Approval of 401 Water Quality Certification (GC3351) with Additional Conditions
Dear Messrs. Midgett and Crow:
You have our approval, in accordance with the attached conditions, to place fill material within
or otherwise impact 0.87 acre of wetlands and waters to perform maintenance dredging and to
fill a basin, construct a boat ramp, boat house, riprap, groin, bulkhead and bridge at your
properties as described in your application received by the Division of Water Quality (DWQ)
Wetlands/401 Unit on April 30, 2004. After reviewing your application, we have determined
that the Division of Water Quality (DWQ) General Water Quality Certification Number 3351
covers these water impacts. This Certification allows you to General Permit No. 198000291
when issued by the US Army Corps of Engineers (USACE). In addition, you should get or
otherwise comply with any other federal, state and local requirements before you go ahead with
your project including (but not limited to) erosion and sediment control regulations and CAMA.
Also, this approval to proceed witbyour proposed impacts or to conduct impacts to waters
as depicted in your application shall expire upon expiration of the 404 or CAMA Permit.

your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and

the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the
conditions listed in the attached certification and any additional conditions listed below.

2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant is required to
return the attached certificate of completion to the 401/Wetlands Unit, North Carolina
Division of Water Quality, 1650 Mail Service Cente~, Raleigh, NC, 27699-1650.
3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3351.
4. Deed Notifications
Deed notifications or similar mechanisms shall be placed on all retained jurisdictional
wetlands, waters and protective buffers in order to assure compliance for future wetland,
water and buffer impact. These mechanisms shall be put in place prior to impacting any
wetlands, waters and/or buffers approved for impact under this Certification Approval and
Authorization Certificate. A sample deed notification can be downloaded from the
401/Wetlands Unit web site at http://h20.enr.state.nc.us/ncwetlands. The text of the sample
. .deed- notification may be modified as appropriate to suit to this project.
Violations of any condition herein set forth may result in revocation of this Certification and may
result in criminal and/or civil penalties. The authorization to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application and as authorized by this
Certification, shall expire upon expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved
water impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the
date that you receive this letter. To ask for a hearing, send a written petition, which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings,
6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are
final and binding unless you ask for a hearing.

Dear Mr. Huggett:
Reference the application of Steve Midgett for a Department of the Army permit to
maintenance dredge a manmade canal and basin, place fill material within the basin, and
construct a bulkhead, boatramp, boathouse, and riprap, on property located off the Hebert Perry
Road, adjacent to Kitty Hawk Bay, in Kitty Hawk, Dare County, NOlih Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
I. All work authorized by this permit must be performed in strict compliance with the
permit plans, which are a part of this permit.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or
alter the structural work or obstructions caused thereby, without expense to the United States. No
claim shall be made against the United States on account of any such removal or alteration.
3. In order to protect juvenile shrimp and finfish, no excavation or filling will be permitted
between the dates of February 15 and September 30 of any year without the prior approval of the
North Carolina Division of Coastal Management.

4. All excavated materials will be confined landward of the mean high water (MHW)
elevation contour within adequate dikes or other retaining structures to prevent spillover of solids
into any vegetated wetlands or surrounding waters.
5. No vegetated wetlands will be excavated or filled.
6. Excavation will not exceed -4 feet below the elevation of mean low water (ML W).
7. The temporary placement or double handling of excavated or fill materials within waters
or vegetated wetlands are not authorized.
8. The fill material will be clean and free of any pollutants except in trace quantities. Metal
products, organic materials, or unsightly debris will not be used.
9. No attempt will be made by the pennittee to prevent the full and free use by the public of
all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not
interfere with the public's right to free navigation on all navigable waters of the United States.
10. The permittee will maintain the authorized work in good condition and in confonnance
with the terms and conditions of this permit. The pennittee is not relieved of this requirement if
he abandons the permitted activity without having it transferred to a third party.
11. The activity will be conducted in such a maImer as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTD's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTD's or less in trout waters, are not
considered significant.

This permit, issued on December 7. 2004 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
I) Due to the fact that the pedestrian bridge will end in coastal wetlands, the proposed pedestrian bridge is
hereby deleted.
Excavation
2) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted
between February 15 and October 31 of any year without the prior approval of the Division of Coastal
Management, in consultation with the Division of Marine Fisheries.
3) Excavation shall not exceed -4 feet below the nonnal water level. In no. case shall the depth of
excavation exceed the depth of connecting waters.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.

personnel when the project is inspected for compliance.

4) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
5) No excavation shall take place at any time in any area outside of the alignment of the area indicated on
the workplan drawings.
NOTE:
The permittee's contractor is advised to contact the U.S. Coast Guard at (910) 815-4895, ext. 108
to discuss operations and appropriate lighting, markers, etc. for all dredge equipment.
Spoil Disposal
6) All excavated materials shall be confined above the normal water line and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.
7) No spoil material is to be placed within 30 feet of the normal water line, except that which shall be used
to backfill the area behind the authorized bulkhead.
8) The disposal area effluent shall be contained by pipe, trough, or similar device to a point at or beyond
the normal water level to prevent gully erosion and unnecessary siltation. ,.
9) The terminal end of the pipeline shall be positioned at or greater than 50 feet from any part of the dike
and a maximum distance from spillways to allow settlement of suspended sediments.
10) A water control structure shall be installed at the intake end of the effluent pipe to assure compliance
with water quality standards.
11) The diked disposal area shall be constructed a sufficient distance from the normal water level or any
marsh to eliminate the possibility of dike erosion into surrounding wetlands or waters.

Bulkhead

12) The alignments of the authorized bulkhead shall be staked by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of construction. Failure to initiate
construction within 30 days, or erosion of the shoreline by' adverse weather conditions, shall require the
alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of
construction.
13) The bulkhead shall be constructed prior to any backfilling activities~: ( Ii, ,i I,
14) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.

15) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel.
16) The backfill material shall be clean and free of any pollutants except in trace quantities.
17) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
18) No backfill material is to be placed within 30 feet of the normal water line, except that which will be
used to backfill the area behind the permitted bulkhead. Any future request to place fill within this area
shall require a modification of this permit.
19) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead.
Concrete Boat Ramp
20) The concrete boat ramp shall be poured on high ground and pushed or placed into the water once
hardened. Live concrete shall not be allowed to contact waters of the State or water that will enter
waters of the State.
Boathouse and Courtesy Pier
21) This permit authorizes only the boathouse and courtesy pier located in or over the water that are
expressly and specifically set forth in the permit application. No other structure, whether floating or
stationary, may become a permanent part of this docking facility without permit modification. No non-
water dependent uses of structures may be conducted on, in or over public trust waters without permit
modification.
22) The boathouse, courtesy pier and associated structures shall have a minimum setback distance of 15 feet
between any parts of the structure and the adjacent property owner's riparian access corridor.
23) The boathouse shall not be completely enclosed or have side coverage more than one half the height of
the side, from the roof waterward. The footprint of the boathouse, as measured from the roof drip line,
shall not exceed 400 square feet. ' - ~- . .
24) The authorized boathouse shall be single story, and shall not be designed to allow for second story use.
25) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest. . .

26) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors should be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
Riurau Groin
27) The alignment of the authorized riprap groin shall be staked by a representative of the Division of
Coastal Man'agement within a maximum of 30 days prior to the start of construction. Failure to initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the
alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of
construction,
28) The riprap groin shall be setback 15 feet from the adjoining riparian access dividing line.
29) The offshore riprap groin section shall be setback 15 feet from the adjoining property lines and the
riparian access dividing line.
NOTE:
The setback may be waived by written agreement of the adjacent riparian owner. If such a
waiver is obtained, a modification of this permit wilI be require before initiating any construction
within the limits of the setback area.
30) The height of the permitted riprap groin shall not exceed one foot above the normal water level.
31) The riprap groin may not extend offshore more than 25 feet.
32) The riprap groin shall be marked at its end with yellow reflectors extending at least three feet above the
normal water level.
33) No backfill of the riprap is authorized by this permit.
Riurau and Wooden Marsh Enhancement Breakwaters
34) The alignments of the authorized riprap and breakwater for marsh enhancement shall also be staked by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse
weather conditions, shall require the alignments to be restaked by DCMWithin a maximum of 30 days
prior to the new expected start of construction. ' ;"

35) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite or
broken concrete.
36) During construction of the riprap and wooden marsh enhancement breakwaters, construction matting
shall be utilized when crossing any area of coastal wetland. The matting shall be removed immediately
upon completion of construction of the breakwaters.
37) This permit authorizes no backfill activities behind the authorized riprap and breakwater structures.
38) The, height of the permitted breakwater structures shall not exceed six inches above the normal water
level.
39) The wooden breakwater shall be constructed with an equal gap between each sheathing board totaling at
least one inch of open area for every linear foot of breakwater. The breakwater shall have at least one,
five foot opening at every 100 feet. The breakwater sections may be staggered and overlap as long as
the five foot separation between sections is maintained. Overlapping sections shall not overlap more
than 1 0 feet.
40) The permitted breakwater shall be constructed of treated wood, plastic lumber, metal sheet piles or other
suitable materials approved by Department personnel.
41) The riprap breakwater shall be marked at 50-foot intervals with yellow reflectors extending at least three
feet above normal water level.

