Dear Mr, Wicker:
This lettcr provides the comments of the U. S, fish and Wildlife Service (Scrvice) on the
subject Public Notice (PN), dated June 29, 2004. The applicant, Paul M. Kester, has
applicd for a Dcpartmcnt of the Army (DA) permit to add two sections of floating dock to
an existing dock, construct two boat lifts, and perform maintenance dredging of 3,000
squarc feet (fe), These comments are submitted in accordance with the Fish and Wildlife
Coordination Act (FWCA) (48 Stat. 401, as amended; 16 U.S,C. 661-667d), Comments
related to the FWCA are to be used in your detcnnination of compliance with 404(b)(1)
guidelincs (40 CFR 230) and in your public intcrest review (33 CFR 320.4) in relation to
the protection of fish and wildlife resources. Additional comments are provided
regarding the District Engineer's detern1ination of project impacts pursuant to section 7
of the Endangered Species Act (ESA) of 1973, as amended (16 U.S,C, 1531-1543).
Proposed Activities
The proposed construction and dredging would occur at an existing pier adjaccnt to
Sunset Lagoon at the eastern cnd of Lee's Cut. The pcrn1it application of the North
Carolina Division of Coastal Managcment (NCDCM) states that existing water depths at
the area to be dredged are zero to two feet at mean low water (ML W), The Field
Investigation Report (FIR) of the NCDCM states that a barge mounted excavator would
be used to remove 225 cubic yards of material to crcate a depth of four feet at ML W,
Project drawings (Sheets 1 and 2) with the NCDCM application indicate that water
depths immediately waterward of the proposed work may be four feet at Mcan High
Water.
Federally Protected Species
The Service has reviewed available information on federally-threatencd or endangered
species known to occur in New Hanover County, We have also reviewed information
from the North Carolina Natural Heritage Program (NCNHP) database which contains
excellent data on the special status species, both federal and state, This database can be
accessed by topographic quadrangle (quad) of the U. S, Geological Survey (USGS)" Data
from USGS quads provide the most project-specific information on species which should
be considered in pern1itting this project. The project area is located in the Wrightsville
Beach quad, The occurrence data of special status species within these quads can be
obtained on the internet at < httn://w\V\V.ncsnarks.net/nhp/quad.html >,
Our review indicates that the only federally listed species likely to occur in the project
area is the West Indian manatee (Triclzeclzus manatus), a federally-endangered mammal.
The species is known to occur in New Hanovcr County and the NCNHP database
indicates two manatee occurrences in the estuarine water of Banks Channel south of the
project area, The shallow, estuarine waters west ofWrightsville Beach may providc
suitablc habitat for manatees that move along the Atlantic Coast during summcr months
and arc scasonal transients in North Carolina, primarily from June through October.
Manatecs feed in water one to two meters (3.3 -6.6 fect) deep that may support
submergcd aquatic vegetation, The specics moves extensively when in North Carolina
waters and past occurrencc records cannot be uscd to precisely detem1ine the likelihood
that it will be prcsence at a particular construction site.
The bargc mountcd excavator poses a risk to manatees. To protect manatees in North
Carolina, thc Service developed guidelines entitled "Prccautions for General Construction
in Arcas Which May Bc Used by the West Indian Manatee in North Carolina." These
guidelines address all types of in-water construction, cxcept blasting, and should produce
little, if any, additional expensc. The guidelines are intcnded mainly to ensurc that
construction pcrsonnel are informed that manatccs may occur in the work area, that work
should ccase if a manatce approaches the work area, work should not resume until the
manatee leaves the work area, and procedures for reporting the death or injury of a
manatee. These guidelines are availablc on our web sitc at < httn://nc-

an acceptable lcvel by the implcmentation of the Service's guidelines. The risk would be
further rcduced by performing the work during the period of November through May,
Service Recommendations
With the inclusion of our manatee guidelines, the Service would concur with a
dctcrmination by the District Engineer that the action is not likely to adversely affect
species designated as threatened, endangered, or their designated critical habitat. Based
on the availablc information, we do not believc that the proposcd activity will have
significant adverse and/or irreversible effects on general fish and wildlifc resources under
our jurisdiction, Therefore, with prudent measures to protect manatees the Service has no
objection, from thc standpoint of fish and wildlife, to the issuance of a DA permit for the
proposed work.

9. PROJECT DESCRIPTION:
The project site is located at 1 Bahama Drive, adjacent to Sunset Lagoon located at the eastern end of Lee's Cut,
between the Atlantic Intracoastal Waterway and Wrightsville Beach in Middle Sound, The site is located in the
Wrightsville Beach township, in New Hanover County. To get to the site, take NC Hwy 74 (Eastwood Road)
from Wilmington to Wrightsville Beach, Cross over the draw bridge in Wrightsville Beach and take a left at the
first stop light (N, Lumina Drive), Continue along N, Lumina Drive and turn left onto Parmele Drive. Take the
next left on Bahama drive and the subject property \vill be located on the right on the corner of Bahama Drive
and Bermuda Drive. The lot is approximately Y2 acre \vith approximately 114' of shoreline frontage, There is an
existing two-story single family residence located on the property, as well as an existing 6' x 50' pier, a 10' x 12'
platform and a 6' x 20' floating dock. The property elevation averages approximately 6.0 feet above mean sea
level.
The subject property contains an area of coastal wetlands, which averages approximately 114' in length and 40' in
\vidth, adjacent to the shoreline on the waterward (southeastern) side of the lot. Smooth Cordgrass (Spartina
alterniflora) is the predominant species along the waterward side of the marsh border, while Sea Lavender
(Limonium. spp.), intermixed with Spike Grass (Distichlis spicata), are found at slightly higher elevations. Salt
Meadow Grass (Spartina patens), Sea Oxeye (Borrichia frutescens) and Grounsel-bush (Baccharus halimifolia)
complete the transition to the high ground,
The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground
portion of the project area as Developed, The waters of the canal, which are included in the Wrightsville
Recreational Area, are classified SB# by the Division of Water Quality. They are NOT designated as a Primary
Nursery Area by the N.C, Division of Marine Fisheries and they are CLOSED to the harvest of shellfish,
The applicant is proposing to construct a new section of floating dock to add to the existing dock. The applicant
has proposed to install two (2) 6' x 18' sections of floating dock on both ends of the existing dock and to construct
two (2) 13' x 14' boatlifts on the eastern side of the proposed dock expansions, The applicant has also proposed to
perform maintenance dredging in the area surrounding the floating dock and proposed boatlifts. The applicant is
proposing to remove approximately 225 cubic yards of material from the area surrounding the proposed dock and
boatlifts. The dimensions of the dredging would include a 30' x 100' X -4,0' area, as measured at Mean Low Water
(ML W). The material would be removed by a barge mounted excavator, then placed onto the barge and
transported to an existing spoil disposal island located on the southern side ofMott's Channel in Wrightsville
Beach, The applicant has obtained permission from the owners of the spoil island to place the proposed dredged
material on the site,
10, AI,TICIPATED IMPACTS:
The proposed project would result in the incorporation of an additional 216 square feet of estuarine waters and
public trust area, The proposed maintenance excavation would result in the disturbance of 3,000 square feet of
shallow bottom and 3,000 square foot of high ground, The project would create approximately 225 cubic yards of
spoil material to be transported offsite, No significant depression areas are expected in the shallow bottom and
open water areas due to the rapid increase in depth from the shoreline out to the channel (1 ft, drop in elevation
for every ten ft. towards the channel), There would be increased turbidity levels during project activity, however,
if timed to avoid periods of peak biological activity, no long-term adverse impacts are anticipated,
