Aana Taylor -Smith of the Winston-Salem Regional Office of the NC Division of Energy, Mineral, and Land
Resources (DEMLR) conducted a compliance evaluation inspection at the subject facility on 19 March
2014. The assistance and cooperation of Mr. Robert Dickerson, Plant Manager, during the inspection
was greatly appreciated. An inspection checklist is attached for your records and the inspection findings
are summarized below.
This facility is located at 8630 Broad Street in Rural Hall, Forsyth County, North Carolina. Stormwater
related to industrial activity is discharged from the site to an unnamed tributary to Beaver Dam Creek,
which is currently classified as Class C waters, in the Yadkin -Pee Dee River Basin.
Documentation & Monitoring Review
The facility's Stormwater Pollution Prevention Plan (SPPP) is thorough, up to date, and fully
implemented. Analytical and qualitative monitoring has been completed as required. However, please
note that the renewed NPDES General Stormwater Permit NCG030000 has updated requirements for
metals sampling. Please refer to the attached copy of the NCG030000 permit and make changes to the
sampling program as required.
Site Review
The facility is orderly and well -maintained. Secondary containment is implemented as required. All
violations noted in the previous inspection conducted 10 April 2012 have been corrected. The facility
currently monitors two Stormwater Discharge Outfalls (SDOs). The outfalls were inspected and found to
be in good order. No evidence of erosion or instability at the SDOs was observed. The receiving stream
was free of pollution indicators.

During the inspection, it was noted that while Representative Outfall Status does not apply to this site,
Outfall 002 can be released from analytical and qualitative monitoring requirements because it does not
discharge stormwater related to industrial activity. Ken Garner Manufacturing is no longer required to
perform either type of monitoring at Outfall 002. Please append this letter to your SPPP to document
that your facility has been relieved of all monitoring requirements at Outfall 002. Please notify DEMLR
immediately if conditions at this site should change such that Outfall 002 will discharge stormwater
related to industrial activity.
Thank you for your efforts to comply with the stormwater permit., No additional response to this letter

In response to your renewal application for continued coverage under stormwater General Permit NCG030000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG030000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods -beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://Portal.ncdenr.org/web/wq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

Some of the changes include:
• Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C. The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations, and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

My name is Gale Sheehan and I am the Director of Technical Services of ERS-USA an
Environmental consulting firm. ERS, Inc has been in operation for 19 years with 500
clients and we specialize in assisting clients with EPA and OSHA regulatory compliance
on a national level. We have been contracted by Ken Garner Manufacturing to assist
them in responding to the recent compliance evaluation inspection (CEI) and
subsequently NOV for their facility located at the Rural Hall site.
My plans are to visit the facility on May 241h/ May25th 2012 to see first hand the
mentioned violations cited.
My initial plans will be as follows:
l) To have the SWPPP as required by the general permit completed by July 1,
2012.
2) To insure all Analytical Monitoring as required in the General Permit for all
pertinent SDO's are initiated by July V , 2012.
3) To eliminate the illegal discharge of the specified concrete waste/wastewater
stream by July31, 2012 through state of the art solids capture techniques and
water recycle activities. (We will request pre -approval for the design
parameters selected from (NC DWQ) prior to implementation. Minimization
will be implemented ASAP prior to complete elimination.
4) When we have sufficiently corrected these deficiencies then the Ken Garner
site will apply for Representative Outfall Status (ROS) July 30, 2012.

Dear Mr. Garner:
Ron Boone of the Winston-Salem Regional Office of the NC Division of Water Quality (DWQ or
the Division) conducted a compliance evaluation inspection (CEI) at the subject facility on April 10,
2012. The assistance and cooperation of Mr. Robert Dickerson, Plant Manager, was greatly
appreciated. An inspection checklist is attached for your records and the inspection findings are
summarized below.
The facility is located at 8630 Broad Street, in Rural Hall, Forsyth County, North Carolina, at
approximate coordinates 36.247484°,-80.3066050. The facility currently discharges stormwater
related to industrial activity via two stormwater discharge outfalis (SDO), to an unnamed tributary to
Beaver Dam Creek, which is currently classified as a Class C water located in the Yadkin Pee Dee
River Basin. The approximate coordinates of the two SDOs are: 36.247640" by-80.307662" and
36.247147' by-80.3064750. The first SDO. is located just inside the forested area on the west side of
the main building, about 175 feet north of the south end of the building. The second SDO is. located
on the southeast corner of the building, on the inside of the split in the facility's entrance road that
directs traffic to the back and front of the main building.
Documentation & Monitoring Review
The facility does not currently have a Stormwater Pollution Prevention Plan (SP3) as required
in Part 11, Section A, of the general permit. Mr. Dickerson did have a site map during the inspection
but it lacked many of the requirements specified in Part 11, Section A, Paragraph 1(c), of the general
permit.
Analytical monitoring (AM), as required in Part II, Section B, of the general permit, has been
conducted at the outfall on the west side of the main building, but not at the SDO located on the

