The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: All work authorized by this permit must be performed in strict compliance with the permit plans, which are a part of this permit. 2. No vegetated wetlands will be excavated or filled outside of the authorized area. 3. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands are not authorized. 4. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 5. No excavated or fill material will be placed in any location or in any manner so as to impair surface water flow into or out of any wetland area. 6. The permittee will maintain the authorized work in good condition and in conformance I' -2- with the terms and conditions of this permit. The perrnittee is not relieved of this requirement if he abandons the pennitted activity without having it transferred to a third party. 7. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 8. After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3351 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and LAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. PROJECT SUMMARY: The applicant proposes to make improvements to an existing waterfowl impoundment located near SKYCO, on Roanoke Island, Dare County and on the Roanoke Sound. PROJECT SETTING The project is located on a 3,000-acre tract located south of US 64/264 and east of NC 345 in the SKYCO area of Roanoke Island, Dare County. Nearly all the property is a Coastal Wetland marsh vegetated mostly with Juncus roemerianus with areas-of-CladumZeeTal manmade-mosqu itGhe&agd-caeals-w+th--water-dept#s-of-2-and-3 feet-are-iesated-ea-the property that connects to Shallowbag Bay and Roanoke Sound. Old spoil piles located adjacent to the canals and ditches and an existing hummock located on the north side of the impound are vegetated with pines. Other manmade features on the property consist of a waterfowl impoundment area that includes a diked impoundment pond, a surface water pump, an electrical service, a soil service road which has an existing culvert crossing of a canal, and approximately 600 feet of riprap along the north side of the dike. The adjacent property to the south is a continuation of the marsh, and US Highway 64/264 is located on the north side. The waters of Shallowbag Bay are classified as SC by the Division of Environmental Management and are closed to shellfish taking. The waters of Roanoke Sound in this area are classified as SA by the Division of Environmental Management and are closed to shellfish taking. DEVELOPMENT PROPOSAL In order to provide public access and improve the impoundment area, the applicant proposes the following improvements to the property: 1) Construct a 60 feet by 80 feet parking area with two, 15 feet wide access driveways to NC 345. The parking area surface will be crushed stone. 2) Construct a walking trail from the parking area, across an adjacent ditch by means of a new footbridge 6 feet wide and 34 feet long, to the existing service road. 3) Rehabilitate and improve the existing service road by covering with a 6-inch layer of reject aggregate approximately 15 feet wide. The existing dike serves as the roadbed around the impoundment. 4) Rehabilitation of the existing dike by adding fill material to increase the height of the dike approximately one foot. The applicant proposes to excavate a borrow ditch along the inside of the impoundment as a source of fill material. FIELD INVESTIGATION REPORT: NCWRC, Roanoke Island Marshes Conservation Project PAGE 3 5) Install a new electrical service, water pump, supply culvert (pipe) 12-inch diameter and 40 feet long, with two, 15 feet long bulkhead portals to protect the pipe. Approximately 450 square feet of the existing canal bottom will be covered with a 12-inch layer of Class B stone riprap at the intake, and approximately 300 square feet of the impoundment bottom will be covered with stone in a like manner. 6) Install a new 24-inch diameter water control structure with an armored spillway on the southeast dike side to drain into the existing perimeter ditch. 7) Excavate a new 300 feet long, 8 feet wide, -2 feet deep ditch to connect the existing canal system, which is the side of the proposed water supply pump to the existing perimeter ditch. The existing perimeter ditch is not connected to any water body, and the applicant is proposing to connect the ditch to the nearby canal and mosquito ditch system to improve circulation. 8) Refurbish 600 feet of existing riprap along the inside of the impoundment area to aid with stabilizing the dike as needed. This material will be removed and salvaged and replaced after the dike has been rehabilitated. 9) Construct approximately 1,300 feet of 6 feet wide walking trail and two, 12 feet by 16 feet elevated wildfowl observation platforms. ANTICIPATED IMPACTS The development proposal will result in the following impacts: 1) Parking area will result in covering approximately 3,300 square feet of Estuarine Shoreline (ES) Area of Environmental Concern (AEC) with crushed stone. Approximately 2,100 square feet of coverage with stone will be located outside of the AEC. 2) Construction of the trail and bridge from the parking area to the service road will result in 240 square feet of ES covered with stone, 144 square feet of ES Shaded, and 60 square feet of Public Trust Area and Estuarine Waters AEC's being shaded. 3) The rehabilitation of the service road and dike will result in the coverage of approximately 22,400 square feet of ES and 105,600 square feet of dike located outside any AEC. 4) Approximately 125,000 square feet of the impoundment bottom will be disturbed during excavation of the fill material. 5) The new water supply pump structure and water control structure will result in the filling of approximately 450 square feet of PTA, EW, AEC and 300 square feet of impoundment bottom. 6) The proposed connecting ditch will result in 2,400 square feet of Coastal Wetlands AEC being excavated and approximately 177 cubic yards of marsh material being excavated. The excavated material will be used for dike rehabilitation. The observation platform will shade 512 square feet of uplands and 512 square feet of ES AEC. 9) Temporary water turbidity will occur during construction.
