Blvd. After reviewing your application, we have determined that this project is covered by Water Quality General Certification Number 3402, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands. The General Certification allows you to use Nationwide Permit Number 39 once it is issued to you by the U.S. Army Corps of Engineers. Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. The above noted Certification will expire when the associated 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing, and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter; and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed in the attached Certification, as well as the additional conditions listed below: 1. The work conducted at Impacts #1 and #3 to stabilize and restore the stream channels shall be monitored for three (3) years. If during the monitoring period the stream banks are observed to be eroding, sloughing, or collapsing, DWQ shall be notified and an updated stream stabilization plan shall be submitted for DWQ approval. If the work is not conducted according to the submitted plan then this approval is no longer valid. 2. All constructed stormwater conveyance outlets shall be directed as diffuse flow at non-erosive velocities through the protected stream buffer such that it will not re-concentrate before discharging into a stream or Lake Wylie. This includes the constructed stormwater discharge outlet located on lot 36. If this is not possible, a stormwater management plan for the project shall be provided to this Office before occupancy of any facilities at the site. The plan shall specify all stormwater discharge points, plan details, and calculations to indicate that diffuse flow through the protected buffer will be achieved. 3. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds on the property. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). A sample deed notification format can be downloaded from the 401/Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands. 4. The culverts required for this project shall be installed in such a manner that the original stream profiles are not altered (i.e. the depth of the channel must not be reduced by a widening of the streambed). Existing stream dimensions (including the pattern and profile) are to be maintained above and below locations of each culvert. The culverts shall be designed and installed to allow for aquatic life movement as well as to prevent head cutting of the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall be re-established or, if the pipes are installed in a perched manner, the pipes shall be removed and re-installed correctly. The applicant must submit a plan and receive written approval from this office to address any head cutting that will occur as a result of this project (e.g., use of cross vanes downstream of the culvert). Use of native vegetation and other soft streambank stabilization techniques must be used where practicable instead of riprap or other bank hardening methods. If riprap is necessary, it shall not be place in the streambed, unless approved by the DWQ. 5. We understand that you have chosen to contribute to the Ecosystem Enhancement Program (EEP) in order to compensate for the stream and wetland impacts. In accordance with 15A NCAC 2R .0402 and 15A NCAC 2B .0242(7), this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H .0506(h) and 15A NCAC 2B .0233(10). Until the EEP receives and clears your check (made payable to: DENR - Ecosystem Enhancement Program), the stream and wetland impacts shall not occur. For accounting purposes, this Certification authorizes the fill of 0.17 acre of wetland and 295 linear feet of perennial stream in the Catawba River Basin, Cataloging Units 03050101 and 03050102. Two hundred ninety five linear feet (295 If) of stream mitigation is required. Please be aware that the EEP rules require rounding of wetland impacts to the nearest foot/ quarter acre (15A NCAC 2R .0503(b)). 6. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notification application. All construction activities shall be performed so that no violations of state water quality standards, statutes, or rules occur. 7. Erosion and sediment control practices must utilize Best Management Practices (BMP) and be in full compliance with all specifications governing the proper design, installation, and operation and maintenance of such BMP in order to protect surface water standards: L 8. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date the Division of Land Resources has released the project. 9. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of Completion" form to the 401/Wetlands Unit of the NC Division of Water Quality. 10. Continuing Compliance. North Star Investors (NSI) shall conduct its activities in a manner consistent with state water quality standards (including any requirements for compliance with section 303(d) of the Clean Water Act) and any other appropriate requirements of state and federal law. If DWQ determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that state or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate and modify this certification to include conditions appropriate to assure compliance with such standards and requirements in accordance with 15 A NCAC 2H.0507(d). Before codifying the certification, DWQ shall notify NSI and the US Army Corps of Engineers, provide public notice in accordance with 15A NCAC 2H.0503, and provide opportunity for public hearing in accordance with 15A NCAC 2H.0504. Any new or revised conditions shall be provided to NSI in writing, shall be provided to the United States Army Corps of Engineers for reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Klimek, P.E., Director September 8, 2004 Gaston County DWQ # 04-0776 On September 2, 2004 Mr. Alan Johnson and Ms. Polly Lespinasse of this office visited the subject site to inspect the work conducted to remove sediment from the stream channels and Lake Wylie that was observed during the initial