Approval of 401 Water Quality Certification and Authorization Certificate per the Neuse River
Buffer Protection Rules (15A NCAC 2B .0233) with Additional Conditions
Dear Mr. Perry:
You have our approval, in accordance with the attached conditions and those listed below, to place fill
within or otherwise impact 0.0013 acres of wetlands, 138 feet of streams and 8,886 square feet (ft) of
protected riparian buffers for the purpose of constructing an access road for a subdivision at the subject
property, as described within your application dated June 10, 2004 and received by the N.C. Division of
Water Quality (DWQ) on June 10, 2004. After reviewing your application, we have decided that the
impacts are covered by General Water Quality Certification Number(s) 3402 (GC3402). The
Certification(s) allows you to use Nationwide Permit(s) 39 when issued by the US Army Corps of
Engineers (USAGE). This letter shall also act as your approved Authorization Certificate for impacts to
the protected riparian buffers per 15A NCAC 213 .0233. In addition, you should obtain or otherwise
comply with any other required federal, state or local permits before you go ahead with your project
including (but not limited to) Erosion and Sediment Control, and Non-discharge regulations. Also, this
approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in
your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H.0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.

The Additional Conditions of the Certification are:
1. Impacts Approved
The following impacts are hereby approved as long as all of the other specific and general
conditions of this Certification (or Isolated Wetland Permit) are met. No other impacts are
approved including incidental impacts:

2. Erosion & Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all specifications
governing the proper design, installation and operation and maintenance of such Best
Management Practices in order to protect surface waters standards:
a. The erosion and sediment control measures for the, project must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Sediment and Erosion Control Planning and Design\Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the most
recent version of the North Carolina Sediment and Erosion Control Manual. The devices
shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects,
including contractor-owned or leased borrow pits associated with the project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimentation Pollution Control Act.
3. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond
the footprint of the impacts depicted in the Pre-Construction Notification. All construction
activities, including the design, installation, operation, and maintenance of sediment and erosion
control Best Management Practices, shall be performed so that no violations of state water quality
standards, statutes, or rules occur.
4. No Sediment & Erosion Control Measures w/n Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum
extent practicable. If placement of sediment and erosion control devices in wetlands and waters
is unavoidable, they shall be removed and the natural grade restored within six months of the date
that the Division of Land Resources has released the project.

5. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality,
1650 Mail Service Center, Raleigh, NC, 27699-1650.
6. Diffuse Flow
An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive
velocities through the protected stream buffers and will not re-concentrate before discharging into
the stream as identified within 15A NCAC 2B .0243(5).
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved wetland or
stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that
you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of
the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved
buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is
subject to review as provided in Articles 3 and 4 of G.S. 150B.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
Act and the Neuse riparian buffer protection rule as described within 15A NCAC 2B .0233. If you have

WATER QUALITY SECTION
This letter is in response to your letter dated June 21, 2004 (copy attached), which
requested additional information for the Sunnybrook Road site. The following restates
your questions as shown on your letter and then provides our response.
1. It is unclear what activity will be taking place in the PhaseH "borrow/spoil area
phaseL " Will this activity include residential housing or open space?
The area in question, which is in Phase II, will be used on lots within phase I that
require slight fill in order to level the lot. This soil from this area isn't proposed to be
used in any wetlands or streams. When construction begins in Phase II the
borrow/spoil area will be graded to match surrounding grades and lots will be placed
on a portion of it with a road on the remaining portion.
2. Please provide calculations showing how the impervious area was determined.
Please find the attached calculations provided by McIntyre & Associates, which total
28.29% impervious surface area for the site.
3. Please provide a drainage plan including topography and all impacts.

The attached impact map includes the routing of the stormwater (i.e. drainage plan)
and also shows the topography. All impacts to buffers and jurisdictional features are
also shown on the attached map.
4. Please provide worksheet and an Operations and Maintenance Agreement for the
level spreaders proposed within your plan. This information can be found on our
website at http://h2o.enr.state.nc.us/ncwetlands.
Level spreaders and scour holes are shown on the attached map. Worksheets
corresponding to the proposed devices are attached as is an Operations and
Maintenance Agreement that has been signed and notarized.
5. Please provide across sectional detail that assures aquatic life passage.
Please find the attached cross sectional drawing from the project engineer that shows
the proposed 48" culvert buried one foot as per the regulations to allow for aquatic
life passage.

On June 10, 2004, the Division of Water Quality (DWQ) received your additional information on
the application dated April 30, 2004 to impact 0.0013 acres of wetlands, 138 feet of streams and
.204 acres of buffers to construct the proposed residential subdivision. The DWQ has determined
that your application was incomplete and/or provided inaccurate information as discussed below.
The DWQ will require additional information in order to process your application to impact
protected wetlands and/or streams on the subject property. Therefore, unless we receive the
additional information requested below, we will have to move toward denial of your application
as required by 15A NCAC 21-1.0506 and will place this project on hold as incomplete until we
receive this additional information. Please provide the following information so that we may
continue to review your project.

5. Please provide a cross sectional detail that assures aquatic life passage.
Please respond within three weeks of the date of this letter by sending this information to me in
writing and Steve Mitchell of the DWQ Raleigh Regional Office. If we do not hear from you
within three weeks, we will assume that you no longer want to pursue this project and we will
consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your application
are not authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr. John Dorney

LEVEL SPREADER OPERATION AND MAINTENANCE AGREEMENT
The Level Spreader system is defined as a vegetative means of dispersing storm water.
Maintenance activities shall be performed as follows:
Level spreaders or other structures that provide diffuse flow shall be maintained every six months. All
accumulated sediment and debris shall be removed from the structure, and a level elevation shall be
maintained across the entire flow spreading structure. Any down gradient erosion must be repaired and or
replanted as necessary.

