Modification Request of Southwest Quadrant Road Crossings 11 & 16, and of Special
Condition "L"
Dear Ms. Gibby, Mr. Deal & Ms. Higgins:
Please consider this letter a formal request on behalf of the Permittee for modifications to
Crossing #'s 11 & 16, along with a modification of Special Condition "L" of the approved Individual
Permit No. SAW -2008-01712 issued on April 22, 2010, January 9, 2013, October 3, 2016,
December 14, 2016, and July 12, 2017 and Individual Certification No. 3766 (DWQ Project
#20061804, Ver.3) issued on March 15, 2010, February 22, 2013, November 10, 2016,
December 22, 2016 and July 10, 2017.
In 2010 during the review of the initial permit application, it was discussed that the project
engineer would not be able to provide a detailed design of the stream crossings. As such, it was
agreed upon by Jean Gibby with the US Army Corps of Engineers (USACE) and the permittee
that if the detailed design differed from the original design authorized, and the changes were
minimal, that the modification of the road crossings could come in for a final administrative
review. This request includes the relocation of the previously authorized Crossing #'s 11 & 16,
and the modification of the proposed stream and wetland impacts. Crossings #17 within the
Southwest Quadrant of the Village is not anticipated to change.
Crossing #11:
In the original approval, the permittee was authorized to impact 60 linear feet of permanent and
20 linear feet of temporary Perennial/Important stream for Crossing #11. Since that time, the
road infrastructure within the southwest quadrant of the Village at Flowers Plantation has been
reconfigured to a "Parkway" alignment and crossing #11 has been shifted up the stream
approximately 460 feet. This relocation is necessary to 1) shorten the overall Southwest Flowers
Parkway length, and 2) to generate a better proportion of the land inside and outside the
parkway. This separation with the parkway is needed to separate single-family vs. townhomes
vs. commercial use. With this modification request, the permittee is proposing 52 linear feet of
permanent (i.e. culvert) and 49 linear feet of temporary (i.e. construction activities) stream
impacts for this road crossing. Please see table #1 summarizing previously approved impacts
and the proposed modifications to Crossing #11 R.
Crossing #16:
In the original approval, the permittee was authorized to impact 95 linear feet of permanent and
20 linear feet of temporary Intermittent/Unimportant stream for Crossing #16. Since that time, the
road infrastructure within the southwest quadrant of the Village at Flowers Plantation has been
reconfigured to a "Parkway" design and crossing #16 has been shifted up the stream
approximately 190 feet. This relocation is necessary to provide a 2" a point of ingress/egress from
the future Lot #7 development. With this modification request, the permittee is proposing 50 linear
feet of permanent (i.e. culvert) and 33 linear feet of temporary (i.e. construction activities) stream
impacts, and 547 ft2 of temporary wetland impacts (i.e. construction activities) for this road
crossing. Please see table #1 summarizing previously approved impacts and the proposed
modifications to Crossing #16.
Crossing #17:
In the original approval, the permittee was authorized to impact 312 ftz of permanent non -riparian
wetland, and 40 ftz of temporary non -riparian wetland for Crossing #17. At this time, there are no
anticipated changes to this proposed crossing.

In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance with the
provisions outlined on the most recent version of the attached Compensatory Mitigation Responsibility Transfer
Forms. The requirements of these forms, including any special conditions listed on these forms, are hereby
incorporated as special conditions of this permit authorization".
The Southwest Flowers Parkway and internal collector roads within this modification request
include Phase 6 in the above table. The proposed mitigation plan includes 52 linear feet of
stream mitigation (#11 at 2:1, with 1:1 included within original preservation) and 0.007 acres of
non -riparian wetland mitigation (#17 at 1:1 with riparian wetland credits). These mitigation ratios
are proposed as they were approved within the original Individual Permit Authorization.
In an effort to follow current mitigation policies, the Permittee authorized us to contact private
mitigation banks seeking compensatory mitigation credits. Requests were sent to Resource
Environmental Solutions, Restoration Systems and Wildlands Engineering, Inc. requesting stream
credits, no stream credits were available within the Neuse Basin -03020201 HUC at this time.
Therefore, a request was sent to the North Carolina Division of Mitigation Services (NCDMS), see
attached Acceptance letter for 52 LF of stream credits. Additionally, a request for non -riparian
wetland credits was sent to Resource Environmental Solutions, see attached Statement of
Availability letter with the sponsor of the EBX-Neu-Con Wetland & Stream Umbrella Mitigation
Bank specifically 0.01 riparian wetland credits from the Hannah Bridge Site.
Fish & Wildlife Values (33CFR320.4(c)):
A pre -application meeting was held on June 17, 2019 with Jean Gibby and Joshua Deal of the
USACE. In that meeting, and post -confirmation from the US Fish & Wildlife Services (USFWS), it
was requested that the streams in the action area and downstream be inspected for suitable
habitat for the listed and proposed mussels and fish. S&EC evaluated the property and the action
areas on August 6, 2019. S&EC conducted site assessments to identify potential suitable habitat
and preliminary surveys for the individual species listed on the official species list. This included
assessing the physical characteristics of the streams, identifying the forest types and looking for
evidence of the listed species onsite. Additionally, S&EC completed a Self -Certification through
the USFWS and submitted a project review through the North Carolina Natural Heritage Program.
The results of the above was sent to USFWS on August 21, 2019 requesting concurrence of our
findings. To date, we have not received a response from the USFWS. A copy of our
concurrence request is attached for reference.
Stormwater Management:
According to the Individual 401 Water Quality Certification Approval Certification No. 3766,
Condition No. 9, "a final, written stormwater management plan for each phase of this project shall
be submitted to the DWQ 401 Oversight/Express Permitting Unit for review and approval". The
project engineers submitted a Stormwater Management Plan for review & approval earlier this
year, please see attached Approval of Stormwater Management Plan for the Publix at Flowers
Plantation, reviewed and approved by NCDWR.