site visit on July 7m. It was evident that some work had been done, however, excessive sediment depositions remained at all three crossing (Impacts #1, #2, and #3 on site plan). Specifically, the following was noted: Impact #1: Approximately 20' downstream of the culvert, approximately 18" of sediment was observed in the stream channel. At approximately 100' downstream of the culvert 10" of sediment was observed. In the lake, sediment deposition covered approximately 250 square feet It also appears that the sediment removed from the stream channel was disposed on and spread over the riparian area. The upstream side of the culvert was to be restored to a more natural grade with vegetative plantings. This has not been done. It also appears that additional sediment is entering the stream from a sediment basin just upstream of the culvert. • Impact #2: While no measurements were taken, sediment accumulations were observed in the stream channel and cove of the lake. • Impact #3: Approximately 30' down stream of the second check dam approximately 14" of sediment was observed in the stream channel. Approximately 30" of sediment was noted 75' downstream of the check dam. Sediment deposition in the lake was also observed. The upstream side of the culvert was to be restored to a more natural grade with vegetative plantings. This has not been done. The stormwater must be discharged as diffuse flow through the 50' buffer. It was observed that approximately 200 ft. of stream below the road crossing and 750 ft. of stream above the road crossing had been impacted from sediment deposition ranging from 5" to 18" in depth. The origin of the sediment appeared to be from the main sediment basin located under the power lines north of the main entrance. The sediment must be removed from the channel. While the shovel and bucket method of removal is acceptable for the removal of the main sediment deposits, a less intrusive method (low impact) is required for removal of the remaining sediment. The natural streambed (sand/pebble/cobble stone) must be protected. The following items were also observed during the site visit: • Immediately above road crossing #5 it was observed that approximately 50 ft. of channel had been removed, as well as all vegetation adjacent to the channel. The area was left bear with no silt fence to prevent more sediment from entering the stream. The area must be stabilized and the channel must be restored and vegetation replanted (2" caliper, native specie trees). • The culvert was not properly installed. The down stream end of the culvert was perched thus preventing the movement of aquatic life upstream (Condition #9, General Certification #3402). The culvert must be reinstalled or measures taken to facilitate the movement of aquatic life upstream and downstream of the culvert. • The stormwater outfall at road crossing # 3 must be reworked. Flow from the outfall must be diffused so as to prevent erosion and scouring in the buffer. All construction activities shall be performed so that no violations of state water quality standards, statutes, or rules occur. 7. Erosion and sediment control practices must utilize Best Management Practices (BMP) and be in full compliance with all specifications governing the proper design, installation, and operation and maintenance of such BMP in order to protect surface water standards: and the Mooresville Regional Office beginning in January 2005. If during the monitoring period the stream banks are observed to be eroding, sloughing, or collapsing, DWQ shall be noted and an updated stream stabilization plan shall be submitted for DWQ approval. If the work is not conducted according to the submitted plan then this approval is no longer valid. 2. All constructed stormwater conveyance outlets shall be directed as diffuse flow at non-erosive velocities through the protected stream buffer such that it will not re-concentrate before discharging into a stream or Lake Wylie. This includes the constructed stormwater discharge outlet located on lot 36. If this is not possible, a stormwater management plan for the project shall be provided to this Office before occupancy of any facilities at the site. The plan shall specify all stormwater discharge points, plan details, and calculations to indicate that diffuse flow through the protected buffer will be achieved. 3. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds on the property. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). A sample deed notification format can be downloaded from the 401/Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetiands. 4. The culverts required for this project shall be installed in such a manner that the original stream profiles are not altered (i.e. the depth of the channel must not be reduced by a widening of the streambed). Existing stream dimensions (including the pattern and profile) are to be maintained above and below locations of each culvert. The culverts shall be designed and installed to allow for aquatic life movement as well as to prevent head cutting of the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall be re-established or, if the pipes are installed in a perched manner, the pipes shall be removed and re-installed correctly. The applicant must submit a plan and receive written approval from this office to address any head cutting that will occur as a result of this project (e.g., use of cross vanes downstream of the culvert). Use of native vegetation and other soft streambank stabilization techniques must be used where practicable instead of riprap or other bank hardening methods. If riprap is necessary, it shall not be place in the streambed, unless approved by the DWQ. 5. We understand that you have chosen to contribute to the Ecosystem Enhancement Program (EEP) in order to compensate for the stream and wetland impacts. The outlets are located outside of the 50 foot riparian buffer and are sized with 1 foot diameter rip-rap and we believe that they meet the diffuse flow requirement. Their preferred energy dissipaters are rip-rap aprons that we had engineered in accordance with their review process. We respectfully request that you coordinate with the County to resolve any outstanding issues. It seems that we may now be contrary to local requirements and as such we have no way to determine how to address this concern. 