Main Ave. Newton, NC 28658 NORTH CAROLINA Environmental Quality February 12, 2020 Subject: NPDES MS4 Permit No. NCS000397 City of Newton Catawba County Dear Mr. Clark: The NC Department of Environmental Quality (DEQ) has issued the attached final National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) permit to the City of Newton. DEQ also hereby approves the submitted final Stormwater Management Plan (SWMP) as prepared by WithersRavenel, and dated and signed by you on January 27, 2020. Please note that the approved SWMP is an enforceable component of the subject permit. With this issuance of the final NPDES MS4 permit and approval of the final SWMP, DEQ has determined that the requirements of the Notice of Violation number NOV-2019-PC-0282, which was issued to the City of Newton on April 24, 2019, have been met in full. NOV-2019-PC-0282 has been closed. The subject state NPDES MS4 permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated May 9, 1994, or as subsequently amended. If any parts contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding. This permit does not affect the legal requirements to obtain other permits which may be required by the other State, Federal or Local Agency.
