As we discussed Eaton has had monthly monitoring results below the zinc and copper benchmarks for the last three months. We commend Eaton on their efforts to limit stormwater exposure to the process. As stated in the permit, "monitoring shall continue until three consecutive sample results are below the benchmark values or within benchmark range." It appears that you have achieved this and can go back to semiannually sampling. I talked to Bethany Georgoulias, Environmental Engineer in our Stormwater Program in Raleigh and she confirmed that this interpretation of the general permit language. Eaton has initiated BMPs and process modifications to address zinc and copper benchmark exceedances. You indicated that you all have charted steady reductions in the zinc and copper sampling results as part of the triggered Tier II and III response. In fact you indicated that the last sampling results were below the benchmarks, and that you all continue to implement modifications to address any potential exposures. As we discussed, you should continue your monthly sampling of the outfali with the exceedances, but can limit the analytical monitoring to only zinc (total recoverable) and copper (total recoverable). Please note that for the required semi-annual sampling, all discharge characteristics in the permit should be monitored. Thanks, Jason Morgan Ms. Laura Herbert C�j Regional Supervisor �p North Carolina Department of Environment and Natural Resources Division of Land Resources�,�, 2090 U.S. Highway 70 Swannanoa, NC 28778 RE: Eaton Corporation General Permit No. NCG030000 Dear Ms. Herbert: Eaton Corporation operates a metal finishing facility in Arden, North Carolina which has coverage under the Metal Fabrication General Permit No. NCG030000 ("Permit"). Beginning in 2013 the facility began sampling the stormwater and comparing the analytical results to the benchmark values as required by the Permit. The facility has had four exceedances of the benchmark values at outfall SW-01. As required by the Tier Three response actions in the Permit, Eaton is providing notification of benchmark value exceedances. This Tier Three notification is for outfall SW-01 and for metals copper and zinc. A spreadsheet summarizing the analytical results and the laboratory reports are attached. As a result of the exceedances of the benchmark values, Eaton initiated the response actions for Tier One and Tier Two required in the permit to limit the impact of these metals on the stormwater. These actions include: • Comprehensive weekly inspections of the "backyard" area have been and continue to be conducted. These inspections have identified several potential factors that may contribute to the stormwater impacts. Actions have been taken to cover or tarp certain areas and materials have been relocated to covered areas to prevent contact with stormwater. • Implemented twice weekly floor sweeping of the facility with emphasis on the copper and steel fabrication areas. • instituted procedures that limit the number of employees with access to the backyard area by use of badged access. • Review of the BMPs. Eaton believes the BMPs are properly installed and working to minimize the impact on stormwater. Eaton has also reviewed the manufacturing activities to identify potential sources of copper and zinc. The facility operates an enclosed fabrication area which utilizes copper. It is possible that residue is carried out of the shop on fork lifts wheels. As a result of this finding the twice weekly floor sweeping program was implemented. Also, "test to destruction" switchgear is disassembled in the backyard to recover copper for recycling. This switchgear was not covered and an action was put in place to tarp completely unless actively disassembling. Additionally, an exposed scrap wire hopper was identified as a potential source of copper and has been eliminated through a process change. There is also a truck that transports copper which parks in the "backyard" that could be a potential source of copper. The potential sources of zinc include a metal roller system that is used to transport product down the assembly line which was temporarily placed in the backyard and uncovered. This conveyor system has been removed from the backyard. Zinc is also present in the chain link fencing and in the galvanized stormwater piping. Eaton has also carefully reviewed the analytical data and the sampling activities. Samples were collected on June 2, 2013; November 26, 2013; January 28, 2014; February 10, 2014. See the attached spreadsheet of the sampling dates and analytical results. Eaton believes the samples collected on June 2 and November 26 are representative of the stormwater. However, the sample collected on January 28 is actually snow melt and not actual discharge. The sample collected on February 10 was actually more of a trickle and not an actua isc arge since it was light snow and not raining. Additionally, due to the difficulty in collecting an adequate sample, the sample container opening may have come into contact with the soil. Eaton believes the analytical data associated with the January and February samples are not representative of the stormwater and should be discarded for purposes of comparison of the analytical results with the benchmark values. Following the implementation of the response actions, the analytical results from the November sampling looked very similar to the June sample results. It did not appear that the response actions had resulted in any impact on the copper and zinc concentrations in the stormwater. Additional response actions have been taken subsequent to the receipt of the !November sampling results. However, we believe the last two sampling events should not be utilized to evaluate the benchmark values. Therefore we believe it may be too early to conclude the response actions have not had a positive impact on the stormwater. Eaton believes additional stormwater sampling should be conducted to collect more representative data to compare with the benchmark values to further evaluate the impacts of the response actions that have been taken at the facility before concluding the response actions have had not result on the stormwater impacts. While Eaton has promptly responded with follow-up actions and continues to inspect the drainage area and evaluate to facility conditions for opportunities to reduce impacts to stormwater, Eaton believes that more sampling is needed to further evaluate the conditions and actions taken. We propose collecting four additional representative samples over the next four months (one per month) provided that stormwater flow is available for sampling.
