Division of Water Quality (DWQ) received your letter dated July 7, 2004 including an attached letter dated June 10,2004. In your June 10, 2004 letter you requested confirmation that a road crossing impacting streams, wetlands and/or buffers would not be approved by the DWQ unless there are no practical alternatives to such a road crossing and that the development generally must avoid and minimize impacts to surface water quality (and buffers) pursua~t to the 401 Water Quality Certification Rules, 15A NCAC 2H .0500 et seq. and the Neuse River Basin Riparian Buffer Rule, 15A NCAC 02B .0233. Your understanding is correct. Specifically, please refer'~o 15A NCAC 02H .0506(f)-(g) and 15A NCAC 02B .0233(8). These rules are available at htt{J:llh20.enr.State.nc.us/admin/rules/. Please note that most road crossings are permitted by the U.S. Army Corps of Engineers (USACE) under Nationwide Permits (usually 14 or 39) and by the DWQ under associated General Water Quality Certifications (3404 and 3402 respectively). A list of current Nationwide Permits is available on the USACE website at http://www.saw.usace.army.millwetlands/ general&nationwide permits.html #N ationwide%20Permits. A list of current General Water Quality Certifications is available on our website at http://h20.ehnr.state.nc.us/ncwetlands/certs.html. In order to be approved under these Nationwide Permits and General Water Quality Certifications the road crossing would need to comply with all of the conditions of the Permit or Certification, including (in most cases) written authorization from the US ACE and DWQ. Please be aware that this letter does not approve any impacts to wetlands, streams and/or buffers. Development of the property is in the plarming stage. A road crossing of a stream and/ or wetlands has been discussed among parties interested in the development. The road crossing under consideration is depicted on the enclosed diagram. It is my understanding that such a road crossing would not be permitted unless there are no practical alternatives to such road crossing and that the development generally must avoid and minimize impacts to surface water quality pursuant to the 401 Water Quality Certification Rules, 15A N.CA.C 2H.0500 et seq. and the Neuse River Basin Riparian Buffer Rule, 15A N.CA.C 2B.0233.
