to 1 vertical or flatter to the water line and 2 horizontal to 1 vertical or flatter below the water line. C. Any areas used for wastepiles, screening, stockpiling or other processing shall be leveled and smoothed. 3. Page 7 D. No contaminants shall be permanently disposed of at the mine site. On -site disposal of waste shall be in accordance with Operating Condition Nos. 11.A. through D. E. The affected land shall be graded to prevent the collection of noxious or foul water. Revegetation Plan: After site preparation, all disturbed land areas shall be revegetated as per the following: Permanent Seeding Specifications Dates Species Rate. In addition, the permittee shall consult with a professional wildlife biologist with the N.C. Wildlife Resources Commission to enhance post -project wildlife habitat at the site. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining of any mine segment under permit. The old mine is approximately four acres and has been mined to twenty-five feet in depth. They proposed to dewater to fifty feet and have agreed to back off of that depth to protect wetlands. They now proposed to dewater to the present twenty-five feet and wet mine to fifty feet. While doing this, they will dewater into a sediment basin located up gradient of the wetland and let the water sheet flow over four weirs into the wetland. After discussing with Deborah Sawyer and Richard Feed, we feel that this will protect the wetlands in question. This office recommends that the Pump and Monitoring Plan be approved as is. Dear Mr. Davis, I am writing to request a modification to my currently existing mine permit No. 27-39. The modification requested consists of a 2.43 acre expansion of the mine -and authorization to deepen the mine from the currently permitted 25' to a new depth of 50'. Enclosed, you will find the application package associated with the modification request. The letter of transmittal enumerates the constituents of the submittal package. The requirement for a mine map has been satisfied by the inclusion of two separate plats. One is a survey prepared by Stroud Engineering, PA which provides an overall view of the mine and surrounding areas. This map illustrates the relationship of the haul road/access easement to the mine and to SR 1101 (Griggs Acres Road). It. is also the map which has been used previously for the original mine application as well as two previous modification -requests. Therefore; I felt -it would be helpful to include this with the - application package. -Secondly, a plat has been prepared by Performance Engineering which provides a V equals 50' scale mine map. This mine map illustrates the existing condition of the mine with respect. to actively mined areas, the extent of open water and the side slopes which have been graded and seeded in their final configuration. The mine -map also illustrates the extent of the requested expansion. Details have been provided for erosion control measures and the dewatering facility. Hopefully, by providing both of these maps you and other review individuals can obtain a very clear understanding of what is existing and what is being proposed. The requirements for-USGS Quad Sheets, County tax maps and NCDOT County highway maps have beer. -a ,sed by...providing excerpts :,f the aforerrientioned three items. As Mr. Bob Stewart of Performance Engineering discussed with you by telephone, we felt that the information contained on the excerpts is sufficient and providing the entire maps would be cumbersome and of no added value. With respect to how this modification request will not invoke any of the seven denial criteria as set forth in G.S. 74-51 of the Mining Act of 1971, I submit the following: Page 2 of 2, letter to Mr. Tracy E. Davis, dated 11/3/01, re: Malco Mine. 1. To my knowledge, nothing in the proposed modification will violate any rule promulgated under the act. 2. I have no reason to believe that any adverse impacts to potable ground water supplies, wildlife, freshwater, estuaries or marine fisheries will result from the proposed modification_ The operation entails only dewatering freshwater into a existing wetlands slew with approximately 1,000' available for filtration between the dewatering discharge point and the open waters of the Albemarle Sound, 3. Regarding air quality, surface water quality and groundwater quality, again the nature of the operation is such that there are no anticipated compromising of any of the concerns fisted above. The haul road is consistently wetted to minimize dust from the trucks entering and leaving the mine area. No pollutants or sedimentation results from the operation of this sand mine. Mr. Stewart has been in touch with Mr. Nat Wilson, PG of the Division of Water Resources. He has provided Mr. Wilson with technical information regarding the dewatering pump and its operation. Mr. Wilson has indicated that he may require periodic monitoring of the salinity levelsin. the mine lake to insure that there are no adverse impacts to any potable water wells in the surrounding area. I am prepared to initiate and continue this monitoring at your direction. 4. Gven the isolated location of the mine and the fact that it is buffered by a heavily wooded area in the direction of the nearest residences (and'one church), I feel there is no threat to public health and safety resulting from the existing mine or the proposed expansion. 5. There are no publicly owned park, forests or recreation areas in the Point Harbor area. 6. The mine has been operated for approximately seven years with no occurrences of sedimentation, landslides or acid water pollution. Nothing in the proposed modification will increase the probability of any such occurrences. 7. I have operated the existing mine for seven years with no violations, permit revocations, bond forfeitures or other legal incidences. The operation entails only dewatering freshwater into a existing wetlands slew with approximately 1,000' available for filtration between the dewatering discharge point and the open waters of the Albemarle Sound. 3. Regarding air quality, surface water quality and groundwater quality, again the nature of the operation is such that there are no anticipated compromising of any of the concerns listed above. The haul road is consistently wetted to minimize dust from the trucks entering and leaving the mine area. No pollutants or sedimentation results from the operation of this sand mine. Mr. Stewart has been in touch with Mr. Nat Wilson, PG of the Division of Water Resources. He has provided Mr. Wilson with technical information regarding the dewatering pump and its operation. Mr. Wilson has indicated that he may require periodic monitoring of the salinity levels in the mine lake to insure that there are no adverse impacts to any potable water wells in the surrounding area. I am prepared to initiate and continue this monitoring at your direction. 4. Given the isolated location of the mine and the fact that it is buffered by a heavily wooded area in the direction of the nearest residences (and'one church), I feel there is no threat to public health and safety resulting from the existing mine or the proposed expansion. 5. The haul road is consistently wetted to minimize dust and the trucks are covered when traveling fill. The proposed Phase 2 excavation area is located farther from any existing residences or other habitable structures than existing Phase i of the excavation site. There have been no indications of adverse impacts to surface or ground water resulting from the on -going operation of the mine. 4.
