Dear Mr. Williams:
The Pretreatment, Emergency Response and Collection Systems (PERCS) Unit of the Division of
Water Resources has reviewed the industrial user pretreatment permit (IUP) renewal for the
following significant industrial user (SIU) submitted by the City of Brevard. This IUP was received
by the Division via email on September 6, 2019.

The review indicates that with the following comments, the IUP is adequate and meets the
minimum requirements of 15A NCAC 2H .0905 and .0916 and 40 CFR 403.8(f)(1)(iii). The
allocation table, maintained in the Division's database, has been updated accordingly.
1. Pretreatment Unit: non -aeration equalization tank was checked in the application, while
the permit indicates that they have aeration. Please clarify and modify the permit or
application as applicable before November 1, 2019.
2. Monitoring diagram: A diagram was not included in the renewed permit. An older version
was found in the previous permit, please confirm no changes has been made to the
monitoring location. Otherwise, submit an updated diagram to PERCS file. Please also
make sure the industry has a copy in their IUP.
3. The signature date should always be before the effective date, so it is not retroactive and
the industry can get a copy before the permit goes in effective.
4. The duration for an IUP could be up to 5 years, but the current permit lasts only 3 years.
A permit modification is allowed to extend the current permit for 2 more years.

5. The 2H rule was approved in March 2019 and started to require IUPs be submitted 30
days in advance of the effective date.
Federal and State pretreatment regulations require the local delegated pretreatment program
to effectively control and document the discharge of wastewater from Significant/Categorical
Industrial Users to the POTW. It is the POTW's responsibility to ensure that these objectives are
consistently met.
