Sullins, Deputy Director Division of Water Quality March 31, 2006 Subject: No Exposure Certification NCGNE0271 Analog Devices, Inc. 7910 Triad Center Drive, Greensboro, NC Guilford County The Division has reviewed your submittal of the No -Exposure Certification for Exclusion from NPDES Stormwater Permitting form, which we received on March 11, 2006: Based on your submittal and signed certification of no exposure at the above referenced facility, the Division is granting your certification as' provided for under 40 CFR 126.22(g), which is incorporated by reference in North Carolina regulations., The Division of Water Quality is rescinding your previous Stormwater Certificate of Coverage, NCG030106, based solely on your no exposure certification. Please note that by our acceptance of your no exposure certification, you are obligated to maintain no exposure conditions at your facility. If conditions change such that your facility can no longer qualify for a no - exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. Your conditional no -exposure exclusion expires in five years (March 1, 2011). At that time you must re -certify with the Division, or obtain NPDES permit coverage for any stormwater discharges from your facility. Your certification of no exposure does not affect your facility's legal requirements to obtain environmental permits that may be required under other federal, state, or local regulations or ordinances. I was hoping you could assist nib in clarifying what "industrial activities" are exempt from General Storm Water Permit Coverage in North Carolina. On November,11, 1999, I toured the Analog Devices Inc. (Analog) Greensboro, NC site. The purpose of the tour was to review whether the site needs coverage under the North Carolina Department. of Environment; Health and Natural Resources (N_ C DEHNR) General Permit for Storm Water (NCG030000). Background The Analog Greensboro Manufacturing facility has always maintained.that it would prefer to implement Best Management. Practices (BMPs) which would eliminate ' exposures to storm water because as a Category I 1 facility, that.would preclude coverage under the C=eneral Stern Water Pe.:.iit. , As far back.as 1991, Analog implemented BMPs such as relocating the storage of hazardous wastes indoors anddristalling roof over hangs aver Shipping andReceiving Docks, so as not to have to get coverage under the General Storm Water Permit. Though the intent was to be exempt from General Storm Water Permit coverage, it appears that . Analog submitted a Notice of Intent '(NOI) in September 1992. Analog included a cover letter with the NOI explaining the Best Management Practices it had. implemented, and' requested an exemption from storm water coverage. However, Analog received a ' Certificate of Coverage (NCG030106) in April 1993. Analog assumed that because the cover letter submitted with the original NOI had not led , to an exemption, then it must have,to renew its original permit coverage. According=to NC DEHNR,.Analog renewed it's coverage under the General Storm Water Permit in Capaccio Environmental Engineering, Inc. Page I . Project No. 93-026 1 1/23/99 May 1997. The permit coverage was reissued in October 1997 and will expire August.31, 2002, Storm Water Permit Applicability - The way I understand it; if all three of the following 'conditions: are met; the. Analog Greensboro. facility would.be. required to have coverage under storm water, regulations. 1. If it has a point source discharge. 2. ' . If it discharges to "Waters of the US" and' ' - .3. If it is considered an "industrial activity" subject to the"regulations. = It appears that the Analog Greensboro facility meets Conditions.•) and 2. However, ' Condition 3, pertaining to "industrial activity"-,is:where•.we, nced'some regulatory interpretation and clarification. It appears that the NC'DEHNR allows for exemptions to. storm water permits. In a fact sheet (WQSWOOFS) I downloaded from NC DEHNR's website, it states-, "A category of industrial facilities defined by SIC Codes is known•as "Category l I When facilities within this category eliminate the exposure of materials/products/handling equipment to storm'water, they are not required to file an application for a storm water. permit." Analog s SIC Code.(3674).falls,under Category 11• facility requirements. Therefore, my opinion is that the following areas would not be' considered `"industrial activities;.', because there.appears to be no exposure of chemicals to storm'water. However, I would - like clarification as to whether the following would be considered "industrial activities" ' . by the NC DEHNR. 1.. Outside storage of•Nitrogen and,Helium in -aboveground tanks— inert gases stored' in•liquid form under pressure ' .2. Totally enclosed furrie scrubber- no longer used because. processes moved off -'site ...but still, connected, located outside , 'nutside.s.cr'-be of Fuel O.1L in aboveground Lark `,vi«h sCceruary conta:nii+. r+t that is totally, enclosed. 4. Make-up Air Units on Roof which are•standard`for most facilities: " 5. Being a Category I 1 facility, it has implemented BMPs.to.elim'inate exposures, to reach that goal: ITeel that it may be possible to be exempt, however, clarification is -needed on what is considered an "industrial- activity" by ' the NC.DEHNR. This permit CD is reissued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated December 6, 1983. The following information is included with your permit package: ■ A copy of the stormwater general permit. ■ A Stormwater Pollution Prevention Plan Certification Form. This form certifies that you have developed and implemented the Stormwater Pollution Prevention Plan (SPPP) required in your permit. This form must be completed and returned to the Division within 30 days of receipt of this letter. DO NOT send the SPPP with the signed form. ■ Five copies of Analytical Monitoring forms. ■ Five copies of Qualitative Monitoring forms. ■ A copy of a Technical Bulletin on the stormwater program with outlines program components and addresses frequently asked questions. ■ A corrected Certificate of Coverage if you indicated a name or address change on the Renewal Form returned to the Division. V Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water Quality may require modification or revocation and reissuance of the certificate of coverage. This permit does not affect the legal requirements to obtain other permits which may be required by DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area Management Act or any other Federal or Local governmental permits that may be required.
