Bradley - The mines have not moved. However, they are now closed down and the previous contacts are no longer with

Dear Mr. McKeown:
On February 15, 2013, Mike Mickey and Lon Snider of this office met with you and Jack Garvey
to perform a NPDES General Stormwater Permit Inspection on the Hanson Brick PG Plant 3 and Mine
site located off Hunt Road near Pleasant' Garden, NC. The inspection findings are detailed below and an
inspection checklist is attached. for your records.
1. Permit
Hanson Brick East, LLC, holds NPDES Stormwater Permit No. NCG070068 for the discharge of
stormwater from the facility. The permit expires next on May 31, 2013. Our records indicate that the
mine closed in 2008. As was discussed during the inspection, the stormwater permit will need to be kept
current until the mine site is reclaimed.
2. Records/Reuorts
Part II, Section A of the permit requires the development of a Stormwater Pollution Prevention Plan
(SPPP). A copy of the SPPP, last updated in 2005, was available for review during the inspection. The
plan was found to be satisfactory. Please note that Part II Section A.(7) of the permit requires that the
SPPP be reviewed and updated on an annual basis. The current plan in the file needs to be updated.
3. Facilily Site Review
The property was toured to observe the previous mining operation. All previous buildings and tanks have
been removed. Observations noted one main outfall from the pit areas. The stormwater runoff through
the rock dam was found to be free of turbidity. It is our understanding that.Hanson is working on plans to
reclaim the site.
4. Effluent/Receiving_Waters
Stormwater from the property is eventually discharged to a tributary of Polecat Creek, class "WS-III"
waters in the Cape Fear River Basin. The outfall was found to be clear and free of turbidity.

5. Monitorin Program
Part ll, Section B of the permit requires that qualitative (visual) monitoring be performed and documented
semi-annually. The file review showed that this monitoring has not been performed for some time. This
monitoring needs to be continued for any outfalls affected by site runoff from unclaimed pit areas. These
qualitative records (see form attached) do not need to be submitted to. the Division, however, the records
must,be kept on file at the facility for a period of five years.
The analytical monitoring for on -site vehicle maintenance referenced in Part II, Section C of the permit is
not required since the facility uses less than 55 gallons of new motor oil when averaged over the calendar
year.
In summary, the SPPP should be updated and the semi-annual qualitative monitoring should be
continued until the site is successfully reclaimed. Once the site is reclaimed, Hanson Brick can request
that the permit be voided if it is determined that the permit is no longer needed.

We need a few more specifics before we can make these changes. I read through the email chains down there, but I'm
not totally sure about the entire request.
Which contacts for these permits should be changed to Mr. McKeown?
Also, are there old contacts in BIMS that should be removed from these permits?
There are three different kinds of contacts in BIMS (not including billing contacts, which Fran McPherson has to change):
Owner Contact
Permit Contact
Facility Contact
We can't change the Owner Affiliation (not same as "Owner Contact") without a change of Name/Ownership form from
the permittee. Is Mr. McKeown also asking to be the owner? The Owner Affiliation is basically the person we'd consider
legally responsible for the permit, and often that's where we send permit renewal correspondence. [However, we are
trying to get better at copying Permit and Facility contacts in the future, especially since a lot of permits have no Owner
"Affiliation" and just a company name for Owner.]
I've copied Sheri in our group to help work through this request -- she's been handling contact changes for us in BIMS. If
you could give us the details, I know she'll be happy to work with you on it. (And Sheri, if you need any help, just let me
know!)

Yes, I think you've identified the options. My additional comments for these two sites:
•. Dormant status? I suppose we could do this. But, if they know that they're done on those sites, why would
they want to keep paying the $200/yr? Why would they want the obligation of an annual review and update of
both SPPP's?
Rescind permits? Note: closed since 2008, meaning that the sites have been 'dormant' for five years, even if
they haven't requested that status from us. How much longer are they going to wait? Given what we think -we
know about their future business plans (i.e., none), rescission seems like the best choice for them. Our
rescission would be based on site inspections and conclusions that there is no residual exposure that presents a
significant risk of stormwater pollution. The report of a little turbidity doesn't sound so bad to me. Based on
what 1 think i know about their status, 1 think we should wait until the facilities receive the close out from DEMLR
and the mining permits are rescinded by DEMLR, and then rescind the two COC's under
NCG07...........................Wait, flip flop: l don't think NCG07 is predicated on a DEMLR permit like NCG02 is. But
still, these sites still looks like mines, even though they are NCG07's.............flip flop back: keep them under
NCG07 until the mines are finally reclaimed per DEMLR determination. Then rescind both permits. if their
schedule for reclaiming the clay pits is near term, just skip the 'dormant status' exercise. !f it's going to be a
while, then yes, let's get them to apply for dormant status.
Continue to hold the permits and comply with them as they are? Again, based on what we think we know
about the sites, seems like the least attractive alternative.

