A copy of the Compliance Inspection Report is enclosed for your review. Mr. David McKeown, Regional Environmental Manager and John Williford, Production Supervisor, were also present during the inspection and their time and assistance is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES General Permit NCG020000 under Certificate of Coverage NCG020120. Permit coverage authorizes the discharge of stormwater and/or process wastewater from the facility to receiving waters designated Little Brown Creek, a Class C water located in the Yadkin -Pee Dee River Basin. As a result of the inspection, the facility was found to not be in compliance with the conditions of the NCG020000 permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Please be advised that violations of the NPDES General Permit are subject to a civil penalty assessment of up to $25,000 per day for each violation. This mine is relatively inactively used a few times per year with one active stockpile on the site. The Stormwater Pollution Prevention Plan (SPPP) was reviewed. The most recent SPPP was developed in 2013. The SPPP needs to be annually updated, including a list of significant spills over the last 3 years, documented employee training and certification that the outfalls have been evaluated for the presence of non-stormwater discharges. Please refer to General Permit NCG020000 for the additional required information. The site map also needs to be modified to include the information stipulated in the General Permit. All Best Management Practices (BMP's)have not been regulary inspected and will need to be inspected once per week. This information will need to be documented as well as any related repairs of the BMP's. Qualitative and Analytical Monitoring has not been conducted at the site since 2009 and will need to be initiated semi-annually for stormwater and quarterly for wastewater. If there is no discharge from the outfalls, this needs to be documented on the two Discharge Monitoring Forms which cover any stormwater discharges as well as any mineldewatering wastewater discharges. There are two outfalls which were observed in the field with no issues noted. Requirements of the previous permit included the development of a Stormwater BMP Plan, Analytical and Qualitative Monitoring for Stormwater only discharges, and Analytical Monitoring for mine dewatering and process wastewater discharges. Met with Mr. Jack Garvey, Area Environmental Manager, and Mr. Jason Smith, Plant Superintendent. Mining activities at the Anson County Mine are somewhat sporadic in that clay material is removed from existing stockpiles on an as -needed basis to be hauled to the company's brick manufacturing facility. The site is graded so that all stormwater is captured in the remaining pits to allow for detention of any solids. Site has two outlet areas where brick is supplied to serve as BMPsloverflow weirs. Any discharge would exit the pits over the brick weirs and travel through a vegetated area prior to entering a grassed ditch that leads to the receiving stream. Based on review of DMRs, facility has had no stormwater discharges from 2004 to 2009 and a single mine dewatering event in the third quarter of 2003. Due to the sporadic nature of mining activities, BMP inspections have not been conducted on a weekly basis. Facility's Stormwater BMP Plan, which has been revised to a Stormwater Pollution Prevention Plan to reflect conditions of the recently renewed general permit was reviewed and contained all permit -required components. Recommendations were made at the time of inspection to begin documentation of the required weekly BMP inspections and submittal of both DMR forms to cover any stormwater only discharges as well as any mine dewateringlprocess wastewater discharges. The majority of the property is immediately south of the intersection of Camden Church Road (SR-1121) and Horton Road (SR-1211)-in Anson County, -North Carolina. Approximately 1.7 acres of land includes the right-of-way for Camden- Church Road and land north of the right-of-way. The 49.5 acres of land south of the DOT right-of-way is mined for clay. Due to buffer limits, the total area disturbed is 42.4 acres. Erosion control is provided by diversion berms directing runoff to Erosion Control. Structures 1 and 3. Erosion Control Structure 2 has been removed by excavation. The entire mine area has been surrounded by perimeter berms to include an 8ft high berm paralleling the NCDOT right-of-way. This berm provides screening from the public roadway. Periodically, it will be necessary to pump water that accumulates in the Erosion Control Structures to continue excavation at depths below the outlet of the structures (the erosion control basins also serve as the mine areas). The water from the selected basin is pumped to the adjacent structure. The pump capacity is no more than 500gpm (0.1114 cubic feet per second). MAINTENANCE CONSIDERATIONS 1. All erosion and sediment control practices shall be checked for stability and_ operation following every runoffproducing rainfall, but in no case less than once weekly. Any needed repairs will be made immediately to maintain all practices as designed. 2. The sediment traps will be cleaned out when 1 ft. of sediment accumulates in the basins. 3. All seeded areas shall be fertilized, reseeded as necessary and mulched according to specification in the vegetative plan.
