NC; 27107-2241 RE: Rockingham County Landfill- General Permit No. NCG120055 Storm water Monitoring Tier Three Response for SD0#1 Dear Corey Basinger: During recent testing of Rockingham County Landfill's sediment pond SDO#l, elevated fecal coliform levels were detected four consecutive times above the allowed bench mark level. According to our permit number NCG120055, we are required to institute Tier Three Response and inform you of the situation. We suspect the elevated levels are caused by seasonal seagulls roosting on the landfill slope as well as vultures that heavily populate surrounding trees, thereby contaminating rainwater runoff. Also the ponds are not completely draining between samples and therefore the stagnant water may be the cause of the elevated levels of Fecal Coliform. This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended). The following information is included with your permit package: • A new Certificate of Coverage (COC) • A copy of General Permit NCG120000 • A copy of the Technical Bulletin for the General Permit • Two copies of the Discharge Monitoring Report (DMR) Form • Two copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the permit to update your current SPPP to reflect all new permit requirements. The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable, report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections B, C: A lower TSS benchmark of 50 mg/I for HOW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections B, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements. • Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined in the "Definitions" section of the permit. • Sections B, C. The term "Representative Storm Event" has been replaced by "Measurable Storm Event." A measurable storm event is defined in the permit. • Section D: If the permittee fails to respond effectively to problems identified by qualitative monitoring, DWQ may require the permittee to perform corrective action. Your assistance and cooperation during the inspection was greatly appreciated. An inspection checklist is attached for your records and the inspection findings are summarized below. The facility is located at 281 Shuff Road, in Madison, Rockingham County, North Carolina. The facility currently discharges stormwater to Little Mill Creek, which is currently classified as Class C waters in the Roanoke Ritter Basin, Documentation and Monitoring Review Landfill permits for the facility are current. All aboveground storage tanks on site are double -walled and therefore do not require secondary containment structures, inspections or record keeping. The Stormwater Pollution Prevention Plan (SP3) is complete and well implemented. Training sessions are conducted annually to keep staff informed and updated. You also indicated to Mr. Thomas that you often work with employees one-to-one to ensure that the SP3 is being followed. The facility has four stormwater discharge outfalls (SDO) which were visited during the inspection. The drainage area for SDO I is greatly impacted by the work being conducted to re -slope that section of the landfill, resulting in above benchmark levels for Total Suspended Solids. Based on your conversation with Mr. Thomas you plan to seed the exposed area in wheat to stabilize the slope and then continue the work in smaller segments. In addition, Mr, Thomas made recommendations for protecting the drop inlets to help reduce the amount of sediment reaching the settling ponds. Lab sample bottles have been received from Meritech, Inc to begin analytical and qualitative testing of SDO 004 which receives drainage from the Landfill wood mulch storage area as required in paragraph 4 of your inspection letter. Samples will be collected for lab analysis of COD, Total Suspended Solids, and Fecal Coliform during the next sampling event scheduled for period July 1, 2008 thru December 31, 2008. The corrective actions for mucking out basins for SDO 001 and SDO 003 have begun as required in Paragraph 5. Areas around the risers in each of the four sedimentation basins have been cleaned, riser pipes adjusted/repaired where needed and new stone has been placed around all risers. Efforts are underway to continue the mucking process with currently available Landfill equipment. The Rockingham County Board of Commissioners in their October 2008 meetings approved for the Landfill to purchase a track excavator and an articulated dump truck which is needed to complete the mucking process in SDO 001 and SDO 3 basins as well as basins SDO 2 and SDO 4. Purchase orders have been issued for a new excavator and a new articulated dump truck and placed with James River Equipment seeking prompt delivery of this new equipment. Upon delivery, priority assignment for this equipment is to complete the mucking and cleaning process in the four (4) sedimentation basins. Steve W. According to our database records, the facility currently discharges stormwater to Little Mill Creek, which is currently classified as Class C waters in the Roanoke River Basin. Documentation & Monitoring Review 3. Landfill and land disturbance permits for the landfill are current. All aboveground storage tanks (AST) on site are double -walled and therefore do not require secondary containment structures, inspections or records. 4. The site has four stormwater discharge outfalls (SDO) but analytical and qualitative monitoring has been completed at only three of them. Each SDO receives discharge from a sedimentation basin that receives stormwater runoff from specified drainage areas. The drainage areas for SDOs 001 through 003 still encompass active landfill operations. The drainage area for SDO 004 currently contains an inactive landfill cell that has been capped and closed. That is why monitoring was discontinued at this particular SDO. However, drainage area/SDO 004 also contains a mulching operation. As such, you must begin monitoring the discharge from SDO 004 immediately - The first round of analytical samples, taken on 30 June 2008, resulted in exceedences of benchmark values/ranges of Total Suspended Solids (TSS) at SDOs 001 and 003 and of pH at SDO 1. The facility has undertaken and documented the necessary Tier One responses to identify possible causes of the exceedences and corrective actions. The final corrective action, to muck out the basins for SDO 001 and 003, has not yet been accomplished due to the lack of proper equipment and financial constraints. The county is reminded that all identified corrective actions should be completed within 2 months of identification of corrective actions. If the next sampling event results in repeat exceedences of the same parameters at the same SDO, then a Tier Two response will be necessary, which includes monthly sampling until three consecutive samples show the discharge(s) are below the specific parameter's benchmark value or within the benchmark range - Site Review 6. The site was clean and well maintained. As mentioned above, ail ASTs on site are double -walled and therefore don't require secondary containment. No other discrepancies or concerns were noted. Please continue to maintain some vegetation in these areas, such as grass, to help prevent erosion and the washing of silt and sediment into the stream. 8. Please be aware that the Division may assess civil penalties of up to $25,000 per day, per violation for failure to comply with the requirements of NCG120000. Please reply to this fetter in writing within 30 business days of receiving it. We should receive your response no later than 30 October 2008. The more significant changes to the General Permit include the following: • Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL, may not be eligible for renewed coverage under the General Permit. • Part It Section B Table 1 — An increased sampling frequency from once per year to twice per year. • Part II Section B Table 3 — Benchmark concentrations now replace cutoff concentrations; the elimination of the option to avoid sampling based on cutoff concentrations. • Part II Section B — New provisions requiring the permittee to execute Tier One and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive monitoring events show no benchmark exceedences. • Part II Section B — A new provision that four exceedences of any particular benchmark will trigger increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control measures.
