Dear Mr, Haley:
On June 30, 2004, at your request I conducted an on-site determination to review a surface water located on the
subject property for applicability to the Tar-Pamlico Buffer Rules (15A NCAC 2B ,0233). The surface water is
labeled as "04-0817" on the attached map initialed by Bob Zarzecki on June 30, 2004. Division of Water
Quality (DWQ) Staff from the Washington Regional Office (WaRO) had previously conducted an on-site
determination of the stream on November 26, 2003. In your letter dated May 4, 2004, you requested an appeal
of their determination as provided within 15A NCAC 02B ,0233(3)(a).
At your request, I conducted an appeal of their determination as stated above. During my review I evaluated the
stream using the DWQ Stream Classification Form. I evaluated.the streamreach located on thesubjectproperty
east of Corey Road (SRI709) and calculated the score to be 17 points, The form states that if the score is
"greater than or equal to 19 points the stream is at least intermittent". A dirt path existed along the south bank
of the surface water and large spoil piles existed along the north bank of the surface water.
The DWQ has determined that the surface water labeled as "04-0817" on the attached map is a "man-
made ditch" east of Corey Road (SRI709) and is exempt from the Neuse Buffer Rule. This determination
shall replace the determination originally performed by the Washington Regional Office. This on-site
determination shall expire five (5) years from the date of this letter.
This letter only addresses the applicability to the buffer rules and does not approve any activity within the
buffers, Nor does this letter approve any activity within Waters of the United States or Waters of the State. If

Dear Mr. Stephens
WATER QUALITY SECTION
Per our meeting this letter serves as formal appeal of a
NCDENR DWQ "Blue Line StreamH jurisdiction determination
made in the field by Ms. Maria Tripp on November 26, 2003.
See Attachment. This appeal is being submitted based on
further limnological evaluation of the subject watercourse,
watershed, land use and subsequent correspondence with you
and Mr. John Dorney. The following paragraphs characterize
the subject drainage area, watershed and drainage feature.
The evaluation site is located at approximately 350 33'
28" N, 770 21' 41" W ([35. 5578411N, 77.3616915 W], UTM 18
285983E 3937458N) south of Firetower Road (SR 1708) and
east of Corey Road (SR 1709) in Pitt County, NC (Fig. 1).
Figure 2 presents an aerial view of the subject area. The
project area is primarily wooded in the upper reaches of
the watershed and in the direction of Bells Fork
(intersection of Charles Blvd. and NC 43) and Firetower.
This Intersection is the approximate interfluve between the
Tar-Pamlico (north) and Neuse (south) river basins.
Outlying areas north, east, south and west of the subject
site are developed residentially. The subject site is
featured on USGS 7.5' series topographic map 1998 and soil
survey of Pitt County sheets 49 and 50 dated 1974. The
subject site and surrounding area is within the Rains soil
series, a hydric fine sandy loamy. Although considered a
hydric soil, the typical Rains pine flat does not always
exhibit redoximorphic indicators of hydric soils chroma.
This tract, (Taylor tract) was determined to be non-
jurisdictional (404 Wetlands) by the Army Corps of
Engineers during a field meeting on November 18, 2003.

The subject agricultural ditch (Blue Line Stream) was
originally constructed to drain land to the north and
south, Figure 4 (DOQQ aerial image) shows the area
surrounding the ditch, in use agriculturally during 1993.
This ditch is approximately 6' deep and deeply incised.
Bank erosion is occasionally present. This ditch enters the
subsequent tract at the northern corner of the Covenant and
Taylor properties and drains part of the Tucker Tract to
the north-northeast. The ditch bisects the Taylor and
Covenant tracts and exits the subject area through a
culvert under Corey Road. West of Corey Road the drainage
feature (although not shown on the 1998 USGS Topographic
map) eventually flows to Fork Swamp Creek.
The reach of the ditch along the subject tract typically
contains water through intercept of the surficial aquifer.
Flow is usually absent. The riparian area of the northeast
2/3 of the ditch maintains understory shaded by Red Maple
and sweet gum. The entire south length of the ditch is a
grass covered access trail. A flood plain or bench is not
present sinuosity is absent. The channel bed is homogenous
sandy silt and sediment transport exists during storm
events only.
During numerous site visits no fish, amphibians or aquatic
invertebrates were observed.
With all due respect to the previous judgements made
regarding this waterbody, the above characteristics and
reasons support my desire to have this waterbody carefully
re-examined. Therefore I am requesting your consideration
of a more thorough evaluation of the waterbody and formally
appeal the "Blue Line Stream" determination of November 26,
2003.

suggest should be delineated and surveyed. The surveyed wetland lines must be verified by our staff
before tlle Corps will make a final jurisdictional determination on your property.

your wetlands cannot be accomplished in a timely manner. You may wish to obtain a consultant to
obtain a more timely delineation of the wetlands, Once the consultant has flagged a wetland line on
the property, Corps staff will review it, and, ifit is accurate, we strongly recommend that you have the
line surveyed for final approval by the Corps. The Corps will not make a final jurisdictional
determination on your property without an approved survey.
The waters of the U.S, and/or wetlands, on your property have been delineated, and the limits of the
Corps jurisdiction have been explained to you, Unless there is a change in the law or our published
regulations, this determination may be relied upon for a period not to exceed five years from the date
of this notification,
