Ron Boone of the Winston-Salem Regional Office of the NC Division of Water Quality (DWQ) conducted a compliance evaluation inspection (CEI) at the subject facility on September 19, 2011. The assistance and cooperation of Vincent McAlexander, Patrick Edmund, Greg Craft and William Baugher were greatly appreciated. An inspection checklist is attached for your records and the inspection findings are summarized below. 2. The facility is located at 650 Stadium Drive, in Winston Salem, Forsyth County, North Carolina. Stormwater related to industrial activity is discharged from five separate stormwater discharge outfalls (SDO) at the site, to an unnamed tributary (UT) to Salem Creek, which is currently classified as Class C waters in the Yadkin Pee - Dee River basin. Documentation & Monitoring Review 3. The site has an excellent Stormwater Pollution Prevention Plan (SP3) but it has not yet been fully implemented. The only problems noted with the actual SP3 document are listed below: a. The SP3 incorrectly lists Bath Branch as the receiving stream. As stated above, the actual receiving stream is a UT to Salem Creek. This should be corrected in the SP3. b. The SP3 does not list the TMDI_s and parameters of concern for the receiving stream as required by Part II, Section A, Paragraph 1(a), of the general permit. c. The SP3 does not address remote fueling operations as required in Part Il, Section A, Paragraph 2(f), of the general permit. 4. The SP3 has not yet been fully implemented. The items required by the SP3 that have not yet been accomplished are listed below: a. The SP3 states that there were no spills in the three years prior to the effective date of the SP3 (05/30/2008). However, Mr. Edmund indicated that there have been spills since then, but no records of those spills have been kept, as required by Part III, Section D, Paragraph 6, of the general permit. Additionally, there have been no annual updates to the spill list, as required by Part Il, Section A, Paragraph 7, of the general permit. Page 2 of 3 b. The annual certification of the SDOs, as required by Part II, Section A, Paragraphs 1(e) and 7, was not accomplished for 2009, 2010 or 2011. c. The SP3 includes a checklist of Best Management Practices (BMP) that the operators can use and check off each BMP as it is implemented. These checklists have not been used and none of the BMPs have been checked off. d. There have been no annual SP3 reviews as required by Part iI, Section A, Paragraph 7, of the general permit. e. The SP3 certification document has not been signed. f. The SP3 has a list of positions of responsibility but the names have not been filled in, therefore leaving SP3 responsibilities unassigned. Please review Part 11, Section A, Paragraph 6 of the general permit. g. The spill team has not been formally assigned as required by Part 11, Section A, Paragraph 3, of the general permit. h. Training has'not been accomplished or documented as required by Part 11, Section A, Paragraph 5, of the general permit. ' i. There is no documentation of preventative maintenance/good housekeeping, as required by Part 11, Section A, Paragraph 4, of the general permit. j. There is no documentation of facility inspections, as required by Part II, Section A, Paragraph 8, of the general permit. 5. Qualitative monitoring was accomplished in 2007 and 2008, but has not been accomplished since then. 6. Analytical monitoring was accomplished in June 2008, resulting in three Total Suspended Solids (TSS) benchmark exceedences for which corrective actions were allegedly identified and implemented. Analytical monitoring was accomplished again in December 2008, again resulting in three TSS benchmark exceedences, as well as one Oil & Grease benchmark exceedence. Analytical monitoring was not accomplished in 2009 or 2010, and has not yet been accomplished for 2011. Site Review 7. In general the site was relatively clean, however the following problems were noted: a. The vehicle wash rack at the site drains to an oil/water separator and then to the city's sanitary sewer system. It is actually noted in the SP3, and Mr. Boone has received one complaint from a concerned citizen, about how the trench drains inside the wash rack often become clogged with solids being washed from the vehicles, resulting in the wash water, which at this point is considered wastewater, overflowing from the facility and flowing directly to a stormwater catch basin, which then flows directly to the UT to Salem Creek. Again, please note that this is a wastewater and such overflows are considered an illegal discharge. It is noted that the city has plans to move the entire Fleet Services operation to a new site located on Lowery Street. However, in the interim, either a structural or a procedural BMP must be implemented to prevent this from occurring. It is also noted that Mr. Boone was told during the inspection that the Fleet Services Department has stormwater catch basin covers that are to be used to prevent illegal discharges from entering the stormwater system and ultimately the receiving stream. However, these covers have not been used. Using these covers to prevent the wastewater from entering the receiving stream is one BMP the department could use to prevent this situation. Please review_ Part 11, Section A, Paragraph 2(e) of the general permit to aid you in addressing this situation. b. The SP3 identifies all aboveground storage tanks (AST) at the site, including those that are located inside the building. It is noted that there is at least one other tank, located inside the building, which contains the floor cleaner/degreaser solution, but is not included on the SP3's list of tanks. Please note that the SP3 and this general permit are only concerned with ASTs located outside the buildings exposed to the elements, unless spills from those tanks can travel to the outside of the facility. It is also noted that the floor cleanerldegreaser tank does not have secondary containment. There are two tanks (tanks #8 and #9 as identified in the SP3) located outside the building at the vehicle wash rack that do not have secondary containment as required by Part II, Section A, Paragraph 2(b), of the general permit. d. There are numerous large petroleum spills in the large gravel/dirt parking lot located on the west side of the main maintenance building. Most of the spills are quite old, but again they're large and should have been properly stopped, contained, and cleaned up. There were also fairly large spills inside the building that had not yet been stopped or cleaned up at the time of the inspection, however, this permit is not particularly concerned with these spills until they are somehow transported from inside the facility to the outside; such as on the bottom of vehicle tires. One spill in particular, located on the asphalt lot west of the main maintenance building, had oil dry granules applied to it but had not yet been swept up and properly disposed at the time of the inspection. It is unknown how long this spill had been there but it had been quite some time as no liquid petroleum was evident at the time of the inspection; it had been mostly soaked up into the oil dry granules. Please note that these spills should be cleaned up and properly disposed as soon as possible. This should be included in the SP3. e. Most of the SDOs are stormwater catch basins that drain to the stormwater system and ultimately to the receiving stream. There was a large amount of dirt, gravel, and small pieces of what appeared to be broken up concrete in the vicinity of these catch basins. This material should be swept up and properly disposed because it can adversely affect TSS samples and it can also enter the receiving stream where, in a large amount, would be considered.a pollutant. 8. You are reminded that violations of the NCGO80000 general permit are subject to civil penalty assessments not to exceed $25,000 per day per violation. Please reply in writing to this Notice of Violation within 30 business days of receiving it. Your written response should include corrective actions with implementation schedules for every violation and deficiency noted above in paragraphs 3 through 7. 9. A rain event of .35 inches occurred on June 26, 2008 and the analytical monitoring of the outfalls was completed. "The samples are currently at Research & Analytical Laboratories, Inc. in Kernersville for processing. When we get the results, they will be forwarded to your attention. Mease note that Fleet Services was issued a general storm water permit on August 31, 2007 and is within the first year of the Storm Water Pollution Prevention plan development and implementation. The City of Winston-Salem has received Draft # I of the storm water prevention pollution plan from our consultant. It has been reviewed and sent back to the consultant with comments. Further discussion is expected to be completed by mid -July, at which time, the document will be finalized with plan implementation to take place shortly thereafter. SincrrGly; W.S.
