You have our approval, in accordance with the attached conditions and those listed below, to instal~ rip
rap within 0.05 acres of water along 750 feet of shoreline alol1g the west facing bank of the "c010n
are" on Lake James for shoreline stabilization, as described within your application dated March 30,
2004. After reviewing your application, we have decided that the impacts are covered by the .C.
Division of Water Quality (DWQ) General Water Quality Certification Number 3399 (GC3399). he
Certification(s) allows you to use Nationwide Permit No. 13 when issued by the US Army Corp~ of
Engineers (US ACE) , This letter shall also act as your approved Authorization Certificate for impacts to
the protected riparian buffers per 15A NCAC 2B ,0243. In addition, you should obtain or otherWise
comply with any other required federal, state or local permits before you go ahead with your p;'~ect
including (but not limited to) Erosion and Sediment Control and Duke Power regulations and pe 'ts.
Also, this approval will expire when the accompanying 404 permit expires unless otherwise specifi din
the General Certification. I

This approval is only valid for the purpose and design that you described in your application. J you
change your project, you must notify us and yOll may be required to send us a new application. If the
property is sold, the new owner must be given. a copy of this Certification and approval letter a~d is
thereby responsible for complying with all conditions. For this approval to be valid, you must follot the
conditions listed in the attached certification and any additional conditions listed below. I

Diffuse Flow
An additional condition is that all stormwater shall be directed as diffuse flow at non-e~sive
velocities through the protected stream buffers and will not re-concentrate before disch ging
into the stream as identified within 15A NCAC 2B .0243(5).

2. Rip rap
The rip rap shall be installed from the water by use of a barge to minimize shoreline disturbance.
The rip rap shall be installed to active erosion areas and shall not exceed a height near the high
water level.
3. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable.
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality,
1650 Mail Service Center, Raleigh, NC, 27699-1650.
If you do not accept any of the conditions of this Certification (associated with the approved wetland or
stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that
you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of
the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved
buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is
subject to review as provided in Articles 3 and 4 of G.S. 150B.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
Act and the Catawba riparian buffer protection rule as described within 15A NCAC 2B .0243. If you

Ill. Project Information
^ ttach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to sunounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the propetiy
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,

Dear Mr. Zimmerman:
The letter serves both as notification of the issuance of a McDowell County Shoreline
Protection Permit and authorization for the commencement of work on the property. A
survey of the existing condition of your property has been completed as required by the
Lake James Shoreline Protection Ordinance. This process allows for the documentation
of the existing condition of the property prior to development. The relevant figures
specific to your lot are as follows:

Prior to any land disturbing activity within 50 feet of the shoreline, any trees that
are to be removed will need to be marked, At that time I will need to be contacted to
make a site visit to record all the necessary measurements before any trees are cut.
Trees can removed within the 50 foot buffer to clear winding foot paths and allow access
to boat docks, but they must be replaced with trees totaling an equivalent diameter
somewhere within the 50 foot buffer.

We received your FebflJary 11,2004 letter that clarified the use of rock stabilization 0 the
opposite side ofthe common area from the proposed Sunset Point Marina; stabilization would ot be uscd
in the ~narina area its.e!f. ?n February 24, ~004, w~ visite? th~ projec~ site and found that most\ofthe
shorellnc whcre stabIlIzation would occur IS compnsed of a hIgh erodmg clay bank. Therefore,\ we can
concur with the stabili7..ation in this area. However, as we discussed on February 26, 2004, we Will likely
provide recommendations on the subsequent pennit application for the stabilization work, WhiC\Will
include, in part, constructing the structure from the water to minimize shoreline disturbance, lim ting the
rock to active erosion areas and to a height near the high water level, and maintaining the existin woody
debris in the lake to provide fish habitat.