42) The offshore breakwater section shall be setback 15 feet from the riparian access dividing line. The line
of division of riparian access shall be established by drawing a line parallel to the channel, then drawing
a line perpendicular to the channel line that intersects with the shore at the point where the upland

Sedimentation and Erosion Control
NOTE:
An Erosion and Sedimentation Control Plan may be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. The applicant
should contact the Town of Kitty Hawk to initiate this process.

43) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
44) Appropriate sedimentation and erosion control 'devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
45) All disturbed areas shall be properly graded ~d p"rovided a, gro~4. co~er sufficirnt to restrain erosion
within thirty days of project completion. . .

Stormwater Manag:ement
46) The N.C. Division of Water Quality approved this project under stormwater management rules of the
Environmental Management Commission under Stormwater Permit No. SW7040625 on 9/30/06. Any
violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit.
General
47) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
48) All material resulting from the removal of the existing docking facility structures and pedestrian bridges
shall be placed on an approved upland disposal site.
49) No excavated or fill material will be placed at any time in any vegetated wetlands or surrounding waters

50) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

PROJECT SETTING
Messrs. Midgett and Crow own adjacent residential lots located near the south end of Herbert
Perry Road (SR 1213) in the Village of Kitty Hawk in Dare County. Both of these 4/1O-acre
parcels front an old 250 feet long "L"-shaped basin off Kitty Hawk Bay. Three dilapidated piers
ranging 5 feet to 10 feet in length, once used to moor commercial fishing boats, line the western
shoreline of the basin. Silt and sand measuring 2.5 to 4.0 feet in depth has accumulated within the
basin such that the water depths range 0.0 to 2.3 feet at Normal Water Level (NWL).
To access the site, turn west off US Highway 158 onto West Kitty Hawk Road and travel 9/10 ofa
mile. Then turn left onto Herbert Perry Road and follow the road to its southern end. The site is
located on the east side of the road.
Man-made features noted on the two lots include a 16 feet by 24 feet shed, 4 feet by 30 feet dock,
3 piers, and a 3 feet by 30 feet long bridge over the man-made basin. A review of NC DCM
records did not show previous permit involvement with the basin or other improvements. Erosion
of the basin's 4 feet tall west bank is such that the old bridge and piers have been undermined.
Aerial photos, taken 1984 to 1995, indicate that the west bank has been eroding at a rate of 1 foot
per year. The 6 feet-30 feet by 200 feet strip of land forming the east side of the basin appears to
be eroding at 2 feet per year. Adjacent shorelines, which are protected by concrete riprap, appear
to be relatively stable.
Elevation ranges 1 foot to 5 feet above Normal Water Level. Vegetation noted growing on the site
includes Salt meadow grass (Spartina patens), Black Needlerush (Juncus roemerianus), Soft rush
(Juncus effusus), Wax myrtle (Myrica cerifera), Common reed (Phragmites australis), and
Loblolly pine (Pinus taeda). The presence of 70 square feet of Coastal Wetlands vegetated with
Black N eedlerush and Salt meadow grass was noted along the shoreline just east of the shed. The
6 to 30 feet wide by 200 feet long strip of land, which forms the eastern side of the basin, is
vegetated with a mixture of non-coastal wetland species and irregularly flooded Black Needlerush
and Salt meadow grass.
The waters of Kitty Hawk Bay, in the vicinity of the project, are classified as SC by the NC
Environmental Management Commission. These waters are classified as Joint Waters by the NC
Marine Fisheries Commission and NC Wildlife Resources Commission, and as Estuarine/Public
Trust Waters by the NC Coastal Resources Commission. Water depths within the basin range 0.0
to 2.3 feet at NWL. The presence of shellfish or finfish resources was not observed during the
site inspection. The presence of submerged aquatic vegetation was not noted in the vicinity of the
project. Review of available information suggests that there are no known archeological sites or
geological formations associated with. the site.

