4h. Explain the purpose of the proposed project:*
Washed out pipe needs replacing so that the roadway can be repaired.
41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:*
The wasting structure is a 128"x83" corrugated metal pipe arch that is 35' long with headwalls. The proposed structure is a 12'11" x 7'6" corrugated aluminum structural plate pipe arch
that is 50' 2" ft long with headwalls. Rip will be installed underlined with geotextile along the stream banks at the tie in points for long term stability. In order to maintain a dry work area
temporary dewatering and pump around will be necessary. Note the new structure is 16ft longer which will allowfor a skew on the pipe to better align with the stream so that the stream
doesn't make a right turn at the roadway fill. Equipment to be used includes an excavator, backhoe, grader, crane, etc.
4j. Please upload project drawings for the proposed project.
5. Jurisdictional Determinations
5a. Have the wetlands or streams been delineated on the property or proposed impact areas?*
R Yes r No O Unknown
Comments:
Wetland impacts are calculated out to the proposed right -of -entry; however it is anticipated that the
mechanized clearing area will provide temporary access only for dewatering measures and will be
minimized during the site work. Therefore no mitigation is proposed.
5b. If the Corps made a jurisdictional determination, what type of determination was made?

6i. Comments:
This is a pipe replacement project not a road improvement project. The existing pipe will be 16ft longer only to provide a better skew for the stream so
that the creek doesn't have to make a 90 degree turn into the pipe which eats away at the fill slope. Minimal tree removal right at the pipe is proposed
for installation, the remaining buffer impacts are within maintained power line R/W and is for access only for devmtering measures. Therefore no buffer
mitigation is proposed.

E. Impact Justification and Mitigation U
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
Stream impacts will be minimized onsite including rip rap bank stabilization where possible. Rip rap armoring along the stream will be limited to only
amount necessary to ensure long term stability.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Sediment and erosion control Best Management Practices for protection of surface waters will be enforced during project construction.
2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State
2a. Does the project require Compensatory Mitigation for impacts to Waters of the U.S. or Waters of the State?
r Yes r No
2b. If this project DOES NOT require Compensatory Mitigation, explain why:
This is a pipe replacement project not a road improvement project. The existing pipe will be 16ft longer only to provide a better skew for the stream so that the creek doesn't have to
make a 90 degree turn into the pipe which eats away at the fill slope. Mitigation is typically not required for maintenance work to replace an existing structure.
F. Stormwater Management and Diffuse Flow Plan (required by DWR)
1. Diffuse Flow Plan
1a. Does the project include or is it adjacent to protected riparian buffers identified within one of the NC Riparian Buffer Protection Rules?
r Yes r No
What type of SCM are you providing?
r Level Spreader
r Vegetated Conveyance (lower SHWT)
r Wetland Swale (higher SHWT)
r Other SCM that removes minimum 30 % nitrogen
W Proposed project will not create concentrated stormwater flow through the buffer