southeast corner of the building.
2009, May and October, 2010, and
the AM were annotated:
Specifically; AM was conducted on the western SDO in October,
May and September, 2011. However, the following problems with
1. pH testing of the discharge is -NOT being conducted within 15 minutes of sample collection;
2. The company experienced an exceedence of the Total Suspended Solids (TSS) benchmark in
May, 2010, but did not perform the required tier one actions in response to the exceedence, as
required in Part II, Section B, of the general permit; and,
3. As stated above, the company is not performing AM at the SDO located on the southeastern
corner of the property.
Concerning qualitative monitoring (QM), Mr. Dickerson stated that he does conduct QM at the
SDO located on the west side of the building, as required by Part II, Section C, of the general permit,
but the QM has not been documented as required.
Site Review
The site was very clean and well maintained. Mr. Boone noted only one concern. The
company manufactures counter weights for excavating machines. As part of that process, the
company mixes its own concrete which it uses to fill the steel counter weights. The mixing drums of
the concrete truck(s) are typically washed out and the waste is then dumped on the ground in a small
area located on the northeast corner of the plant site. The water that drains from this waste concrete
and the rainwater that incidentally fails on the piles of the waste concrete is then considered a
wastewater. Currently, it appears that all drainage from this small area is captured by a stormwater
drop inlet located just adjacent to the dump pile. The water is then conveyed through underground
piping to the SDO located on the west side of the main building where it is then discharged.
Unfortunately, this is considered to be an illicit discharge of wastewater. The company must
take steps to eliminate the discharge. The company has many options'to achieve this, including but
not limited to: 1. Finding another legal place to dump and/or dispose of the waste, 2. Constructing a
series of holding basins that settle out solids as the water passes through each phase and that does
not discharge (this can likely be achieved by constructing such. a system according to how much
waste is generated daily), or 3. Purchasing premixed concrete from an outside source. Regardless of
how the company ultimately decides to eliminate the illicit discharge of this wastewater, the selected
process must be approved by this office. We will work with you to determine the best course of
action. In the interim, you must minimize this illicit discharge by all means possible.
Please correct all violations noted above as soon as practical. Please reply in writing to this
letter within 30 days 'of receiving it. Your reply should provide proposed corrective actions with
implementation schedules for each of the violations outlined -above. Please note that violations of the
NCG030000 general permit are subject to civil penalty assessments not to exceed $25,000 per day,
per violation. Your written response will be considered in deciding whether any further action should
be taken.

It should also be noted that once these deficiencies are sufficiently corrected, the site may
want to consider applying for Representative Outfall Status (ROS), which may reduce the number of
SDOs at which you're required to perform AM.

Submission of this No Exposure Certification constitutes notice that your facility does not r d , pem�it
authorization for its storm water discharges associated with industrial activity in the State of !�
Carolina because it qualifies for a no exposure exclusion. A condition of no exposure at an ind1
facility means all industrial materials and activities are protected by a storm resistant shelter (wit. e
exceptions) to prevent exposure to rain, snow, snowmelt, and/or runoff. - Cl%
Industrial materials or activities include, but are not limited to: material handling equipment or activws,
industrial machinery, raw materials, intermediate products, by-products, final products, or waste `
products. Material handling activities include the storage, loading and unloading, transportation, or
conveyance of any raw material, intermediate product, final product or waste product. A storm resistant
shelter is not required for the following industrial materials and activities: drums, barrels, tanks, and
similar containers that are tightly sealed, provided those containers are not deteriorated and do not leak.
"Sealed" means banded or otherwise secured and with locked or non -operational taps or valves;
adequately maintained vehicles used in material handling; and final products, other than products that
would be mobilized in stormwater discharges (e.g., rock salt).
A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion.
In addition, the exclusion from NPDES permitting is available on a facility -wide basis only —not for
individual outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the
facility is not eligible for the no exposure exclusion. By signing and submitting this No Exposure
Certification form, you certify that a condition of no exposure exists at this facility or site and are
obligated to comply with the terms and conditions of 40 CFR 122.26(g).
You are required to reapply for the No Exposure Exclusion once eve[y five (5) ears.

I certify under penalty of law that I have read and understand the eligibility requirements for claiming a condition of "no
exposure" and obtaining an exclusion from NPDES stormwater permitting.
I certify under penalty of law that there are no discharges of stormwater contaminated by exposure to industrial activities
or materials from the industrial facility or site identified in this document (except as allowed under 40 CFR 122.26(g)(2)).
I understand that I am obligated to submit a no exposure certification form once every five (5) years to the North Carolina
Division of Water Quality and, if requested, to the operator of the local municipal separate storm sewer system (MS4) into
which the facility discharges (where applicable). I understand that I must allow the North Carolina Division of Water
Quality, or MS4 operator where the discharge is into the local MS4, to perform inspections to confirm the condition of no
exposure and to make such inspection reports publicly available upon request.
In the event that the site no longer qualifies for a No Exposure Exclusion, i understand that I must obtain coverage under
an NPDES permit prior to any point source discharge of stormwater from the facility. Additionally, I certify under penalty
of law that this document and all attachments were prepared under my direction or supervision in accordance with a
system designed to assure that qualified personnel properly gathered and evaluated the information submitted. Based
on my inquiry of the person or persons who manage the system, or those persons directly responsible for gathering the
information, the information submitted is to the best of my knowledge and belief true, accurate and complete. I am aware
that there are significant penalties for submitting false information, including the possibility of fine and imprisonment for
