Wastewater Treatment Plant Permit Number: NCG 140141 Jackson County Dear Mr. McNeely: On November 1, 2001, Mr. Roy Davis and I inspected the storm water collection, treatment and disposal system operated by Toxaway Concrete. Attached, please find an NPDES Compliance Inspection Report Form. The facility appears to be operated and managed well, but lacks in record keeping. Record keeping should be kept in a bound book located in the managers office (or other secure place) which complies with the record keeping requirements of the issued permit. There written records must include, but not be limited to, notes regarding inspections and sampling with descriptive comments concerning the condition of the catch basins and stream above and below the discharge point. Additionally, records oe the amount and date of solids removal from the catch basins should be maintained. It should also be noted that Section E: Reporting Requirements. 9, requires that anytime solids are discharged from the catch basins to the stream for any reason, the Division of Water Quality be contacted by phone within 24 hours, and in writing within 5 calendar days. Nothing in this letter should be taken as removing from you the responsibility or liability for failure to comply with all applicable state laws and regulations. Settleables are collected from the catch basins and are used as fill material in adjacent areas. At the time of inspection, the catch basins were in need of clean -out. The equipment operator onsite acknowledged this and said it would be taken care on. 4. Retord keeping was lacking. Plant manager was instructed to keep better records as required by the issued permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated December 6, 1983. The stormwater permit you are receiving, NCG 140000, does not permit wasting concrete, dumping excess concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess concrete or washes excess concrete into storm sewers or waters of the state will be operating in direct violation to both the terms of this permit and the North Carolina General Statutes. Such a discharge shall be considered an illegal discharge and may subject the owner to enforcement actions in accordance with North Carolina General Statutes 143-215.6A If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to request an individual permit by submitting an individual permit application.