Ken —The Hanson brick mines permitted above closed in 2008. The gates are locked and all equipment, tanks, etc., have
been removed. However, the mines have not been reclaimed and some slight turbidity stormwater is leaving their
basins at one site. Not sure how to handle. Possible options are to: 1) continue to require qualitative monitoring and
follow SPPP, 2) suggest they request dormant status, or 3) suggest they void the permits.
Hanson indicates that no further industrial activity is planned, that they want to sell the property and are in the process
of getting bids to reclaim (some minor dirt moving, mainly seeding). Any thoughts? Thanks, Mike.

Hanson Brick Plant and Mine #3 — Guilford County
Dear Mr. Garvey:
On August 20, 2008, Jenny Graznak of this office performed a General Stormwater
Permit Inspection at Hanson Brick Plant #3 located at 6245 Hunt Road in Pleasant Garden,
North Carolina. This facility holds General Stormwater Permit No. NCG070068 under the
National Pollutant Discharge Elimination System (NPDES) to discharge Stormwater from
activities classified as Stone, Clay, Glass, and Concrete Products. You were present for the
inspection. This type of inspection consists of two basic parts: a review of facility files and self -
monitoring data, and an on -site inspection of the facility and its outfalls. This particular
inspection evaluated five (5) areas as designated on the EPA inspection form, -and observations
from each area are addressed below:
1. Permit
The latest release of this permit became effective June 1, 2008 and expires May 31, 2013,
2. Records/Reports
As required by the Permit, the facility has a Stormwater Pollution Prevention Plan (SPPP),
which was created in 1994 and included annual updates. The SPPP contained all of the
required sections, including a location map of the facility and a site plan listing potential
stormwater pollutants and best management practices used at the site. The SPPP also
includes a Spill Response Plan, which includes contact information and guidance in the case of
an emergency. Employee Training occurs on an annual basis.
3. Facility Site Review
The manufacturing facility at Plant #3 closed in 1988. The clay mine associated with this plant
closed in February 2008, however it has not been completely reclaimed as of yet. Therefore,
the one "active" outfall is still monitored according to the permit.
There is one 500-gallon aboveground storage tank at Plant #3, which contains off road diesel
fuel. The tank is housed in a containment box for protection.
4. Effluent/Receiving Waters
The site has four outfalls on the property (only one is active) that discharge to an unnamed
tributary to Polecat Creek (Class WS-III) in the Cape Fear River Basin. The outfalls were
inspected during Ms. Graznak's visit to the site. The active outfall discharges from a
Stormwater pond, through a check dam,, and into the woods surrounding the property. There
has been little Stormwater discharge at the Plant due to the drought conditions so the
Stormwater pond was entirely dry. No discharge was observed.

5. Self -Monitoring Program
The stormwater permit requires semi-annual qualitative monitoring at stormwater outfalls. An
on -site review of the qualitative monitoring data during the inspection showed that all
parameters were evaluated per the specifications of the permit. On -site vehicle maintenance
monitoring requirements at the site are waived, since these activities are not performed at the
site. Hanson Brick has an Environmental Management System, which describes and details the
process and for monitoring the Stormwater outfall. There is also a system in place to inspect
the erosion and sedimentation control measures on a semi-annual basis.
The facility was found to be in compliance with NPDES Permit No. NCG070068. Please
refer to the attached report for further details from the inspection. If you have any questions

Your facility is currently covered for slormwater discharge under General Permit NCG070000. This permit expires
on March 31, 2003. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by early spring of 2003. Once the permit is reissued, your facility would he eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit coverage will be expiring. Enclosed you will find a Permit Coverage Renewal
Application Form. The application must be completed and returned by October 2, 2002 in order to assure
continued coverage under the general permit. Due to staff and budget constraints, letters confirming our receipt of
the cornpicted application will not be sent.
Failure to request renewal within the time period specified, may result in a civil assessment of at least $250.00.
Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your
facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1
and could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the 1 1 categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facility industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional
information contact the Central Office Slormwater Staff member listed below or check the Stormwater & General
Permits Unit Web Site at hitp:Hh2o.enr.state.nc.us/su/storniwater.html
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottom of the form. You will be notified when the
rescission process has been completed.
