In your letter received on 1 /22/2007, you stated that your site has been fully reclaimed and has been released by the Division of Land Resources. In accordance with your request, NPDES General Permit NCG020153 is rescinded, effective immediately.' Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. Enforcement action will be certain for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthennore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential need for NPDES permit coverage. DATE: March 9, 2005 SUBJECT: Reclaimed Water Identification for Directional Bore Martin Marietta Quarry Water Reclamation Project Rivers Project No. 99173 RECEIVED MAR 1 1 2005 DWQ- ARO Roger Williams, with RCOM, Inc., contacted our office on February 25, 2005 regarding "IZeclainicd Water" marking for the 14-inch HDPE to be installed by directional bore methods. He indicated he had purchased black HDPE piping, which did not have identification to indicate reclaimed water piping. Mr. Williams stated he would be installing a tracer wire with the piping, such that it could be located and would not likely be disturbed considering the depth the pipe was to be installed. I contacted Al I -lodge, NCDENR — Washington Regional Office, to discuss the identification requirements for directionally bored "Reclaimed Water" piping. I informed Mr. I -lodge that the location of the directional bore was on the City of" New Bern's portion of the Martin Marietta Quarry site, and was not along a highway or in a residential area. The directionally bored line will be installed within the fenced -in quarry site, which is not readily accessible to the public. Additionally, the connecting 12-inch SDR-21 piping on each end of the bore will be identified in accordance with the NC Administrative Code, Mr. 1-lodge understood that it would be difficult, if -not impossible, to pull a purple wrap or identification tape in the bore with the HDPE piping. Mr. Hodge stated that as long as the connecting piping was properly identified, and above ground signs indicating a directionally bored reclaimed water line were installed at each end of tlic bore, he would consider the line properly marked in this situation. I contacted Donald Robinson and discussed the requirements. informed Donald that above ground markers, comparable to those specified in Specification Section 15 12 1 — Pipe Accessories, purple in color, and marked to identify the directionally bored piping is reclaimed water, would need to be installed at each end of the bore. The Division has determined that the subject discharge qualifies for such coverage. Therefore, the Division is hereby issuing the subject Certificate of Coverage under the state-NPDES general permit no. NCG020000 which shall void NPDES Permit NCO000931. This Certificate of Coverage is issued pursuant to the requirements of North Carolina and the US Environmental Protection Agency Memorandum of Agreement dated December 6,1983 and as subsequently amended. If any parts, measurement frequencies or sampling requirements contained in this general permit are unacceptable to you, you have the right to submit an individual permit application, associated processing fee and letter requesting coverage under an individual permit. Unless such demand is made, this decision shall be final and binding. Please take notice this Certificate of Coverage is not transferable. Part II, EA. addresses the requirements to be followed in case of change of ownership or control of this discharge. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement wastewater treatment or disposal facilities. Construction of any wastewater treatment facilities will require issuance of an Authorization to Construct from this Division. Failure to abide by the requirements contained in this Certificate of Coverage and respective general permit may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. Please note that the general permit does require monitoring in accordance with federal law. In accordance with current rules, there are no annual administrative and compliance monitoring fees for coverage under general permits. The only fee you will be responsible for is a renewal fee at the time of renewal. The current permit expires August 31, 1997. This coverage will remain valid through the duration of the attached general permit. F_ M, m TO DISCHARGE STORMWATER UNDER THE NATIONAL P LLUNTANT DISCHARGE ELIMINATION SYSTEM In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards and regulations promulgated and adopted by the North Carolina Environmental Management Commission, and the Federal Water Pollution Control Act, as amended, MARTIN MARIETTA-NEW BERN is hereby authorized to discharge stormwater from a facility located at MARTIN MARIETTA-NEW BERN Craven County to receiving waters designated as the UT NEUSE RIVER/ NEUSE RIVER BASIN in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts 1, II, III and IV of General Permit No. NCG020000 as attached. This certificate of coverage shall become effective November 1, 1993. This Certificate of Coverage shall remain in effect for the duration of the General Permit.