PROJECT DESCRIPTION
. Create an 87 feet by 154 feet spoil retention basin with a capacity of 1,021 cubic yards
within high ground located 40 feet west of the basin. Proposed dimensions are:
o Berm base: 18 feet wide
o Berm top: 2 feet wide
o Berm height (inside): 4 feet tall
The basin's capacity appears adequate to handle the 881 cubic yards of spoil material to be
excavated.
. Construct 188 linear feet of wooden bulkhead along the NWL of the western shoreline of
the existing basin.
. Continue the above alignment a distance of 57 feet in a southerly direction in order to
contain the fill (dewatered spoil material), which is to be placed in the triangular portion of
the silted-in basin.
. Use a hydraulic dredge to excavate 787 cubic yards of silt/sand from a 10,625 square feet
area within the canal basin with an existing bottom contour of 2.0 feet below NWL to a
final contour of 4.0 feet below NWL.
. Hydraulically excavate 89 cubic yards of silt/sand from a 30 feet by 80 feet long access
channel in Kitty Hawk Bay with an existing bottom contour of 3.0 feet below NWL to a
finished contour (connecting depth) of 4.0 feet below NWL.
. Return the effluent from the bermed disposal area to the basin area being dredged.
. Excavate 5 cubic yards of silt/sand from an 11 feet by 12 feet area at the south end of the
basin and then place 3 cubic yards of concrete to form a 12 feet by 40 feet concrete boat
ramp.
. Construct a 12 feet by 58 feet gravel approach to the boat ramp.
. Place 270 cubic yards of the dewatered spoil material within the 2,242 square feet of basin
located landward of the 57 feet long bulkhead. Starting depth of the fill area is 0.75 feet
below NWL and the proposed final elevation of the area will be 2.5 feet above NWL.
This area of the basin appears to have been created within uplands.
. Add 40 linear feet of new rock riprap to the existing 16 feet riprap section to create a 56
feet long riprap groin paralleling the new access channel.
. Reconstruct 112 linear feet of bulkhead along the south end of the basin to tie into a
proposed groin. Construct a 5 feet by 112 feet dock just landward of the bulkhead.

. Construct 175 feet of wood marsh enhancement breakwater along the western shoreline of
the basin a distance of 2 to 5 feet waterward of NWL.
. Place a 5 feet wide by 268 feet long section of riprap a maximum distance of 5 feet
waterward of NWL along the bay side of the 5 feet wide island which forms the western
boundary of the basin. Then, continue to place riprap around the 30 feet wide area of
Coastal Wetlands, lying north of the mouth of the basin.
. Construct a 10 feet by 40 feet boathouse within the northwest corner of the basin. (There
are no dock spaces proposed as a part of this development.)
. Repair the 16 feet by 24 feet shed in its existing location.
. Construct a 6 feet by 52 feet wood bridge across the basin at its north end.
ANTICIPATED IMPACTS
. Dredging within the basin/canal and access channel will eliminate 13, 157 square feet of
Estuarine/Public Trust Shallow Water Habitat.
· The installation of deadmen and filling activities associated with the installation of 382
linear feet of bulkhead will disturb 5,730 square feet of high ground located within the 30-
foot buffer and will result in the filling of 100 square feet of Coastal Wetlands.
. Filling the triangular area of the existing basin will eliminate 2,242 square feet of
Estuarine/Public Trust Shallow Water Habitat.
. The construction and filling of the bermed spoil containment basin, and the placement of
gravel within a 12 feet by 58 feet boat ramp approach, will result in the disturbance of
14,096 square feet of high ground located outside the 30-foot wide buffer.
. The placement of a 5 feet wide section of riprap along 268 feet of the shoreline of Kitty
Hawk Bay and along the mouth of the canal will eliminate 1,340 square feet of
Estuarine/Public Trust Shallow Water Habitat.
· The placement of an additional 8 feet by 40 feet section of riprap to create a 56 feet long
riprap groin will eliminate 320 square feet of Estuarine/Public Trust Shallow Water
Habitat.
. The construction of a 10 feet by 40 feet boathouse and a 6 feet by 52 feet bridge over the
waters of the basin will shade 712 square feet of Estuarine/Public Trust Waters.

The applicants own adjacent parcels, which were previously used for conunercial fishing purposes. This
use left the property with multiple piers, docks, and an oversized basin. Although these parcels are
residential lots, NO residences, living quarters or wastewater disposal systems are requested or authorized
by this application.

The proposed work will allow both property owners to utilize the canal and basin to dock boats while
accomplish all work under one permit request. The canal and basin has silted in since the last dredging
activity and the depth to hard sand substrate varies from -5.5 in the canal to -4.0 feet through the silt in the
basin. This request will remove the silt accumulation and produce a consistent 4.0 bottom depth.
The portion of the basin on lot 4 to be filled has silted in to the point that it is unusable at this time. Normal
water level only allows for depths ofless averaging 0.5 feet. Filling this area will also allow for future
maintenance excavation of the basin and canal to be accomplished without use of hydraulic dredging.
Lessening cumulative impacts from spoil disposal effluent in future maintenance. The access channel will
be supplemented with a riprap groin to lessen the need for maintenance dredging requests. Removing the
silt will promote flushing of the basin, maintain navigable depths, and canal to aid in improving long-term
water quality
