This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended). The following information is included with your permit package: • A new Certificate of Coverage (COG) • A copy of General Permit NCG060000 • A copy of the Technical Bulletin for the General Permit • Two copies of the Discharge Monitoring Report (DMR) Form • Two copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the permit to update your current SPPP to reflect all new permit requirements. The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable, report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part li of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. The more significant changes in the General Permit since your last COC was issued are noted either in the Draft Permit Fact Sheet that accompanied the public notice (http://i)ortal.ncdenr.org/web/wq/ws/su/current- notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are posted on the Stormwater Permitting Unit's website with the new General Permit. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements. • Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined in the "Definitions" section of the permit. • Sections 6, C. The term "Representative Storm Event" has been replaced by "Measurable Storm Event." A measurable storm event is defined in the permit. • Section D: If the permittee fails to respond effectively to problems identified by qualitative monitoring, DWQ may require the permittee to perform corrective action. Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit, including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than 30 days from the date the facility receives the sampling results from the laboratory. Also note that existing permittees do not need to submit a renewal request prior to expiration unless directed by the Division. Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or decree. (ATC), on behalf of Pepsi Bottling Ventures, LLC (Pepsi), is submitting the attached information regarding the recent oil release at the Pepsi facility located at 33425 Myer Lee Drive in Winston-Salem, North Carolina. During the evening of January 18, 2011, an estimated 25 to 30 gallons of oil was released from an air compressor located outside the facility production building. The oil line from the air compressor to the heat ■ exchanger failed. The release was discovered upon employee arrival at the facility the morning of January 19, 2011. The oil flowed across the pavement and entered the storm drain near the air compressor. The storm drain flows through a concrete culvert which empties into the onsite storm water retention pond located at the northeast corner of the property. The retention pond eventually discharges to Salem Lake. A topographic map is included as Figure I and site plan depicting the location of the air compressor, storm drain and retention pond is included as Figure 2. Pepsi notified ATC and asked for assistance in responding to the spill. ATC contacted Mr. Corey Basinger of North Carolina Department of Environment and Natural Resources (NCDENR) Division of Water Quality at 2:30 PM on January 19, 2011 to report the release. Mr. Keith Huff of the City of Winston-Salem was contacted the same day at 2:40 PM and provided information regarding the release. The following information describes, on a day to day basis, the mitigation efforts regarding the release. Mr. Ron Boone February 23, 2011 NCDENR — Division of Water Quality Page 2 Wednesday January 19, 2011 — ATC and Shamrock (spill response subcontractor) responded following notice of the compressor oil release. Absorbent pads were applied to the oil on the pavement and absorbent booms and pads were placed in the retention pond. A 3-inch diameter flow pipe that maintains the level of the pond was sealed and booms were placed around the concrete outfall of the pond. It should be noted that the water level of the pond, though above the 3" pipe, was several feet lower than the concrete outfall. Several thousand gallons of water were sent through the storm drain in order to flush any residual oil from the culvert leading to the retention pond. A vacuum truck was then used to skim off any accumulated product from the pond surface. Approximately 900 gallons of product/water was recovered from the retention pond surface and disposed of offsite (disposal manifests are attached). Towards the end of the day, the absorbent pads were removed and containerized and the pavement was pressure washed. New pads and booms were deployed in the pond. At the direction of the city, additional skimming of the pond was to be conducted the following day. It should be noted that no oil exited the retention pond as the surface level of the pond was lower than the concrete outfall. Thursday January 20, 2011 — ATC/Shamrock were onsite with a vacuum truck to further mitigate product on the pond. An absorbent boom was dragged across the pond in order to accumulate the oil near shore where the vacuum truck was then used to recover the oil. Approximately 1,578 gallons of product/water were recovered from the surface of the retention pond'and disposed of offsite (disposal manifests are attached). The city instructed Pepsi to seal off the concrete outfall of the pond. Further recovery of product/water with a vacuum truck and placement of pads and booms was to continue. Friday January 21, 2011 — ATC and Contaminant Control Inc. (spill response subcontractor) were onsite with a vacuum truck to further mitigate product on the pond. A steady light wind caused some accumulation of product along the shore. Absorbent booms and pads were used along with a vacuum truck to recover the product. Approximately 1,508 gallons of product/water were recovered from the surface of the retention pond and disposed of offsite (disposal manifests are attached). Further recovery of product/water with a vacuum truck and placement of pads and booms was to continue. Saturday January 22, 2011 — Pepsi instructed CCI to install hard containment booms around the inlet and outlets of the pond in order to further ensure that any residual product would not be released from the pond. CCI mobilized to the site and installed the containment booms in the afternoon. Absorbent pads and booms were placed within the inlet boom and outside of the outlet booms to further collect product. Monday January 24, 2011 — CCI was onsite again to change out booms and pads as needed. Ice on the pond prevented access to some areas of the pond. Tuesday January 25, 2011 — A thicker accumulation of ice overnight has again prevented access to the pond. Pepsi personnel did manage to break up some ice and deploy additional pads. Mr. Ron Boone February 23, 2011 NCDENR — Division of Water Ouality Page 3 Wednesday January 26 through Friday February 2, 2011 — Pepsi continues to inspect the pond on a daily basis. The retention pond has minor areas with petroleum sheen which continues to be mitigated with absorbent booms and pads. Thursday February 3, 2011 In anticipation of a significant amount of rainfall, Pepsi petitioned the city to allow opening the 3-inch outlet drain to prevent the retention pond from overflowing. The city agreed to allow the discharge but instructed Pepsi to collect an effluent water sample from the manhole located between the pond and the railroad tracks located to the north of the site. An effluent water sample was collected on February 3, 2011 and submitted to Compu Chem laboratories in Cary. North Carolina for analysis of oil and grease by Method 1664. The laboratory report showed a non -detectable level of oil and grease in the effluent water sample. A copy of the laboratory report is attached. Monday February 7, 2011 — In an effort to further mitigate the oil remaining in the culvert, Pepsi mobilized a vacuum truck and a sewer jet to the site. The sewer jet was placed in the storm water catch basin nearest the release location and extended down the culvert towards the retention pond inlet. The vacuum truck was positioned at the pond inlet and recovered the water and oil as it exited the culvert. Approximately 1,581 gallons of water and oil were recovered and disposed of offsite (disposal manifests are attached). Inspection and further mitigation activities, if needed, will continue to the satisfaction of the City of Winston-Salem. Pepsi reiterates that no oil was discharged from the retention pond and will consider this matter closed upon approval of the city and DENR.