4) Attached is a letter from the NC EEP; unfortunately it took the EEP two months to respond to our request. The Corps has agreed to the special provision allowing out-of-kind mitigation. We have been permitted for all crossings by the Corps as attached. 5) Through coordination with Gaston County and the land planner the applicant is prepared to add restrictive language to all lots that contain wetlands and streams. 6) Again, through coordination with their various consultants and through the approval process the applicant identified the need for the 50' buffer to the lake; the buffer is clearly identified on the maps that were submitted with the application. 7) We indicated in the application that there is a separate permit application being filed for the marina. We expect that you can coordinate the concurrent review of the permit applications in your office. Any buffer encroachment will be identified in the application for the marina. The local approval process, which includes review by the Lake Wylie Marine Commission, nearly eliminates the possibility of submitting the application for the marina with the rest of the development. We understand that the permit for the marina has been issued but have not been able to confirm it. 8) Your staff performed a site review and that during the review that three of the five crossings were installed. One crossing was permitted by the Corps as a separate project and the other two were installed without 401 certification. We understand that the project is not compliant with the certification process of the Corps of Engineers permit and we seek a quick resolution. All impacts, except Crossings 1 and 5, are of dry channels. Therefore, avoidance and minimization, though important, are not critical and that these crossing would likely have been certified by your office. Additionally, during our July 1, 2004 field assessment it was Mr. Johnson that assessed the depth of the sediment to be between 15 and 18 inches deep with only one area reaching 30 inches; we are simply re-stating the average impact not the maximum impact. We state our disagreement not because we refute the overall findings but because as presented they have the effect of characterizing the violation as more egregious than it may be. We are working with Mr. Reeve, the contractor, the design engineer, and others to bring to a closure this incident. It is not Mr. Reeve's intention to be in violation of any regulations but as a consequence of his accelerated development timelines he finds himself needing to restore your confidence in his firm. The current outlet protection was designed with the intent of reducing flow velocities consistent with engineering practices. The flow characteristics of the outlet are modeled to be non-erosive while spreading the flow over a greater area. • Attached are copies of the last 8 weeks of inspection reports. We must point out that the attached logs from the Morgan Corporation have a formatting error starting on April 25, 2004. From that date on, the "General Information" portion of the "Storm Water Retention Log" has been tabbed incorrectly for the "Yes", "No", and "N/a" entries. Thus, from May 2, 2004 and on, the logs do not represent that the site is in fact in good condition as validated by the corresponding Gaston County Inspection Reports that are collated into the attached inspections. Additionally, the Morgan Corporation records have an automatic formatting problem that has replaced the tem "silt" with the term "silk". • The detailed accounting of the linear feet of streams impacted by sedimentation is found in Table 1. We have chosen this method to reduce reproduction costs. • We have contacted Backwater Environmental and others to draft the design plan. Generally speaking, the channel will be constructed as a rock riffle that will be stable for the anticipated discharges. We believe that the pre- formed constructed riffle will provide the most stable outlet condition at the discharge point. Interspersed within the riffle will be trees and shrubs that are typically found adjacent to intermittent streams such as arrow wood, dogwood, and others. • This letter serves as notification that the streambeds are currently being returned to the original grade. During the site visit it was observed that four of the five proposed impacts had already been completed. On July 1, 2004, Mr. Alan Johnson and Ms. Lespinasse of this office, along with Mr. Robert Gordon. Gaston County Soil and Water District, Mr. Mike Reeve, Project Manager, and Mr. Chris Huysman, consultant, conducted a follow-up investigation. During the follow-up investigation the following impacts were observed: • Total impacts to the streams due to the unapproved road crossings were approximately 400 feet. • At "Impact 43" the stream had been relocated adding an additional 82 feet to the proposed stream impacts. The relocated stream discharged not into a reconstructed stream channel, but was allowed to discharge through 12- inch diameter rip rap and then flowed overland for approximately 70 feet into Lake Wylie. • Sediment deposition of up to 36 inches deep was observed below impacts ""1, 42, and 43. The sediment was observed up to 150 ft. downstream of the initial impact at impact nl and 42. This letter is being issued as a Notice of Violation and Notice of Recommendation for Enforcement for failure to obtain a 401 Water Quality Certification for the unapproved impacts(NCAC 15A .02H .0500) and for the excessive sediment deposition observed in the streams affecting the aquatic habitat (15A NCAC 2B .0211 (2)). Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing.
