However, the following problems with 1. pH testing of the discharge is -NOT being conducted within 15 minutes of sample collection; 2. The company experienced an exceedence of the Total Suspended Solids (TSS) benchmark in May, 2010, but did not perform the required tier one actions in response to the exceedence, as required in Part II, Section B, of the general permit; and, 3. As stated above, the company is not performing AM at the SDO located on the southeastern corner of the property. Concerning qualitative monitoring (QM), Mr. Dickerson stated that he does conduct QM at the SDO located on the west side of the building, as required by Part II, Section C, of the general permit, but the QM has not been documented as required. Site Review The site was very clean and well maintained. Mr. Boone noted only one concern. The company manufactures counter weights for excavating machines. As part of that process, the company mixes its own concrete which it uses to fill the steel counter weights. The mixing drums of the concrete truck(s) are typically washed out and the waste is then dumped on the ground in a small area located on the northeast corner of the plant site. The water that drains from this waste concrete and the rainwater that incidentally fails on the piles of the waste concrete is then considered a wastewater. Currently, it appears that all drainage from this small area is captured by a stormwater drop inlet located just adjacent to the dump pile. The water is then conveyed through underground piping to the SDO located on the west side of the main building where it is then discharged. Unfortunately, this is considered to be an illicit discharge of wastewater. The company must take steps to eliminate the discharge. The company has many options'to achieve this, including but not limited to: 1. Finding another legal place to dump and/or dispose of the waste, 2. Constructing a series of holding basins that settle out solids as the water passes through each phase and that does not discharge (this can likely be achieved by constructing such. a system according to how much waste is generated daily), or 3. Purchasing premixed concrete from an outside source. Regardless of how the company ultimately decides to eliminate the illicit discharge of this wastewater, the selected process must be approved by this office. We will work with you to determine the best course of action. In the interim, you must minimize this illicit discharge by all means possible. Please correct all violations noted above as soon as practical. Please reply in writing to this letter within 30 days 'of receiving it. Your reply should provide proposed corrective actions with implementation schedules for each of the violations outlined -above. Please note that violations of the NCG030000 general permit are subject to civil penalty assessments not to exceed $25,000 per day, per violation.
