Con SECRETARY 091057 Dear Madam: Subject: Notification for Nationwide Permit 14 (Minor Road Crossing) NCDENR 401 WQC 3704 Culvert Replacement SR 1104, James Pair Rd- Bladen County State Project Number: 41885.2.1 TIP#: W-5121 The North Carolina Department of Transportation (NCDOT) proposes to improve the intersection of NC 131 and NC 41. The intersection has been identified as hazardous to the motoring public by NCDOT Traffic Services. NC 131 will be offset approximately 800 feet to the West. Totally project length is 0.88 miles. This project will require the replacement of one (1) intermittent stream crossing as shown below: Crossin Roadway Station Existing Culvert Proposed Culvert Permit site #1 Sta. 13+57 Y3 42 LF 24" RCP 72 LF 42" RCP 38 LF 36" CMP New Stream Impacts = 0 linear feet Construction of this project will require impacts to the waters of the United States in the Lumber River Basin. Permit site 41 conveys drainage to an UT to Bear Ford Swamp (Class C, Sw). The project is located within the 03040203 Hydrologic Unit, sub basin 03-07-53. Permit Site #1 is located at (Sta. 13+57), along the relocated intersection of SR 1104 (James Pait Rd) and NC 131 (Y3). There is currently a 42LF 24" CMP that carries water from an intermittent tributary of Bear Ford Swamp across SR 1104. This then feeds into a road side ditch; turns West and flows underneath afield road with an existing 38LF 36" CMP. A 72 LF 42" RCP will be installed under SR 1104 along a 110° skew. P. O. Box 1150, Fayetteville, NC 28302-1150 -Telephone (910) 437-0207- Fax (910) 486-1959 RESOURCE STATUS In general, there will be minor impacts proposed as a result of the replacement of the culvert along SR-1104 (James Pait Rd.) in Bladen County. A Nationwide Permit #14 / NCDENR 401 WQC 3704 is required for the project. Endangered Species: Plants and animals with Federal classification of Endangered (E) or Threatened (T) are protected under provisions of Section 7 and Section 9 of the Endangered Species Act of 1973, as amended. As of January 31, 2008, the U.S. Fish and Wildlife Service lists seven federally protected species for Bladen County. These species are not biologically endangered or threatened and Are not subject to Section 7 consultation. A biological conclusion of "No Effect" was reached for all species during the August 21, 2009 survey for protected species. Protected species were not identified, nor, was the general habitat for each species identified. REGULATORY APPROVALS Application is hereby made for a Department of the Army Nationwide Permit 14 / NCDENR 401 WQC 3704 as required by the above-described activities. The COE NWP #14 does not require notification. The National Register was reviewed in addition to conducting a field view of the project for significant historic features. The project impacts are minor in nature and should not remove or degrade existing water quality uses. Pipe sizes proposed are the minimum necessary to create a safe highway while accommodating the 25-year design storm. There is no record within the NCDOT District 3 Office (Bladen County) that the road experiences flood overtopping. By utilizing the erosion control measures, downstream water quality standards will be protected. All appropriate BMP's will be utilized during construction. NCDOT proposes to offset the intersection of NC 131 West of NC 41 to eliminate the numerous collisions that occur at the present location. 31b. NCDOT has obtained ROW through a farm field adjacent to James Pait Rd in order to place the new off-set intersection. Impacts will be minimized as much as possible. The culverts will be replaced utilizing a track-hoe excavator. While front end loaders will place fill material. Eventually a motor grader will finish grade the project prior to paving. 4.