This document confirms that River Dell Companv, Inc. (Applicant) for the Village at Flowers
Plantation -SW Quad (Project) has expressed an interest to utilize 0.01 Riparian Wetland Mitigation
Credits from the EBX-Neuse sponsored Neu -Con Wetland & Stream Umbrella Mitigation Bank,
specifically 0.01 front the Hannah Bridge Site in the Neuse HUC 03030201. As the official Bank
Sponsor, EBX-Neuse 1, LLC, attests to the fact that mitigation is available for reservation at this time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank actino« ledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits/units.
The Banker sill issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the
purchase price. Banker shall provide to Applicant a copy of the Mitigation Credit Transfer Certificate and
a documented copy of the debit of credits from the Bank Official Credit Ledger(s), indicating the permit
number and the resource type secured by the applicant. A copy of the Itlitigation Credit Transfer
Certificate, with an updated Official Credit Ledger will also be sent to regulatoq- agencies showing the
proper documentation.

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in -
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved You must also comply with all other state, federal or local government permits_, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will
expire. it is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy
of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must
be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an applicant is
calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation
required and assigned to DMS for this impact is determined by permitting agencies and may exceed the
Impact amounts shown below. _

Dear Ms. Flowers:
On August 6, 2019, Soil & Environmental Consultants, PA (S&EC) evaluated the Southwest Flowers
Plantation property shown on the attached maps for potential endangered species. The property is located
on the southwest quadrant at the intersection of Buffalo Road and Highway 42 in Johnston County, NC.
Surface waters on this site flow into the Neuse River in the Neuse RiN-er Basin, which has been classified
in "Classification and NC DWQ Standards Applicable to Surface Waters and Wetlands of North
Carolina" as WS -IV; NSW.
We obtained the attached automatically generated official species list from the U.S. Fish & Wildlife
Service (FWS) and N.C. Natural Heritage Program (NHP) report identifying the protected species on or
within one mile of the project area that could potentially be affected by the project. These FWS & NHP
reports were updated as of the date of this report. The official species list is valid for 90 days.
We conducted site assessments to identify potential suitable habitat and preliminary surveys for the
individual species listed on the official species list. This included assessing the physical characteristics of
the streams, identifying forest types and looking for evidence of the listed species onsite.
The results of the search are discussed below.

RESULTS:
The FWS official species list identified the following species:

Of the species identified on the official species list, the NHP did not identify any threatened or
endangered species within the project area or within 1 mile of the project area. Other State listed
species were found within the project area as listed in the attached NHP report.

of the project area.
FRESHWATER BIVALVE SPECIES
Our surveys included a preliminary survey of the streams on site for potential suitable habitat for
freshwater bivalve species. During this survey we looked for suitable habitat for the Atlantic Pigtoe,
Dwarf Wedgemussel, Tar River Spinymussel, and Yellow Lance. (Aote: This did not include a detailed
aquatic mussel surrey for the presence of mussels.) The suitable habitat for these species consists of
medium sized creeks to large rivers with excellent water quality. These species typically live in streams
with coarse sand and gravel with moderate to high flowing water. The streams within the project area did
not appear to contain suitable habitat. Several reaches of the streams onsite had no baseflow and were
filled with fine sand and silt. The streams are also small streams (+/- 2' to 5' wide) with no flow to low
flow baseflow conditions. See the attached photo report for findings. During our habitat assessment we
did not find any evidence of the bivalve species listed on the official species list.

