REGAN Secretary TRACY DAVIS Director On August 7, 2017, Blair Palmer of the North Carolina Department of Environmental Quality — Division of Air Quality (NCDEQ — DAQ) conducted an announced multi -media inspection at the Piedmont Asphalt plant located at 7641 NC Hwy 87 in Reidsville. Inspection included review for compliance with the facilities industrial stormwater permit requirements. This facility holds General Stormwater Permit-NCG160120 to discharge stormwater from industrial activity associated with Asphalt Paving Mixtures and Blocks [SIC 29511 under the National Pollutant Discharge Elimination System (NPDES). The permit became effective October 1, 2014 and expires on September 30, 2019. A copy of the current permit is required to be maintained with the Stormwater Pollution Prevention Plan (SPPP) documents. The current permit was not available for review and was not included in the SPPP at the time of inspection. This facility was required to develop and maintain a Stormwater Pollution Prevention Plan (SPPP). At the time of inspection, the facility did not have updated responsible parties listed, had not provided required annual training, was missing at least one bi-annual analytical and qualitative monitoring sample, had not been reviewing and signing annual updates of the SPPP, was not providing monthly site inspections, and did not provide qualitative or analytical monitoring for the second half of 2016. NC 27103 336 776 9800 The following observations and violations were noted during the NCDEQ multimedia inspection: Stormwater Pollution Prevention. Plan: NCG 160000, Part 11 Section A requires the permittee to develop and implement a Stormwater Pollution Plan that includes items 1 thru 9 of Section A. The facility does have a plan but was deficient in several areas: did not include a current copy of the permit, did not have the responsible parties/contact list updated, was not providing required annual stormwater training, was missing qualitative and analytical monitoring for the second half of 2016, had not provided annual review and update. Analytical Monitoring (Bi-Annual) • NCG160000 Part II Section B requires analytical monitoring to be conducted twice annually for TSS and total rainfall at each outfall. The facility was deficient in that monitoring was not provided for the second half (July 1 thru December 31) of 2016 and was not providing rainfall records. There was no rain gauge onsite. The gauge is needed to collect accurate rainfall data. Qualitative Monitoring (Bi-Annual) • NCG 160000 Part II Section C requires the qualitative monitoring to be conducted twice annually at each outfall. The facility was deficient in that monitoring was not provided for the second half (July 1 thru December 31) of 2016. Your Re uired Response: Accordingly, you are directed to respond to this letter in writing within 30 calendar days of receipt of this Notice. Please initiate the following corrective action: I. Include a current copy of the Permit in the Stormwater Pollution Prevention Plan (SPPP). You may contact Glen White of NCDEMLR at glen. whitetencdenr.gov to have a .pdf copy forwarded to you via email. Print it out a copy and add to the front of your SPPP. 2. Please update your Responsible Party/Emergency Contact List. Several personnel changes have occurred since the last update. Also, contacts should include at least one person that is onsite (Plant Manager, HR & Safety Manager) anytime the facility is in operation. 3. Update the SPPP annually. The last update was on May 10, 2016. Please update.. The permit requires update every 12 months. 4. Provide a Rain Gauge and begin keeping rainfall records as required. 5. Provide Annual Employee Training for stormwater. All personnel that work outside, should be included in training. No records of training could be located at the time of inspection. 6. Provide Monthly Site Inspections. Last inspection date was May 3, 2016. Please return to providing monthly inspections as was being conducted prior to that date, 7. Provide Qualitative and Analytical Monitoring semi-annually as required. No monitoring was conducted during the second half (July 1 thru Dec 31) of 2016. Please ensure that one qualitative and one analytical monitoring event is provided for the two required monitoring periods. (TPH monitoring is no longer required. You may eliminate this parameter from your analytical testing). This change of personnel needs to be reflected in their SWPPP. The facility was advised to have at least one person who his on site to be part of the plan, which should be be Mr. Jackie Stanley, Plant Manager. Mr. Julian Stinson, HR and Safety Manager may be considered in the plan. The containment area looked in good shape, which included the wall. The facility advised to install locking mechanisms on all of the valves tied to draining the containment area. General housekeeping looked good and there was no evidence of spills. However, the location where liquid asphalt is conducted should be done in a manner to prevent spilling of material onto the containment wall and nearby areas The facility was advised to look into a better way of loading of liquid asphalt. There were also no monthly inspections or any site ins ectians bein conducted since May 3 2016. The June 27, 2017 results of TSS were 8.5 mg/l < permitted limit of 100 mgll. The facility has been having samples aralyzed for olt and grease, however. Inspection consist of review of the Stormwater Pollution Prevention Plan, training and monitoring records and observation of the general condition of the site and outfall. Your assistance with the inspection was greatly appreciated. Permit: The Asphalt plant holds General Stormwater Permit NCG160120 to discharge stormwater from industrial activity associated with Asphalt Paving Mixtures and Blocks under the National Pollutant Discharge Elimination System (NPDES). The permit became effective October 01, 2014 and expires on September 30, 2019. The Quarry holds General Stormwater Permit NCG020061 to discharge stormwater from industrial activity associated with Mine Dewatering Wastewater and Process Wastewater. The Quarry is permitted for its mining operations under Mining Permit 79-06. A copy of the current permit is required to be maintained with the Stormwater Pollution Prevention Plan (SPPP) documents. The current permit was included in both files. Records/Reports: This facility was required to develop and maintain a Stormwater Pollution Prevention Plan (SPPP) in accordance with Part II, Section A of the permit. A new SPPP was prepared and issued on February 22, 2016. The document is well prepared. The documents have been maintained and past documents were available for review at the time of inspection. The quarry produces rock of varies sizes used throughout industry in construction. Self -Monitoring Program: The facility is required to conduct qualitative and analytical monitoring twice annually. Records show that monitoring has been conducted as required and results are within the required permit parameters. There is only one actual discharge from the facility. It empties into the adjacent creek as effluent from the quarry's settling basin. The quarry includes the settling basins and the pit itself. The pit was virtually clear with a blue-green surface from minerals at the time of inspection. The quarry reuses it's process water to spray it's roadways and paths to keep dust down and improve air quality at the quarry, asphalt plant and at the adjoining concrete plant. The facility discharges stormwater to Wolf Island Creek, which is currently classified as a Class C water in the Roanoke River Basin. Documentation & Monitoring Review 3. The facility has a complete stormwater pollution prevention plan (SP3). However, some discrepancies were noted in the SP3 and its implementation as detailed below: a. The stormwater discharge outfalls (SDO) have reportedly changed since the date of the SP3 (September 2007). SDO 001 no longer exists due to changes at the site and another SDO has since been identified. The SP3 must be updated to include all SDOs and the site should be reevaluated to determine whether other SDOs exist that must be monitored. The SP3 and site plan should also be updated to delineate the individual drainage areas for each identified SDO and to specify the percentage of each drainage area that is impervious. Also, it needs to be conclusively determined as to whether or not the make-up water pond discharges. Some of the stormwater runoff from the site apparently drains to this pond and as such the pond discharge must be monitored in accordance with the permit. b. One of the general location maps (GLM) in the SP3 was for another site in Pelham, NC. Please remove this map from the SP3 for this facility and update the correct GLM to show accurate latitudes/longitudes for each SDO. c. Permittee needs to begin annual SP3 reviews/updates and have responsible party recertify it annually after the review/update is complete. d. One person listed in the Pollution Prevention and Spill Team lists no longer works there. These lists need to be updated. e. The spill history should be updated. The SP3 currently only indicates that no spills occurred for the three years prior to the date of the last Notice of Intent. The spill history should be updated annually at the time that the SP3 is reviewed and updated. Some training records were available at the site but they did not reflect training of employees in r. stormwater and spills specifically. It was stated that the majority of records were on file at the home office. 4. Mr. Holland stated that the required analytical and qualitative monitoring was being done, but not all records were available during the inspection. Records that were available indicated "No Discharge". Mr. Holland was informed at that time that the permittee must get one sample per year per SDO as required by the permit. Currently, qualitative monitoring does not need to be done during a representative storm event so records of all monitoring events should be available. Site Review The one existing identified SDO was inspected and no evidence of adverse affects of stormwater discharges were detected. As mentioned above, it must be conclusively determined as to whether the make-up water pond discharges. If it does, the discharge must be monitored in accordance with the permit. 6. The drain valve on the secondary containment for the new and used oil and the oil heater was locked in the open position. This valve should be locked in the closed position at all times except to drain the containment, and: then only after inspection by the plant operator. Additonally, the drain valve on the secondary containment for the -diesel fuel tank was closed, but not locked. Mr. Holland does have extensive records that show inspection of the containment devices at the plant. 7. The was a considerable amount of oil/grease spillage on the pavement beneath one of the large machines at the plant, apparently the result of recent maintenance. Please review your spill training procedures for all employees to ensure spills, regardless of amount, are cleaned up and properly disposed of immediately. 8. Please be aware that the Division may assess civil penalties of up to $25,000 per day, per violation for failure to comply with the requirements of NCG160000 and NC General Statutes 143-215.1 and 143-215.75. You may wish to review the permit and general statutes in detail to familiarize yourself with the requirements of each. Please reply to this letter in writing within 30 business days of receiving it. Your response should include an action plan and implementation schedule for the correction of those issues listed above in paragraphs 3 through 7.
