Dear Mr. Huffman & Needham:
You have our approval, in accordance with the attached conditions and those listed below, to
place fill within or otherwise impact approximately 0.001 acres of waters, 52.5 square feet (ft2)
of protected riparian buffers and approximately 12 feet of shoreline for the purpose of removing
a portion of an existing boat ramp located on Lot# 31 and install an equivalent amount on your
property (Lot# 32), as described within your application dated June 20, 2004. After reviewing
your application, we have decided that the impacts are covered by the N.C. Division of Water
Quality (DWQ) General Water Quality Certification Number(s) 3373 (GC3373). The
Certification(s) allows you to use Regional General Permit No. 198200030 when issued by the
US Army Corps of Engineers (USACE). This letter shall also act as your approved
" ,.... '.. Authorization Certificate for-impacts to the protected riparian buffers per 15A NCAC 2B .0243.
In addition, you should obtain or otherwise comply with any other required federal, state or local
permits before you go ahead with your project including (but not limited to) Erosion and
Sediment Control and Duke Power regulations and permits. Also, this approval to proceed
with your proposed impacts or to conduct impacts to waters as depicted in your application
shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and

Division of Water Quality, 1650 Maj.l Service Cent r, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in r vocation of this Certification and may
result in criminal and/or civil penalties. The authorization 0 proceed with your proposed
impacts or to conduct impacts to waters as depicted in yo application and as authorized by this
Certification shall expire upon expiration of the 404 or C Permit.
If you do not accept any of the conditions of this Certificat on (associated with the approved
wetland or stream impacts), you may ask for an adjudicato hearing. You must act within 60
days of the date that you receive this letter. To ask for a haring, send a written petition, which
conforms to Chapter 150B of the North Carolina General tatutes to the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699- 714. This certification and its

Any disputes over determinations regarding this Authorization Certificate (associated with the
approved buffer impacts) shall be referred in writing to the Director for a decision. The
Director's decision is subject to review as provided in Articles 3 and 4 of O.S. 150B.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean
Water Act and the Catawba riparian buffer protection rule as described within 15A NCAC 2B

Dear Alan,
I spoke with Mr. Mike Parker today with regard to lot 32 on Ponderosa Road. The basic
situation is this; I inherited lot 32 and lot 31 from my family approximately 6.5 yrs ago.
I then had a survey and appraisal done on Lot 31 and Lot 32. There is currently, a house on ,~.
Lot 31-as that is the house that I lived in with my family from 1974 to 1980 when I went off t,
to college. The survey was performed by Pippin Land Surveying. At the time of the survey
Mr. Pippin noted to me that the concrete boat ramp located on Lot 32-- shown on the survey
did extend out over the Lot 31 which I was planning to sell. He indicated at that time that it
would be best to move the lot line to have the concrete ramp located fully on lot 32, the lot I
was going to keep. Based upon this I gave to him my approval to do this---however the
survey was not recorded at the County office. This fact was realized by me and the current
owners of Lot 31 approximately 6-7 months ago. Until that time all parties had accepted the
Pippin survey.
However once the current owners realized that the Pippin survey was not recorded properly
-they expressed their desire to their new found property. I consulted a lawyer to explore
options -and it was decided that the cost for me to try to re~over the property would not be
something that should be pursued. My lawyer did not feel that this would have a negative
impact upon the property value -and he did not feel that the concrete ramp being located
slightly on the other lot would be a problem for the owners of lot 31 (the concrete ramp was
build on the property around approx. (1976-1977). However within the last several weeks
the ramp situation has become a problem. The owners of Lot 31 have indicated to me that
they do not wish for the owners of Lot 33 (the Dixons) using their property-the very last part
of the ramp. To prevent the Dixon's from using the ramp they drilled holes in the ramp and
placed steel rebar in the holes and then cemented the rebar into the ramp. The rebar now
extends up out of the concrete ramp approximately 5 feet. (The rebar was later removed
and replaced by a telephone pole.)
I have since spoken with the owners of lot 31-advised them that it would be best to remove
the rebar as this is a safety hazard. They originally did not agree that they had to move -but
have now come to the understanding that they must move the rebar as they now have been
noticed of this by Ms. Ann Duncan of Duke Energy.