On June 10, 2004, the Division of Water Quality (DWQ) received your additional information on
the application dated April 30, 2004 to impact 0.0013 acres of wetlands, 138 feet of streams and
.204 acres of buffers to construct the proposed residential subdivision. The DWQ has determined
that your application was incomplete and/or provided inaccurate information as discussed below.
The DWQ will require additional information in order to process your application to impact
protected wetlands and/or streams on the subject property. Therefore, unless we receive the
additional information requested below, we will have to move toward denial of your application
as required by 15A NCAC 2H.0506 and will place this project on hold as incomplete until we
receive this additional information. Please provide the following information so that we may
continue to review your project.

1. It is unclear what activity will be taking place in the Phase H "borrow/spoil area phase I."
Will this activity include residential housing or open space?

Dear Mr. Dorney:
This letter is in response to your letter dated May 6, 2004 (copy attached), which
requested additional information for the Sunnybrook Road site. Impacts to the
intermittent stream and the riparian buffers have been reduced further by using headwalls
and now total 138 linear feet of channel impacts, 0.0013 acre of wetland impacts, and
0.204 ft2 of buffer impacts. In addition to providing the additional information requested,
a revised PCN Form is also attached. Please replace the previously submitted
application with the attached revised application. The following restates your questions
as shown on your letter and then provides our response.
1. Please provide the location of any proposed stormwater management practices.
Following construction, the site will contain 28.89% impervious surface (i.e. less than
30% impervious surface), therefore, we do not believe a pre-approved stormwater
plan is required, however stormwater outlets are shown on the attached map with the
diffuse flow provisions at their outlets. The diffuse flow devices were designed as per
the DWQ specifications for level spreaders and scour holes.
2. Please provide details for the stormwater management practices.
The stormwater routing is shown on the attached map. Scour holes and level
spreaders will be employed to insure sheet flow into the buffers.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
A detailed delineation was conducted in order to develop a site plan that minimized impacts.
Impact # 1 is necessary to access the western portion of the site. Due to the presence of an
existing 2-acre pond in the center of the property, the impact could not be avoided entirely.
However, this impact has been minimized by crossing the stream at a point with minimal
wetland impact and has been further reduced big headwalls. In addition the applicant will
utilize BMP devices for water treatment.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration

1. Provide a brief description of the proposed mitigation plan. The description should provide

Dear Mrs. Burdette and Mr. Dorney,
On behalf of Sunnybrook, LLC, we hereby request authorization from the US Army Corps of
Engineers to use Nationwide Permit 39 to cover impacts to stream channels and jurisdictional
wetlands (see attached overall map). We also request written concurrence from the North
Carolina Division of Water Quality that the project complies with the 401 Water Quality
Certifications associated with Nationwide Permit 39 and the Neuse River Riparian Buffer Rules.
A Pre-construction Notification Application (PCN) is attached, which includes an agent
authorization form.
The proposed project consists of impacts from the construction of an access road for a residential
housing development. The site is located northwest of the intersection of Rock Quarry Road (SR
2542) and Sunnybrook Road (SR 2544). Interstate I-440 and a portion of the I-440 exit ramp for
I-40 make up the northwest boundary of the property. The site is approximately 51-acres in size,
and consists primarily of a mixed pine-hardwood forest. Please refer to the attached USGS map,
which displays the location of the proposed project.
S&EC conducted a detailed wetland delineation and Neuse River Buffer evaluation on June 11,
2003. Mr. Steve Mitchell of the NC-DWQ made a site visit and confirmed the buffers on June
24, 2003 (NBR 03-159).
The applicant requested a detailed wetland delineation and buffer evaluation on the property in
order to avoid jurisdictional features and riparian buffers to the maximum extent practicable. The
proposed residential road will impact approximately 0.003 acres of jurisdictional wetlands,
166 linear feet of perennial stream channel. These impacts are elaborated upon within the
attached PCN form and are shown on the attached inset impact maps.

The proposed road crossing (impact # 1) is necessary to gain access to the western portion of the
property. The road crossing will impact a segment of intermittent channel and associated buffers.
Due to the existence of a 2-acre pond near the center of the property, impacts could not be
avoided entirely. Crossing the stream below the pond will allow access to the area west of the
pond with minimal wetland/stream impacts. Following construction, the applicant will maintain
riparian buffers on the stream channels as well as employ BMP devices to preserve water quality.
Given the current mitigation policies of the USACE and the NC-DWQ, S&EC does not believe
wetland mitigation or buffer mitigation should be required but does believe that stream mitigation
will be required (Stream impact = 166 linear feet).
According to the engineer (McIntyre & Associates), the site will contain only 28.89% impervious
(i.e. less than 30% impervious surface). Therefore, we do not believe that this project requires a
pre-approved stormwater plan. Please see the attached calculations.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
A detailed delineation was conducted in order to develop a site plan that minimized impacts.
Impact # 1 is necessary to access the western portion of the site. Due to the presence of an
existing 2 -acre pond in the center of the property, the impact could not be avoided entirely.
However, this impact has been minimized by crossing the stream at a point with minimal
wetland impact In addition the applicant will utilize BMP devices for water treatment.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
