After reviewing your application, we have determined that this project is covered by Water Quality General Certification Number 3373, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands. The General Certification allows you to use Regional Permit No. 198200030 once it is issued to you by the U.S. Army Corps of Engineers (USACOE). This letter also serves as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0243. Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. The above noted Certification will expire when the associated USACOE's 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing, and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter; and is thereby responsible for complying with all conditions. If the total wetland fill for this project (now or in the future) exceeds one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached Certification, as well as the additional conditions listed below: 1. All stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers so as not to re-concentrate before discharging into the stream (as identified in 15A NCAC 28.0243 (5)). 2. No trees are to be removed (except those along the immediate shoreline) from the buffer, and impacts to the ground cover shall be kept to a minimum during the construction of the seawall. 3, Upon completion of the project, the applicant/responsible party shall complete and return the enclosed "Certificate of Completion" form to the Division of Water Quality's 401/Wetlands Unit. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.c. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The permit application indicates that the project will install 140' of Allan Block wall with a river rock base. This office prefers the use of a more "natural" approach to shoreline stabilization. A combination ofriprap used to two feet above normal pool elevation with banks sloped back and vegetated with grass, willows or other acceptable vegetation create a more "natural" bank. A filter fabric must be used in order to prevent soil from eroding from behind the riprap during high-water and/or wave action. Riprap should be imbedded into the lake bottom to prevent undercutting. We do not support the use of river rock iflnstream mining is used to obtain the rock. The following recommendations should be considered during 401 Certification issuance: 1. The stabilization project should be done with minimum class I (class II preferred) riprap or rock. This size rock improves aquatic habitat structure. We do not support the use of river rock as mining river rock causes impacts to aquatic environments and destabilizes riparian zones by causing unnatural geomorphic regime modifications. To the extent practicable, rock or stone should be placed just above the high water mark and towards the lake 5-6 feet or further to provide continuous aquatic edge habitat. Rock should not be extended to the normal waters edge in order to preserve aquatic beach habitat. 2. Any Large Woody Debris (L WD) should be maintained to the maximum extent practicable to provide aquatic habitat. If relocated, the L WD must be securely anchored so that it will remain where installed. Three L WDs were observed by Mr. Brown. 3. Stringent erosion control measures should be installed where soil is disturbed and maintained until project completion. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 10 days of ground disturbing activities to provide long-term erosion control. 4. Disturbed banks may be revegetated with silky dogwood (Corn us amonwn), silky willow (Salix sericea), tag alder (Alnus serrulata), black willow (Salix nigra), and sycamore (Platanus occidentalis) or other native plants to provide long term bank stability and stream shading. Note that silky dogwood, silky willow and black willow can be planted as live stakes collected during the dormant growing season. Cuttings should be randomly planted and done on 4 foot centers from the waters edge to the top of the bank. Trees should be planted on 10-12 foot centers. Banks in these areas should also be seeded with an approved wetland seed mix or temporary crop of wheat or rye. 5. Wide undisturbed shoreline buffers and natural vegetation should be maintained and Catawba buffers rules should be followed to the extent practicable.