Given the lack of known populations of the bivalve species, we concluded that the project would "not
likely adversely affect" these species.
OTHER FRESHWATER SPECIES
During the preliminary survey for the bivalve species we also looked for any suitable habitat for the
Carolina Madtom and the Neuse River Waterdog. These species are found in the Neuse River and the
Tar River Basins. The suitable habitat these species are found in is typically medium to large streams
and rivers with a moderate gradient and large bed material. These species also need riffles, runs and
pools. During our assessment we found no evidence of these species.
Since the lower section of the mainstream onsite could be considered suitable habitat, we concluded
that the project would "not likely adversely affect" these species.
RD -COCKADED WOODPECKER (Picoides borealis):,
S&EC personnel conducted preliminary surveys of suitable habitat (foraging and cavity trees) and
individual Red -cockaded Woodpeckers (RCWs) within the project area. We found no individual
RCWs within the project area. The NHP report did not list any known elemental occurrence within the
project area or within 1 mile of it. We found no ideal suitable habitat (e.g., Long Leaf pine forests)
within the project area. We did find marginally suitable habitat (loblolly pine stands and individual
older pine trees) within the project area. Given the lack of species present, but presence of marginally
suitable habitat we concluded that the project would "not likely adversely affect" RCWs.
MICHAUX'S SUMAC (Rhus michawch) :
S&EC personnel conducted preliminary surveys of suitable habitat within the project area. We visited
a known population of Michaux's sumac within Wake County prior to conducting our preliminary
surveys. We found no individual Michaux's Sumac species within the project area. The NHP report
did not list any known elemental occurrence within the project area. We found suitable habitat within
the project areas to include primarily disturb open areas along field and pond edges. Other sumac
species identified on site included Winged sumac (Rhes cop allinurri). Given the lack of species
present, but presence of suitable habitat and other sumac species, we concluded that the project would
"not likely adversely affect" Michaux's sumac.

CONCLUSION:
After completing the habitat assessments and preliminary surveys, S&EC completed the attached
"Species Conclusion Table" and "Self -Certification Letter". Using language typically used by the
FWS in their conclusion letters, we have concluded that it appears the proposed project is not likely to
adversely affect any federally -listed endangered or threatened species, their formally designated
critical habitat, or species currently proposed for listing tinder the Endangered Species Act (ESA).
We strongly recommend requesting a concurrence letter from the FWS.

To Whom It May Concern:
The species list generated pursuant to the information you provided identities threatened,
endangered, proposed and candidate species, as well as proposed and final designated critical
habitat, that may occur within the boundary of your proposed project and/or may be affected by
your proposed project. The species list fulfills the requirements of the U.S. Fish and Wildlife
Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended
(16 U.S.C. 1531 el see.).
New information based on updated surveys, changes in the abundance and distribution of
species, changed habitat conditions, or other factors could change this list. Please feel free to
contact us if you need more current information or assistance regarding the potential impacts to
federally proposed, listed, and candidate species and federally designated and proposed critical
habitat. Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 of the
Act. the accuracy of this species list should be verified after 90 days. This verification can be
completed formally or informally as desired. The Service recommends that verification be
completed by visiting the ECOS-IPaC website at regular intervals during project planning and
implementation for updates to species lists and information. An updated list may be requested
through the EGOS-IPaC system by completing the same process used to receive the enclosed list.
Section 7 of the Act requires that all federal agencies (or their designated non-federal
representative), in consultation with the Service, insure that any action federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally -listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally -protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or

If your project contains suitable habitat for any of the federally -listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally -protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle
Protection Act (16 U.S.C. 668 et seq.), and projects affecting these species may require
development of an eagle conservation plan (http://www.fws.gov/windenergy/

Publix at Flowers Plantation
Dear Ms. Flowers:
The Division of Water Resources (Division) recently reviewed the proposed stormwater
management plan (SMP) for the subject project as required by Individual 401 Water Quality
Certification issued by the Division on November 5, 2008. Submittal of the SMP satisfies the
stormwater condition no. 9 of the 401 certification for this phase of the project and is subject to
the requirements below.
The Division approves the SMP for Publix at Flowers Plantation (Lots #1, 5, and 7) consisting of
a wet pond including all associated stormwater conveyances, inlet and outlet structures, and
grading and drainage patterns depicted on plan sheets dated February 8, 2019, which are
incorporated by reference and are enforceable by the Division. The following conditions also
apply [I 5A NCAC 02H .0506(b)(5)]:
a) The maximum allowable drainage area for the approved wet pond shall be 1,744,297
square feet and the maximum allowable built -upon area within that drainage area shall be
858,546 square feet. Any changes to these allowable maximum areas shall require the
applicant to submit and receive approval from the Division prior to any construction or
modification of the current site.
b) The footprint of all stormwater management device(s) as well as an additional 10 -foot wide
area on all sides of the device(s) shall be located in either public rights-of-way, dedicated
common areas or recorded easement areas. The final plats for the project showing such
rights-of-way, common areas and easement areas, shall be in accordance with the approved
plans.

c) The approved SMP shall be constructed and operational before any permanent building or
other structure is occupied at the site.
d) The SMP may not be modified without prior written authorization from the Division.
e) Maintenance activities for stormwater management device(s) shall be performed in
accordance with the notarized O&M agreements signed by Ms. Rebecca Flowers of DWF
Development on January 30, 2019. The O&M agreement shall transfer with the sale of the
land or transfer of ownership/responsibility for the approved diffuse flow plan. The
Division shall be notified promptly of every transfer.
f) The applicant and/or authorized agent shall provide a completed Certificate of Completion
form to the Division within thirty (30) days of project completion or as soon as possible if
the project has already been completed. This form is made available online at
htt s://e ocs.de .ne. gov/Farms/Certificate-of-C m ietion.
g) Additional SMP(s) for future phases must receive written authorization from the Division
before any land disturbance, construction, or expansion of the new phase(s) may occur.