At present I wish to resolve this issue to best suit all parties while still maintaining if possible
the ramp. I have found that I can not negotiate with the owners of Lot 31-therefore I feel it
best to remove the portion of the ramp located on their property. Mr. Parker indicated to me
that this is proper and legal to do. Also I would like to ask for permission to put back and f
equal amount as the amount removed onto my lot-lot #32. Therefore the ramp will be
usable. Please advise if this is possible. Also would it be possible for someone to indicate
to me as to what point I should remove the concrete pad---is it to the Pier Projection line
which is shown on the survey---or is it to some other point---Iot projection line ??? I wish to
do what is necessary to make the owners of lot 31 happy. I look forward to your assistance.

0.001 acres of waters and 0.004 acres of protected riparian buffers to remove a portion of an existing boat ramp located
on Lot # 31 and install an equivalent amount on your property (Lot # 32). The proposed activity does not require a Minor
Variance under the Catawba River Buffer Rule (15A NCAC 02B .0243). The proposed activity is classified as a "water
dependent activity" use within the Catawba Buffer Rule. This use is currently designated as "exempf' and does not
require written authorization from the DWQ. However, the DWQ has determined that this activity will require DWQ
approval for the use of General Water Quality Certification No. 3373. As such, the DWQ has determined that your
application was incomplete as discussed below. The DWQ will require additional information in order to process your
application to impact protected waters on the subject property. Therefore, unless we receive the additional information
requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and 2B
.0243(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the
following information so that we may continue to revie:w your project.
o Application - Please complete the attached application and return the original and two (2) copies to this office. Be sure
to include the required application fee of $200. Checks should be made out to the N.C. Division of Water Quality.
Please respond within three weeks of the date of this letter by sending this information to me in writing and Mr. Alan
Johnson of the DWQ Mooresville Regional Office. If we do not hear from you within three weeks, we will assume that you
no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the
application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any

Dear Alan,
I spoke with Mr. Mike Parker today with regarq to lot 32 on Ponderosa Road. The basic
situation is this; I inherited lot 32 and lot 31 from my family approximately 6.5 yrs ago.
I then had a survey and appraisal done on Lo~ 31 and Lot 32. There is currently a house on
Lot 31-as that is the house that I lived in with my family from 1974 to 1980 when I went off
to college. The survey was performed by Pippin:Land Surveying. At the time of the survey
Mr. Pippin noted to me that the concrete boat ramp located on Lot 32-- shown on the survey
did extend out over the Lot 31 which I was planning to sell. He indicated at that time that it
would be best to move the lot line to have the concrete ramp located fully on lot 32, the lot I
was going to keep. Based upon this I gave to him my approval to do this---however the
survey was not recorded at the County office. This fact was realized by me and the current
owners of Lot 31 approximately 6-7 months ago. Until that time all parties had accepted the
Pippin survey.
However once the current owners realized that the Pippin survey was not recorded properly
-they expressed their desire to their new found property. I consulted a lawyer to explore
options -and it was decided that the cost for me to try to recover the property would not be
something that should be pursued. My lawyer did not feel that this would have a negative
impact upon the property value -and he did not feel that the concrete ramp being located
slightly on the other lot would be a problem for the owners of lot 31 (the concrete ramp was
build on the property around approx. (1976-1977). However within the last several weeks
the ramp situation has become a problem. The owners of Lot 31 have indicated to me that
they do notwish for the owners of Lot 33 (the Dixons) using their property-the very last part
of the ramp. To prevent the Dixon's from using the ramp they drilled holes in the ramp and
placed steel rebar in the holes and then cemented the rebar into the ramp. The rebar now
extends up out of the concrete ramp approximately 5 feet. (The rebar was later removed
and replaced by a telephone pole.)
I have since spoken with the owners of lot 31-advised them that it would be best to remove
the rebar as this is a safety hazard. They originally did not agree that they had to move -but
have now come to the understanding that they must move the rebar as they now have been
noticed of this by Ms. Ann Duncan of Duke Energy.

At present I wish to resolve this issue to best suit all parties while still maintaining if possible
the ramp. I have found that I can not negotiate with the owners of Lot 31-therefore I feel it
best to remove the portion of the ramp located on their property. Mr. Parker indicated to me
that this is proper and legal to do. Also I would like to ask for permission to put back and
equal amount as the amount removed onto my lot-lot #32. Therefore the ramp will be
usable. Please advise if this is possible. Also wduld it be possible for someone to indicate
to me as to what point I should remove the concrete pad---is it to the Pier Projection line
which is shown on the survey---or is it to some other point---Iot projection line ??? I wish to
do what is necessary to make the owners, of lot 3~ happy. I look forward to your assistance.
